Iustitia

The Montpellier parchment (made circa 1467–1477), now kept in the Bibliothèque Municipale de Montpellier, is an enigmatic image from Valois Burgundy. In this article, I argue that its peculiarities result from its attempt to synthesise two conceptions of authority: firstly, the virtues of rulers and of councils, and secondly, divine and feudal hierarchy. To make this synthesis, the parchment depicts Iustitia as a signature: a sign that translocates presence and authority between two realms. Iustitia translocates Christ’s authority in the earthly realm, as well as extends worldly judicial hierarchy into the heavenly sphere. In depicting the duke and his councils as fulfilling divine providence, this rhetoric suited the politics and learned culture of the later Burgundian state, and the inscriptions in the Montpellier parchment as well as iconography could have been devised by the Burgundian poet and chronicler, Jean Molinet.

Why Bad Things Happen to Good People?

In a well-known fragment of Justinian’s Digest, Ulpian addresses the students who are about to face the world of law by reading his Institutes: the young people who are going to dedicate themselves to the law must know that it derives and is founded on justice and this because – according to the elegant definition of Celsus – it is indeed an ars, but an ars that deals with the ultimate goal of all research, that is, good and equity. Jurists are sometimes called sacerdotes of this ars – Ulpian continues – and rightly so: in fact they cultivate justice and bring news of the good and the fair by separating the fair from the iniquitous and the licit from the illicit, anxious to form good people not because of the fear of punishment but because of the encouragement derived from the awards, and aspiring to the real philosophy, not to the simulated one. The text has been studied a lot by Roman law scholars, but this essay offers some further interpretative clues concerning, in particular, the last expression of the fragment, namely that jurists tend – nisi fallor, the jurist controversially adds – to the true philosophy, not to the simulated one.

The article is dedicated to the Latin concepts aequitas and iustitia in the works of Isidore of Seville. The “first Encyclopedic mind of the Middle Ages”, Isidore was guided in his works (the “Etymologies”, “Differences” and “Sentences”, studied in this article) by the Roman legal tradition as well as the Christian tradition of use of these concepts. According to Isidore, justice (iustitia) is related to the written law (ius); this word is primarily used with reference to mundane justice and legislation. In the same time it may be a just legal order, established by God, and in this sense iustitia is partly associated with aequitas. On the contrary, an equity (aequitas) is based on natural law (ius naturale) and signifies the primordial order, natural and obvious to everyone. It’s main feature is equality of all the people. Nevertheless
(even in the same Isidore’s works) the concepts of aequitas and iustitia look like interchangeable synonyms: the original distinction between them disappears little by little, as long as God is accepted to be an ultimate source for both iustitia and aequitas and a passage in the “Differences” I.32 (68) appears a mere scholastic exercise in distinguishing the concepts which no longer differ in practice.

The Center for Studies and Research on Ancient Law CEDANT of the University of Pavia is committed to the encouragement of advanced education and research in the field of Roman and Ancient law. Founded in 2002 thanks to the support of the Institute for Advanced Study of Pavia (IUSS), in 2015 CEDANT became a Research Center within the Department of Law of the University of Pavia, in partnership with Almo Collegio Borromeo. CEDANT avails itself of an international Scholarly Advisory Board and carries out its activities by virtue of the collaboration it enjoys with specialists who are selected as appropriate according to the theme under study, and with respect for the broadest participation of the scholarly community and for the wide range of different methodologies. For the academic year 2015‐2016, CEDANT is organizing the thirteenth «Collegium of Roman Law», an intensive residential course of study. The formula of the Collegium consists in bringing together, for three weeks in January 2016 at Collegio Borromeo of Pavia, professors from Italian and foreign universities and, in the capacity of auditors, young scholars interested in the proposed theme. The professors will engage in a series of seminars – in Italian and in English – characterised by strong educational organic unity and coherence, and which also represent an opportunity for scholarly exchange and discussion. At the same time, each participant is invited to contribute actively to the development and pursuit of the research undertaken. A second phase, lasting one week in the month of September 2016, is designed to allow the professors and the young scholars, who have actively contributed to the research, to critique the findings, with the aim of joint publication in a volume to be published by Pavia University Press. The scholarly theme of the Collegium 2016 falls within the project “Redhis – Rediscovering the hidden structure. A new appreciation of juristic texts and patterns of thought in Late Antiquity” (ERC advanced grant 2013, P.I. Dario Mantovani, host University: Università di Pavia).

