The axiological theory of fundamental rights reached in the last decades great academic and institutional repercussion in Latin America, including Brazil. It is commonly called a ‘post-positivist’ theory but, by rejecting Dworkin's thesis of ‘the one right answer’ it maintains elements that, as we argue, are typical of legal positivism. We herein discuss if, in light of a deontological theory of rights a correct decision would be possible, even if based on axiological terms of value-weighting. The rationale for a decision expressed in terms of conflicts of rights reduces the indispensability of fundamental rights. We argue, however, that this does not, of itself, prevent the decision taken from being correct. We use as an example the decision in which the Brazilian Supreme Court discussed whether the constitutional provision that no statute of limitations applies to the crime of racism could be extended to the publication of anti-Semitic hate speeches. Referring to the ideas of balancing and proportionality the court concluded that, under Brazilian law, anti-Semitic hate speech constitutes the crime of racism. We maintain that such a decision proves to be the only correct one under Brazilian Law in the deontological sense. Despite the argumentative damage brought to the internal debate of the courts on the role of fundamental rights, such decisions can nevertheless be able to discern, in the concrete cases, the legitimate from the abusive claims, so as to enable the Law to consistently confront the tendency to abusive and merely instrumental use of the Law itself.

O artigo busca realizar uma aproximação entre teoria constitucional e pensamento pós-colonial, objetivando uma hermenêutica jurídica responsável perante a permanência da violência colonial. Neste sentido, primeiramente os direitos fundamentais na modernidade são caracterizados, especialmente a partir da teoria de Ronald Dworkin, como porta de entrada da moral e, consequentemente, da história no âmbito do sistema jurídico. Seguindo a esteira do teórico estadunidense, trabalham-se as consequências dessa relação íntima entre moral e direito para a hermenêutica constitucional. Em um segundo momento, define-se o pós-colonial e quais contribuições ele pode oferecer para deslocar as narrativas hegemônicas sobre a modernidade. A partir desse movimento, pós-colonial e constitucionalismo são cotejados no sentido de fornecer elementos para uma imaginação moral expandida e mais democrática dos direitos fundamentais. Retomando o pensamento de Dworkin, conclui-se com considerações sobre que tipo de responsabilidade moral temos na escrita do romance jurídico quando o sofrimento injusto e as lutas silenciadas por liberdade e igualdade são alçados ao palco da história constitucional.

The author presents and discusses the debate on indigenous infanticide in Brazil, an issue that has become the subject of several bills in the Brazilian Congress. Moreover, the analysis takes into account other cases regarding traditional practices that conflict with human rights, such as female genital mutilation. The comparison illustrates the possibility of realizing human rights within traditional communities in a dialogical, democratic and unconstrained way. Thus, both individual rights and the collective value of ethical identities are simultaneously protected. Finally, the argument clarifies, in theoretical and practical terms, the alleged impasse between universal human rights and cultural relativism so commonly raised in the public sphere.

Julgamentos como o da Arguição de Descumprimento de Preceito Fundamental (ADPF) no 54 colocam em evidência argumentos morais de alta complexidade, quase sempre perpassados por questões religiosas. Assim, a legitimidade democrática de decisões de nosso Supremo Tribunal Federal é questionada, uma vez que grupos – não tão minoritários – defensores de crenças religiosas particulares sentem-se excluídos do discurso jurídico. Por outro lado, a Constituição brasileira determina que o Estado e o Judiciário devam ser laicos. Portanto, tendo tal complexidade em mente, o presente artigo pretendeu estudar o relacionamento entre o discurso jurídico-constitucional e o discurso religioso no âmbito da mais alta Corte brasileira. O aprofundamento no discurso constitucional, especialmente pelo viés hermenêutico, permitiu uma melhor compreensão e tematização desse relacionamento que, por vezes harmonioso e em outras oportunidades de forma antagônica, nem sempre é devidamente explicitado em uma decisão judicial, fazendo parte dos fundamentos ocultos dessa decisão. A identidade constitucional brasileira depende do resgate de valores pré- constitucionais muitas vezes representados por narrativas religiosas para a garantia de uma mínima coesão política. No entanto, não se pode abrir mão daquilo que a Modernidade e o constitucionalismo representam: pluralismo.

