Mercedes-Benz marka araçların üç köşeli yıldız amblemi, Toblerone çikolatasının üçgen prizma şekli, Clipper çakmağının yuvarlatılmış gövde şekli ve Coca-Cola şişesinin kapanan etek şeklindeki hatları, ticari başarıya ulaşmış ikonik tasarımlarıyla üç boyutlu markaların ilk akla gelen örnekleri arasındadır. Üç boyutlu markalar, marka hukukunda gelişen bir alan olmasına ve dikkate değer ekonomik etkisine rağmen fikri mülkiyet ve tasarım alanyazınında yeterince incelenmemiştir. Bu çalışmanın amacı, üç boyutlu markaların tasarım ve fikri mülkiyet biyografilerini araştırarak üç boyutlu marka koruması ile diğer koruma yolları arasındaki stratejik ve kronolojik ilişkiyi incelemektir. Fikri mülkiyet veri tabanları ve alanyazın taramasına dayanan bu çalışma, üç boyutlu marka olarak korunan üç boyutlu şekilleri, tasarım tarihi ve fikri mülkiyet koruması tarihi eksenlerinde inceleyerek yeniden kavramsallaştırır ve üç ana grup altında sınıflandırır. Birinci grupta, üç boyutlu marka olarak korunan tasarım ikonları yer almaktadır; bunlar genellikle uzun bir tasarım geçmişine sahiplerdir, farklı türlerde fikri mülkiyet korumasına konu olurlar; bu gruba örnek olarak Coca-Cola şişesinin ve Crocs terliğinin şekli verilebilir. İkinci grupta, üç boyutlu marka olarak korunan mimarlık ikonları yer alır; bu gruba örnek olarak San Francisco’daki Transamerica Pyramid binasının ve New York’taki Chrysler binasının şekli verilebilir. Üçüncü grupta, üç boyutlu marka olarak korunan, yıkıcı yenileşim içeren teknoloji ikonları yer alır; bu gruba örnek olarak iPhone akıllı telefonun üç boyutlu şekli ve iPod taşınabilir medya çaların şekli verilebilir. Tasarım tarihinin fikri mülkiyet tarihi ile kesiştiği alandan beslenen bu çalışma, üç boyutlu şekillerin fikri mülkiyet koruma stratejilerinin uzun erimli planlanmasında ve yeni koruma stratejilerinin geliştirilmesinde umut vadeder.

The article argues that industrial design education in Turkey is based on three ecoles, which are the “Academy,” the “Applied-Arts,” and the “Middle-East”; unlike the Academy and the Applied-Arts ecoles that have developed in İstanbul, METU Department of Industrial Design has been positioned as the generator of the Middle-East ecole within the distinctive institutional culture of METU, established in Ankara, the capital of the Republic, in 1956 as an international campus university with education in English. Since industrial design education found its raison d’etre within the modernization mission of Turkey, METU, a university founded with an innovative approach, has provided a fertile ground for industrial design education, and the department has proceeded by leaning on the critical thinking approach that METU considers as essential. In the early years, the department developed a unique educational approach and curriculum in a gradually evolving structure, with its teaching staff coming from diverse backgrounds, by including the student as an actor in the process. METU's non-hierarchical, egalitarian approach to governance has also been evident in the department. The younger generations who joined the department had the opportunity to develop themselves rapidly due to having equal responsibility and right to speak about educational matters. The founders, the first-generation core staff, handed over their administrative positions to the younger generation in a relatively early period, in the 1990s.
During its foundation years, with its leading core staff, the department focused on structuring the education of a brand-new profession within the university system by bringing together different specializations. In the following years, the department created a research culture with the inclusion of the newly graduated academic generation as staff members, influenced the professional context by organizing local and international activities, and developed its educational approach and methods by getting continuous feedback from the field through its increasing collaborations with the industry. One of the major sources of the department for collaboration is its graduates. Having important roles in various sectors, the graduates bring their collaboration proposals to the department in graduation or term projects. Also, the graduates who have achieved international recognition abroad, working in global companies, or successfully running their own design consultancies, continue to carry the department’s domestic influence abroad.
The academic infrastructure of the department is continuously updated by the expertise of faculty members who have done doctoral or post-doctoral research abroad. The department guides the academic agenda in its field with the national and international events it organizes such as Design, Industry and Turkey International Symposium (1994), Design & Emotion Conference (2004), DRS Learn X Design Conference (2019) and the National Design Research Conference (UTAK) series (since 2014). Since the 1980s, members of the department have played leading roles in many initiatives and activities that impacted the professional context, such as the establishment of Industrial Designers’ Society of Turkey (ETMK) (1988); the development of Design Turkey Industrial Design Awards (2008), and the establishment of Industrial Designers’ Commission to define professional rights and standards of industrial designers within the Chamber of Architects, UCTEA (2016).

