International audienceBetween 1616 and 1618 the most important institutions of the Republic of Venice had to deal with the case of a band of individuals, which ran around in the territories of Treviso and bordering areas (Padovano and Vicentino). That band was accused of being responsible of several robberies, arsons and murders. The uncatchable protagonist of those events and the undisputed leader of that group was a very peculiar person: Zuanne Dalle Tavole, a former priest. Eine Stadt auf der Grundlage ihrer Gerichtsakten zu „enthüllen“ – das war das ambitionierte Ziel, das sich Herausgeber/innen und Autor/innen am Beispiel von Vicenza, einer mittelgroßen Provinzhauptstadt des unter österreichischer Herrschaft stehenden Königreichs Lombardo-Venetien, gesetzt haben Das Vorhaben kann als gelungen bezeichnet werden, der vorliegende Band verdeutlicht den hohen Stand an rechtshistorischer Forschung in Italien Die Studie zeichnet sich durch dreierlei aus: einmal durch den reichhaltigen, im Staatsarchiv von Vicenza aufbewahrten Quellenbestand, nämlich die vollständig erhaltenen Prozessakten des österreichischen „Tribunale di giustizia“ für den Zeitraum zwischen 1815 und 1866; weiters durch den originellen Ansatz, in Form einer ‚dichten Erzählung‘ (um das berühmte Diktum von Clifford Geertz sinngemäß abzuwandeln) einzelne Fallstudien auf der Grundlage der Gerichtsverhandlungen zu rekonstruieren, wobei Angeklagte, Zeugen, Opfer, Ankläger und Richter im ‚Originalton‘ zu Wort kommen; drittens dadurch, dass die erzählten Geschichten auch topographisch anhand von zeitgenössischen Katastertafeln im Raum der Stadt bzw ihrem Umfeld verortet werden, was die Anschaulichkeit der Fälle zusätzlich erhöht Zwischen den Texten finden sich überdies auch spätere, wohl ebenfalls im Archiv der Stadt verwahrte bzw neu hergestellte Fotografien der jeweils in Rede stehenden Straßen, Plätze und Gebäude, in welchen die geschilderten Geschichten spielten Wie die Herausgeber einleitend hervorheben, wird durch diese besondere Form der Narration von Delikten und ihrer gerichtlichen Ahndung ein unmittelbarer Einblick in die soziale Wirklichkeit der Stadt gegeben; aber ebenso lassen sich anhand der Akten der ‚gelehrte Diskurs‘ und die rechtlichen Vorstellungen – einschließlich der ‚nicht geschriebenen Regeln‘ – erkennen, welche die mit den Fällen befassten Zeitgenossen in Sprache kleideten Denn zwar bot die gesetzliche Grundlage für die verschiedenen Prozesse das österreichische Strafgesetzbuch von 1803 (in Lombardo-Venetien 1815 eingeführt), doch war es letztlich immer auch eine richterliche Ermessensfrage, welches Delikt in welcher Form bestraft zu werden hatte, und welchen Zeugen mehr Glauben geschenkt werden sollte Diese unterschiedlichen Einschätzungen werden am von Claud io Povolo analysierten – heute wieder höchst aktuellen – Fall der Maria Kuhweiner („suonatrice di chitarra e girovaga“, 33–64), einer jungen aus Kärnten stammenden umherziehenden Musikerin, besonders eindrucksvoll dargelegt Diese hatte im Juli 1839 nach einer nächtlichen Tour durch verschiedene Wirtshäuser mit vier Männern einen von diesen der versuchten Vergewaltigung beim Gericht angezeigt Die Schilderung der Zeugenaussagen (sie hätten nichts eindeutig wahrgenommen, da sich das Geschehene in einer Seitengasse abge-

The goal of the present work is to offer a detailed account of the most significant results of a three-year study of the commissari distrettuali employed by the Empire in the so-called Habsburg Provinces of the Veneto in the first half of the 19th century, especially from 1819, the year in which this position was officially created, until 1848, when revolutionary movements put an end to the so-called “second Austrian domination” in the former territories of the Serenissima.

The book gathers a series of Judicial documents (called referati) of the first half of nineteenth century in which the judges of the court of Vicenza who instructed the trials resumed the inquiries undertaken and proposed to their colleagues the possible penalty to inflict to the defendants. These documents are interesting for their judicial value but also for the ethnographic informations which they can give to the historians.

Tra il 1616 e il 1618 le più importanti magistrature veneziane furono investite del caso di una banda di individui che scorrazzava nel Trevigiano e aree confi nanti (Padovano e Vicentino), rendendosi responsabile, tra l’altro, di azioni quali ruberie, incendi e omicidi. Protagonista inaff errabile di tali episodi e capo indiscusso di quel gruppo di uomini era Zuanne Dalle Tavole, un ex sacerdote. La ricostruzione della sua avventurosa vicenda e l’analisi delle contromisure messe in atto dalla Dominante, anche con l’ausilio delle autorità territoriali a ciò delegate, per neutralizzarne l’operato, costituiscono il nucleo principale del contenuto del presente contributo.
