TIMESHARE  AS A SOURCE OF  FINANCING RECREATION REAL ESTATE. "Timesharing as the source of funds of real estate in the tourist business by the purpose of this article is approximation to the readers of the rules of the functioning of the "new" right of possession real estate in the tourist business, which appeared in Poland in the beginning 90 it was annual and since then gradually it is developed on our market. Timeshar this right, in which must be interested people, which love frequently to rest in one and the same place, furthermore owners and controlling real estate in the tourist zones. Timeshar this is the special variety of the possession of housing buildings or by their part for tourist purposes and indicates the acquisition of the joint right of possession by real estate with the another users. In the article is described the essence of this right, its pluses and minuses, and also rules of its purchase and sale.

The analysis concerns different legal institutions functioning in various legal systems under the name of "three-dimensional property" (3D-Property). It also covers the existing proposals for the regulation of this institution, currently unknown to Polish civil law. Being an exception to the rule of superficies solo cedit, the so-called ‘strata ownership’ would require significant changes to the regulations governing the subject of ownership and other rights in rem, as well as the adjustment of the relations between the owner of ‘space’ and objects within it and the owner of the land. In this regard, possible constructions were presented, recalling the innovative and original solutions that were proposed in codification works in the 1930s.

Celem rozważań zawartych w artykule jest z jednej strony wskazanie i krótka charakterystyka głównych – choć z oczywistych względów nie wszystkich – problemów dotyczących ochrony zabytków w Polsce w ogólności, zaś zabytków nieruchomych w szczególności, na tle ogólnej charakterystyki prawa ochrony dziedzictwa kultury. Problemy te zaczynają się już przy definicji przedmiotu ochrony, łączą się w sposób istotny z zagadnieniem interesu społecznego (określanego także często mianem interesu publicznego lub interesu wspólnego), zaś ogniskują się, w procesie stosowania prawa, w zagadnieniu za szerokiego zakresu władzy dyskrecjonalnej organu ochrony zabytków. The article presents the basic solutions to be applied in the so-called annuity real rights. These are limited real rights (iura in rem), which permit obtaining certain revenues from real property on a regular basis. Their essential purpose is to secure specified periodical benefits, primarily those of a pecuniary nature. These rights show some similarities, on the one hand, to pledge-type rights (especially mortgage) and, on the other hand, to easements. Currently, no annuity real charges of any kind have been regulated under the Polish civil law (since the entry of the Civil Code into force in 1965), as they were perceived, albeit incorrectly, as a reminiscence of the epoch of feudalism. However, they are still popular in other European civil law legislations, for example in the German, Swiss, Austrian, Spanish, Czech, Estonian, Slovenian or Croatian laws. The Act of 4 April 2019 on amending the Act on Real Property Management added a provision temporarily limiting the possibility of demanding restitution of the expropriated property. On the basis of the new provision, the right of the previous owner or its legal successors to restitute the expropriated property has ceased to be of perpetual nature. This right may not be exercised, as it previously was the case, at any time, as it expires 20 years from the date on which the decision to expropriate became final. This solution should be assessed negatively, as it deepens the non-constitutional nature of the statutory mechanism of restitution of expropriated real property, which makes the demand for restitution dependent on whether the public objective has been assumed (i.e. started to be implemented). Article 3871 on property transfer as a form of collateral security was added to the Civil Code by virtue of the Act of 14 May 2020 Amending Certain Acts in Respect of Shield Measures in Connection with the Outbreak of the SARS-CoV-2 Virus (promulgated in the official journal “Dziennik Ustaw”, item 879). Under this provision, contracts on transfer of property as a collateral security, where the property in question is a real property used for the purpose of satisfying housing needs, which is transferred to secure claims under this or any other contract not directly related to business operations or pursuit of the profession by a natural person, are invalid. The second part of the article concerns the interpretation and application in the central parts of Poland of the provisions of the Napoleonic Code on vacant inheritances. The Code does not provide a definition of the vacant inheritance. The key to the interpretation of the provisions on the acquisition of vacant inheritances by the state is the term “is presumed to be” (a vacant inheritance) used in the former Article 811 of the Napoleonic Code (French: est réputée vacante), see the current Article 809 of the French Civil Code which omits the term “is presumed to be”).This indicates that, in the absence of suitable heirs, the law introduced a specific rebuttable presumption of a vacant inheritance, belonging to the state.