This paper discusses the pedagogical approach followed for an educational project focusing on engaging design solutions for tea glass sets in the Turkish context. The project aimed at incorporating local values, usage patterns and rituals to enhance user experience and user-product interaction, reinforce product value, meaning and longevity, and develop more engaging and sustainable solutions. The project was conducted in collaboration with a major glass manufacturing company and involved 28 junior year industrial design students. Eighty preliminary and final design solutions for tea glass sets were analysed. The approaches that students adopted for addressing sustainability considerations were gathered under tea drinking practices, tea serving practices, and marketing of the tea glass sets. The strategies followed by the students to differentiate their designs included analogies and historic precedents, body proportions, contour lines, differing inner and outer walls, axial asymmetry, visual and tactile patterns, and atypical typologies.

hakları açısından birçok davaya ve koruma türüne konu olan örnekler oldukları görülmüştür. Bu
çalışmada, üç boyutlu marka olarak korunan bu ikonik mobilya tasarımlarından Barcelona Koltuğu ve
Tripp Trapp Sandalyesi vaka çalışması olarak ele alınmaktadır. Vaka çalışmaları, ikonik mobilya
tasarımlarının, ilk olarak patent korumasına konu olduklarını ve ayrıca fikir ve sanat eserleri sahiplerinin
hakları kapsamında korunduklarını göstermektedir. Patent koruması sonlandığında, fikir ve sanat
eserleri sahiplerinin hakları kapsamında korunmaya devam eden tasarımların benzerlerinin üçüncü
şahıslar tarafından piyasaya sunuldukları görülmektedir. Hak sahipleri, ekonomik ve sembolik
değerinden faydalanmaya devam edebilmek amacıyla bu ikonik tasarımların üç boyutlu şekillerini üç
boyutlu marka olarak tescil ettirerek tasarımları süresiz koruma yoluna gitmişlerdir. Üç boyutlu marka

eksenlerinde inceleyen ve görsel vaka çalışması olarak sunan bu çalışma, uzun erimli ve çeşitlendirilmiş
bir fikri mülkiyet koruma stratejisi geliştirme ihtiyacına ve ikonik mobilya tasarımları açısından üç boyutlu
marka korumasının sağladığı olanaklara dikkat çekmektedir. Tasarım tarihinin fikri mülkiyet koruması
tarihi ile kesiştiği alandan beslenen bu çalışma, tasarımlar için fikri mülkiyet koruma stratejilerinin
geliştirilmesinde tarihsel bir yaklaşımın ön araştırması niteliği de taşır.
The findings of the survey indicate a significant discrepancy between the designers' self-perception and the managers' views of the designers' skills and knowledge, which suggests a major communication gap between the two groups. Although both designers and managers seem to agree on the nature of industrial design activity in companies as being mainly concerned with aesthetic appeal and functional improvement, the lack of design culture or awareness coupled with inadequate consumer and market feedback cause design activity to be dominated by the issues of production and cost. Thus the designers' technical background is perceived as being inadequate by the designers themselves, and as the very last qualification identified with the design professionals by the managers. The paper offers an overall interpretation of the conclusions drawn, and develops a set of suggestions for design education in Turkey.
The pediatric examination table and its environment are where the interaction between the doctor and the child takes place predominantly. The examination table has a central role in design solutions which can improve user experience; its environment plays an important role for reinforcing and enhancing these solutions. The purpose of this study is to evaluate the process and the outcomes of an industrial design studio project aiming at improving the child's pediatric examination experience from a user- centered design perspective. The goal of the project is to develop design solutions for the general atmosphere of the room around the examination table towards reducing the distance between the child and the medical professionals, providing a reliable and soothing focus for the child, helping the child to cope with the worries arising from the examination room atmosphere and the medical equipment, providing a comfortable examination environment for all the stakeholders involved in the process, facilitating the actions performed during the examination, and providing an easy-to-clean and easy-to- maintain environment. The project was carried out in the fall 2017 with the senior year industrial design students at Anadolu University, and 75 students who took the studio course worked in 15 teams of five. To get design students familiar with the user group and the use context, and to get them reframe the design problem, a user-centered design process was adopted and the methods supporting this approach have been employed.
The study is based on the observation notes taken as a participant observer throughout the project and the analysis of the student presentations. The study indicates that the design students focused on various themes including the actions and circulation patterns around the examination table for pre-exam, exam and post-exam phases; the child’s transition to the examination phase; the medical equipment affecting the mood of the child; the interaction between the child and the other stakeholders, and the examination positions. The students followed various design strategies and developed design solutions for reducing the ambiguity that the child experiences during the examination process, a gradual transition to the examination process by altering the child's focus, directing the child in the exam room without the direct intervention of the doctor or the attendant, providing personalization opportunities which empower the child, keeping the stakeholders within the child’s visual field and at her/his eye level, and facilitating different examination positions.