Recently was discovered in Trentino a cycle of wall paintings of a profane theme dating from the second half of the fifteenth century.
In one of the scenes of the cycle made on the outside walls of a building that has hosted the fifteenth century until today an inn in the village of San Michele is recognizable a rare representation of the Fountain of Youth.
The paintings of singular interest and rarities also include other scenes with the late Justice or Injustice, a Wild Woman and a Wild Man, A Cavagliere in arms and a Giant - a scroll that explains to be the mythical ancestor of the Thun family arrived in Trentino from Rome in the wake of San Vigilio patron of the diocese - a young couple courteous clothes cartouches bearing the ancient name in German and Italian Locanda "Hostaria ala Aquila Rossa" = "Inn at Red Eagle" = "Gasthaus Roter Adler.
A series of clues, to be investigated, suggest that the buyer of the paintings may have been Simeon V Thun, son of Sigismund, established between 1463 and 1505 as a captain in Königsberg Castle - Montereale in a strategic position to control the movements of goods and people on the old boundary between the episcopal Principality of Trento and the territories controlled by the County of Tyrol and the House of Austria.



Da poco è stato scoperto in Trentino un ciclo di dipinti murali di tema profano databile alla seconda metà del Quattrocento.
In una delle scene del ciclo realizzato sulle pareti esterne di un edificio che ha ospitato dal Quattrocento fino ad oggi una Locanda nel paese di San Michele all'Adige è riconoscibile una rara rappresentazione della Fontana di Giovinezza.
I dipinti di singolare interesse e rarità comprendono anche altre scene con L'ingiustizia o la Giustizia tardiva, una Donna selvatica e un Uomo selvatico, Un Cavagliere in armi e un Gigante - che un cartiglio spiega essere il mitico avo della famiglia Thun arrivato in Trentino da Roma al seguito di San Vigilio patrono della diocesi - Una coppia di giovani in abiti cortesi recanti cartigli con il nome antico in tedesco e in italiano della Locanda "Hostaria ala Aquila Rossa".
Una serie di indizi, da approfondire, fanno pensare che committente dei dipinti possa essere stato Simeone V Thun, figlio di Sigismondo, insediato fra 1463 e 1505, come capitano nel Castello di Königsberg - Montereale in una posizione strategica per controllare i movimenti di merci e persone sull'antico confine fra il Principato vescovile di Trento e i territori controllati dalla Contea del Tirolo e dalla Casa d'Austria.

El presente documento expone los resultados de la investigación: “Estudio comparado de los impactos normativos y mediáticos de las agresiones con ácidos a mujeres sobrevivientes en España y Colombia”, la cual tuvo por objeto abordar la situación de estas agresiones con el propósito de responder a la pregunta sobre cómo ha sido el tratamiento noticioso de la temática en los dos países y su influencia en la estructuración y fortalecimiento de sistemas jurídicos. La ley aplicable a los contratos internacionales de franquicia en ausencia de eleccion de parte en la Union Europea, estuvo regulada durante muchos anos por el Articulo 4 del Convenio de Roma de 1980. Dicho Articulo requeria establecer la parte que realizaba la prestacion caracteristica de la relacion contractual, para que la ley de su residencia habitual regulara el contrato. La aplicacion judicial de este precepto presento graves inconvenientes en la determinacion de la ley aplicable al contrato de franquicia, pues no existio unanimidad acerca de la parte que llevaba a cabo dicha prestacion, e incluso se discutia si dicho contrato tenia un prestador caracteristico. Con la transformacion del Convenio de Roma en un Reglamento de la Union Europea (Roma I) se aprovecho para hacer importantes cambios al Articulo 4, donde cobra especial importancia la regulacion rigida establecida para el contrato de franquicia. Devil’s image in the legal writings of the late Medieval Ages based on the text of Bartolus da Saxoferrato «Processus satanae contra genus humanum»
«Processus satanae contra genus humanum», which is believed to have been written by the medieval lawyer Bartolus da Saxoferrato (1313/4-1357), describes the legal action started by the devil who wants to restore the ancient law to possess the humanity. The author of the article examines historical and cultural background of the image of the devil as the participant of the heavenly judgment.
