Depuis l’accession au pouvoir le jeudi 24 janvier 2019 de M. Antoine-Félix Tshisekedi Tshilombo, Président de la République démocratique du Congo, une question intéresse l’opinion publique en général et le juriste congolais en particulier, celle de vouloir savoir si le Chef de l’État congolais, en plein exercice de ses fonctions, peut être mis en accusation et être destitué de ses fonctions du Président de la république.
Cette préoccupation a et continue à conduire à des analyses diverses, tant dans la presse écrite que dans les réseaux sociaux. Les intellectuels et les juristes prennent couleurs des hommes politiques en expliquant chacun selon sa coloration politique, ethnique, tribale ou selon ses sentiments personnels ; les constitutionnalistes, eux, observent de loin le débat, sans y apporter leur version scientifique attendue par la multitude, permettant ainsi la généralisation de l’intox dans le pays. Mais la question demeure, la déchéance d’un chef de l’État en exercice est-il possible en droit constitutionnel congolais dans son état actuel ? Le Congo a-t-il un système semblable aux systèmes américain et français de destitution du Président de la république ? Quelle interprétation peut-on donner aux dispositions constitutionnelles et légales congolaises pour fixer définitivement l’opinion sur la question ?
Pour répondre à ces préoccupations, nous tentons, dans cette réflexion, de préciser l’institution ayant le pouvoir de déclencher une procédure d’accusation, de poursuite et de déchéance d’un Président de la République congolais en fonction. En interprétant la Constitution et les lois de la république, nous dégageons la procédure à suivre, ainsi que les faits pour lesquels il est possible de parvenir à la destitution d’un chef de l’État en plein exercice.
La présente analyse se charge donc de répondre aux questions liées aux faits, aux institutions et aux procédures de poursuite d’un Président de la RDC en fonction telles qu’elles sont instituées en droit constitutionnel et en droit judiciaire congolais. Pour comprendre la particularité du droit constitutionnel congolais par rapport aux autres systèmes, un regard attentif sera jeté au fonctionnement des systèmes américain et français sur la même question.

The modern technological world is working towards exploring new dimensions in the field of Artificial Intelligence (AI). It is a well-known fact that AI is developing at a fast pace and in all likelihood, it will take over mankind in various sectors of the society. Such developments must be deliberated upon and requires the modification of the existing legislative framework in India. The main aim of this article is to address the uncertainty with respect to
the personhood of AI and to assess the intelligence of such a non-human entity. Although such inventions carry their own set of menaces, it is imperative that such developments should continue as it contributes to the progress of the country. A serious challenge with respect to the imposition of liability on AI has to be looked into, in the cases of negligence. This article deals with two ways in which such liability can be attributed. Firstly, by ascribing legal personality and making them accountable for their own acts. Secondly, by transferring it to their users or manufacturers. In the course of this article we will examine whether such AI systems will be capable of satisfying the essential requirements of personhood, i.e., possessing rights and duties. This raises the issue of the standard of care that shall be attributed to them in cases of negligence. Such standard of care shall be determined based on the degree of risk to which others are exposed and the aim to be attained by such a perilous activity. Abstract : The model of democracy has been universally accepted as the soundest, most people-oriented and efficient form of governance. It is currently the most widely employed administrative mechanism in the world, with nearly 167 countries currently making use of it. However, the ancient Athenian system presents a number of flaws that may provide different outcomes to different nations based on their economic and societal setup. This article seeks to provide a viable solution to counter these flaws and enhance the system of governance in countries across the world. The contours of this article deal with the functioning of a democracy, with special emphasis laid on the Indian administrative setup, and the various human traits that can serve as effective parameters for the proposed solution. This article primarily seeks to highlight the various fallacies of democracy and the need to counter such demerits in order to enhance the system of governance currently in practice. This article makes use of various analogies cited by different authors and makes use of comparative analyses between various nations to highlight the variance provided by a democratic setup and its outcome. The focal point of this article emphasizes on the need to implement a Political Eligibility Test (PET) to increase the efficiency of administration and quality of elected representatives in the Indian political arena. It shall also contain a basic framework of the suggested PET which shall function as a guiding model for its legislative implementation. The latent objective of this article is to alter and develop the current legal machinery to incorporate the changes necessary for improving the model of governance currently employed by various nations and to increase the quality of elected representatives capable of making better decisions, informed choices and sound laws for the benefit of the nation.