Resumo: O artigo busca apresentar e discutir sinteticamente os argumentos centrais do debate sobre o chamado infanticídio indígena no Brasil, objeto de propostas legislativas em tramitação no Congresso Nacional. A experiência internacional no tratamento de práticas tradicionais que conflitem com os Direitos Humanos, em especial a mutilação genital feminina, é explorada como exemplo da possibilidade de efetivação dos Direitos Humanos em comunidades tradicionais, de forma dialógica, democrática e não impositiva, procurando-se resguardar, ao mesmo tempo, os direitos individuais e o valor coletivo das identidades éticas. Busca-se, assim, desfazer, teórica e praticamente, o suposto impasse entre Direitos Humanos universais e relativismo cultural, comumente suscitado na esfera pública.

A questão a ser enfrentada pelo trabalho é o do papel do constitucionalismo na conciliação entre a pluralidade de formas de vida culturais e o respeito pelos direitos fundamentais. A partir dos debates sobre o chamado infanticídio indígena no Brasil, buscamos demonstrar os problemas e potenciais inclusivos presentes nos discursos correntes na esfera pública, em especial em torno das propostas legislativas que buscam enfrentar a questão. A inadequação da maioria das proposições é debatida, especialmente em confronto com experiências internacionais que buscaram lidar com problemas análogos por meio de ações pautadas pelo diálogo e pelo respeito às formas internas de deliberação. Sustenta-se a centralidade da categoria dos direitos fundamentais para o enfrentamento dos desafios multiculturais. Igualdade e liberdade caracterizam-se hoje por significarem, grosso modo, e em permanente tensão respectivamente constitutiva entre si, quais diferenças não podem fazer diferença social e o respeito a essas diferenças enquanto liberdade. Assim, direitos fundamentais individuais revelam-se de imediato como coletivos e difusos. Ou, em outros termos, os direitos fundamentais fornecem a base móvel adequada a uma sociedade moderna que incorpora os riscos com os quais se defronta mediante permanente mutação. Desse modo, com a complexidade que hoje assumem os princípios jurídicos, sua universalidade requer contextualização e sensibilidade para as situações concretas e únicas de aplicação. Para tanto, as discussões feministas sobre o papel dos direitos e sua relação com o multiculturalismo nos fornecem uma chave de leitura relevante. Entende-se que as garantias constitucionais em relação à cultura visam preservar não uma suposta pureza cultural, mas o direito às condições de possibilidade de auto-estima, do orgulho de pertencimento a uma identidade digna de valor. Nesses termos, se por um lado os direitos fundamentais podem ser vistos como limites a práticas tradicionais, operam ao mesmo tempo como condição de possibilidade para a existência e preservação dessas mesmas formas de vida – enquanto autocompreensão ética acerca de sua própria história. Os direitos fundamentais, nesse sentido, assumem o papel de elemento desestabilizador de usos, costumes e tradições naturalizados, a exigir que as eticidades se tornem reflexivas para que possam manter sua força enquanto elemento simbólico de reprodução social, e para que as posturas comunitárias ético-políticas não percam seus potenciais inclusivos e emancipatórios.
The role of constitutionalism in reconciling the plurality of cultural forms of life and respect for basic rights is the subject addressed by the present thesis. From the debates on the so-called indigenous infanticide in Brazil, we seek to demonstrate the problems and inclusive potentialities present in the public sphere discourses, particularly around legislative proposals, bills, that seek to address the issues. The inadequacy of most of the proposals is debated, especially in comparison with international experiences that sought to deal with similar problems through actions guided by dialogue and respect for internal forms of deliberation. The basic rights prove themselves as central tools to deal, in a constitutionally productive way, with the multicultural challenges. Equality and freedom are characterized today for meaning, roughly, and respectively constituting a permanent tension between them, which differences cannot make social difference and freedom as the respect due to these differences. Thus, fundamental rights, although individual rights, reveal themselves at the same time as collective and diffuse guarantees. In other words, the basic rights provide the mobile foundations suitable to the modern society, which incorporates the risks faced through permanent mutation. Today’s legal principles complexity, thus, implies in a kind of universality that requires contextuality and sensitivity to the concrete and unique situations of application. The feminist discussions about the role of rights and its relation to multiculturalism give us an interpretation key to face this issue. Constitutional guarantees regarding cultures are not aimed at preserving a supposed purity of a culture, but the right to the very possibility of individual self-esteem, of the pride of belonging to a collective identity worth of value. In these terms, if fundamental rights might be seen as limits to traditional practices, they operate at the same time as a condition for the existence and preservation of these lifeforms – understood as the ethical self-understanding towards its own history. The fundamental rights assume the role of destabilizing naturalized uses, customs and traditions, to demand that ethics become reflexive in order to maintain its strength as a symbolic element of social reproduction, in a way that ethical-political communitarian attitudes retain its inclusive and emancipatory potentials.
