Regulae Iuris

Es handelt sich um diejenigen Seiten der Monographie, auf denen die methodischen Hintergründe der jeweils unterschiedlichen wissenschaftsgeschichtlichen Zuordnungen der Gaius-Institutionen einerseits und des ps.-ulpianischen liber singularis regularum andererseits zusammengefaßt werden.

Attraverso l'esame di alcune caratteristiche del testo comunemente indicato come Fragmentum Dositheanum, l'autore sostiene che, nonostante il riferimento, in un paragrafo, alla conoscenza di 'regulae', il lavoro giurisprudenziale classico da cui è tratto il frammento non era un libro di regulae, ma un'opera elementare di natura squisitamente scolastica; inoltre, secondo l'autore, quest'opera scolastica potrebbe essere identificata con le Res cottidianae di Gaio.

The main goal of this paper is twofold. On one hand—directly investigating original archival material of Montenegrin Parliament from 1946 onward—it aims to show the scope of influence that roman legal tradition had on our law-making. On the other hand the author strives to stress historical background in which roman law became the very foundation of contemporary legal system in Montenegro, as well as to highlight several particular influences it made. The paper is consisted of two non-separated parts: (i) introduction with short historical overview of Ius Commune and its importance, and (ii) the central part with major results of the research.

This is a presentation of the research project, which aims to create a database of regulae iuris and allow their study using the medieval dialectical method, of which the regulae were an important element.