French abstract : Il est désormais acquis que la protection de l’environnement en milieu professionnel est indispensable. Comment dès lors rendre compte de cette donnée au Cameroun ? Le constat est clair : la législation sociale camerounaise souffre de l’obsolescence de ses textes et d’une adéquation relative de ceux-ci aux données actuelles du domaine environnemental. En accord avec les exigences internationales, la législation sociale camerounaise devrait réaménager les mesures préventives de protection de l’environnement en milieu professionnel et revisiter le système de réparation permettant d’asseoir ces mesures.
English abstract : It is now recognized that the environmental protection measures related to the workplace is an important element. However, in Cameroon, the domestic labor law does not take sufficiently into account this aspect of the workplace. The aim of this article is to discuss and address this practical issue in the light of the international environmental law requirements. The Cameroonian labor law needs to reorganize preventive measures related to the protection of the environment in the workplace and completely review the state-run reparation scheme aimed at laying down these measures.

En effet, l’engagement de cette responsabilité est généralement présenté comme le moyen de redonner du crédit à la justice lorsqu'une faute a été commise par ce dernier. Plusieurs régimes de responsabilité sont prévus mais, on peut finalement se demander si cet arsenal répressif contribue à assainir le « Monde » de la responsabilité du magistrat ? Ces régimes de responsabilité n’emportent pas vraiment l’adhésion des justiciables qui ont plutôt le sentiment qu’en pratique, il n’existe pas de véritable sanction pénale du magistrat. Parfois, le magistrat est même présenté
comme le dernier irresponsable d’un monde dans lequel plus personne n’échappe à son devoir de rendre des comptes devant les juridictions. Il importe de préciser que les magistrats sont responsables pénalement conformément au droit commun de la responsabilité, avec cette nuance

En effet, compte tenu de ses liens avec la colonisation, le Congo a reproduit, à l’indépendance en 1960, le modèle français de gouvernance, au détriment de la gouvernance traditionnelle qualifiée de rétrograde. Cette politique a entraîné la mise en sommeil des pratiques coutumières, fondement du pouvoir traditionnel. Cependant, on peut noter que malgré les tentatives d’affaiblissement du
pouvoir traditionnel par le droit et l’administration moderne, les pratiques traditionnelles d’organisation de la société continuent à s’appliquer et demeurent au centre de la vie communautaire. This piece concerns itself with a special category of credit institutions that has emerged in recent years, as a construction of insolvency law. It ponders upon the justifications for the existence of this peculiar but yet little understood legal category as well as its legal implications. Our findings reveal that the emergence of credit institutions of systemic importance is underpinned by both theoretical and practical imperatives, relating to the special law of bank insolvency. It is also justified by the proven ineffectiveness of traditional resolution tools in the resolution of this category. This notwithstanding, both economic and legal analysis do not clearly demarcate the borderlines of this notion, leaving it to be determined as a matter of urgency by banking supervisors during insolvency. The practical implications are primarily the application of a derogatory regime of insolvency rules. This work holds that the intended benefits of this institution can only be fully reaped, if its contents are fully regulated by law, for practical reasons relating to both the prevention and resolution of bank insolvency.

À l’occasion de la rédaction de la nouvelle constitution tunisienne, le pouvoir constituant semble être conscient de l’importance de l’impôt en tant qu’instrument de gouvernance qui peut être fatal pour la stabilité politique de l’Etat. Cela explique la volonté de constitutionnaliser les objectifs sociaux de l’impôt dans le but de réaliser l’Etat social à travers la confirmation du principe de l’équité et la constitutionnalisation de la justice sociale sans pour autant saisir l’occasion de préciser le contenu du principe d’égalité devant l’impôt alors que la plus grande égalité relève de la recherche d’une plus grande justice fiscale. Cette constitutionnalisation de l’impôt à travers les principes fondamentaux s’y rapportant lui octroie alors une légitimité constitutionnelle qui semble l’ériger en un vecteur de solidarité et de gouvernance. Afin d’assurer le respect du principe de l’égalité et offrir des garanties au contribuable tenu de l’obligation de payer l’impôt, un contrôle de constitutionnalité s’avère donc indispensable. Ce contrôle, jusque-là très insuffisant, pourrait se développer grâce au nouveau texte de la constitution qui instaure une véritable Cour constitutionnelle.

