Re: Show Cause Notice and Notice of Preventive Suspension
Dear Ms Olive:
It has come to the attention of HR office that you have violated the terms of your
employment contract, the Code of Conduct and Discipline, the Confidentiality
Agreement and committed serious misconduct or willful disobedience by ostensibly
committing the following acts:
1. Unauthorized use and possession of company property, records and intellectual
properties whether outside or within the office premises. (Rules on the Use of
Company Properties and Facilities)1
a. You have used company records on the clients of Olympus and
disclosed them outside the office premises without authority from
Olympus.
b. You had unauthorized possession and sent the Strategic Marketing
Plan for 2021 to Moon Services, Inc.
2. Fraud or willful breach of the Confidentiality and Exclusivity Agreements with
Olympus or its duly authorized representative.2
a. You disclosed the client information and company property to
outsider/s during the course of your employment with Olympus
without its prior authority
b. You emailed clients of Olympus allegedly on behalf of Moon Services
to offer the same services as that of Olympus.
c. You posed as the contact person of Moon Services in its website.
3. Negligent or abusive use of company properties and equipment. (Rules on the
use of Company Properties and Facilities)3
a. You used your office laptop for video call to marketing Moon Services.
b. You used the internet and e-mail access of Olympus for personal
purposed by disseminating client information to Moon Services and
dealing with the latter’s clients, prospect or otherwise.

c. You visited websites that were not typically used in the ordinary
course of business and visiting other websites for personal use.
Attached for you reference are copies of the videos and screenshots relative to
the acts described above.
Please explain in writing within five (5) days from notice why no disciplinary
action, including dismissal from employment, should be taken against you. Also please
make yourself available to attend an administrative hearing at the Board Room office on
October 07, 2020 at 3:00PM.
In the meantime, you are immediately put on preventive suspension pending the
investigation of this matter. For the duration of your preventive suspension, you are
hereby directed to surrender custody of any Olympus property currently in your
possession, including business information and data about Olympus and/or its clients.
Your failure to submit the written explanation and/or attend to the
administrative investigation shall be deemed a waiver of your right to present evidence
and/or to be heard. Likewise, these and/or the failure to surrender Olympus property
will be seen as a willful failure on your part to comply with a reasonable and lawful
directive from Olympus.