In this context, the Tunisian constituent power seems to be aware that tax is an important instrument of governance, which has consequences for the country's political stability. This explains why it enshrines the social goals oftaxation in the new Tunisian constitution. Here the aim is to realize the social state through both the
confirmation of the principle of equity and the constitutionalization of social justice. While the search for a great tax justice is inextricably intertwined with the search for greater equality, this new constitution does not, however, determine the content of the principle of tax equality. The constitutionalization of the tax system in Tunisia through basic principles of taxation gives it constitutional legitimacy. Hence, this tax
system is becoming a vector of solidarity and governance. In order to ensure compliance with the principle of tax equality, whilst simultaneously offering taxpayers certainty as to their obligations to pay
tax, a constitutional review is important. Previously, this control was unsatisfactory. However, this situation could change in the future due to the establishment of a constitutional court by the new constitution.

Il régit les rapports des personnes physiques ou morales au sein de la collectivité au moyen d’un instrument : la norme. Pour atteindre cet objectif, diverses méthodes peuvent être mises en œuvre notamment la méthode expérimentale. Peut-on parvenir à la conclusion suivant laquelle la méthode expérimentale permet au droit d’être efficient et d’être fondé sur un modèle évaluatif au même titre que les sciences dites exactes ?
La réponse est affirmative. En effet, sur la base de l’évaluation et de l’expérimentation réalisées dans certaines circonstances préalablement à l’édiction d’une loi, la méthode expérimentale peut permettre au législateur d’élaborer et de proposer des règles de droit adéquates applicables à tout un ensemble de personnes. Ceci dans le but de parvenir à une société bien organisée et règlementée.

The Directive 2006/114/EC of the European Parliament and of the Council of 12 December 2006 deals with misleading and comparative advertising. European law perceives it as an unfair trade practice, which has a direct impact on the European domestic market because of its transboundary nature. Italy and France have transposed the Directive, but still harmonization problems persist, also because of the negative attitude of the Courts of such States in relation to European case law, very positive in this regard. The analysis of the condition laid down in Article 4, letter b of the Directive demonstrates this assumption.

Since the 1990s, a new generation of African International Organizations (AIO) emerges on the African continent, inspired, for most of its normative and institutional articulation, by the European model of integration, including its Community law while by bringing African specificities. Thus Community law is rooted in some AIO and the interest by the doctrine on this new branch is still constant. But is there really an African Community law that the doctrine seeks to systematize, at least thematically? This paper is a contribution to the problem posed by considering the nature and characteristics of this law developed mainly in Central and West Africa.

The fact that divorce is more common than ever suggests that a flurry of affection can be dazzling as it may blind people to make a commitment they cannot hold. To avoid the repercussions of divorce, a substantial amount of couples around the world prefers to simply live together without binding themselves to the institution of marriage. While it is a welcoming trend that relationships short of marriage are increasingly recognized globally, this paper wishes to highlight the dilemma of aligning too closely the category of recognized unmarried cohabitation with marriage. It would be respectfully submitted that in order to
offer couples a meaningful alternative option on the “menu”, the gulf between marriage and cohabitation must be maintained and the element of protection, especially when the interest of children is at stake, would better be achieved through institutional design. In other words, marriage and legally-recognized non-marital relationship should be treated as two interacting and complementary regimes serving different purposes. Such a suggestion is proposed after studying, evaluating, analyzing and comparing the latest legal systems regulating heterosexual relationships in four different countries – the Netherlands, France,
Australia and England. It is hoped that the selection of these four jurisdictions could represent a wide enough spectrum to facilitate more constructive discussions on this controversial topic.

law, corporate law, energy law, litigation, investment law, international law (private or public). The deadline for submitting papers is fixed on April 30, 2018. Authors will be notified at the very latest in June 2018. Selected articles will be published in the RLD in June 2018.