boyutlu marka olarak tescil ettirerek tasarımları süresiz koruma yoluna gitmişlerdir. Üç boyutlu marka
olarak korunan ikonik mobilya tasarımlarını, tasarım biyografisi ve fikri mülkiyet koruması biyografisi
eksenlerinde inceleyen ve görsel vaka çalışması olarak sunan bu çalışma, uzun erimli ve çeşitlendirilmiş
bir fikri mülkiyet koruma stratejisi geliştirme ihtiyacına ve ikonik mobilya tasarımları açısından üç boyutlu
marka korumasının sağladığı olanaklara dikkat çekmektedir. Tasarım tarihinin fikri mülkiyet koruması
tarihi ile kesiştiği alandan beslenen bu çalışma, tasarımlar için fikri mülkiyet koruma stratejilerinin
geliştirilmesinde tarihsel bir yaklaşımın ön araştırması niteliği de taşır.
The findings of the survey indicate a significant discrepancy between the designers' self-perception and the managers' views of the designers' skills and knowledge, which suggests a major communication gap between the two groups. Although both designers and managers seem to agree on the nature of industrial design activity in companies as being mainly concerned with aesthetic appeal and functional improvement, the lack of design culture or awareness coupled with inadequate consumer and market feedback cause design activity to be dominated by the issues of production and cost. Thus the designers' technical background is perceived as being inadequate by the designers themselves, and as the very last qualification identified with the design professionals by the managers. The paper offers an overall interpretation of the conclusions drawn, and develops a set of suggestions for design education in Turkey.
The pediatric examination table and its environment are where the interaction between the doctor and the child takes place predominantly. The examination table has a central role in design solutions which can improve user experience; its environment plays an important role for reinforcing and enhancing these solutions. The purpose of this study is to evaluate the process and the outcomes of an industrial design studio project aiming at improving the child's pediatric examination experience from a user- centered design perspective. The goal of the project is to develop design solutions for the general atmosphere of the room around the examination table towards reducing the distance between the child and the medical professionals, providing a reliable and soothing focus for the child, helping the child to cope with the worries arising from the examination room atmosphere and the medical equipment, providing a comfortable examination environment for all the stakeholders involved in the process, facilitating the actions performed during the examination, and providing an easy-to-clean and easy-to- maintain environment. The project was carried out in the fall 2017 with the senior year industrial design students at Anadolu University, and 75 students who took the studio course worked in 15 teams of five. To get design students familiar with the user group and the use context, and to get them reframe the design problem, a user-centered design process was adopted and the methods supporting this approach have been employed.
The study is based on the observation notes taken as a participant observer throughout the project and the analysis of the student presentations. The study indicates that the design students focused on various themes including the actions and circulation patterns around the examination table for pre-exam, exam and post-exam phases; the child’s transition to the examination phase; the medical equipment affecting the mood of the child; the interaction between the child and the other stakeholders, and the examination positions. The students followed various design strategies and developed design solutions for reducing the ambiguity that the child experiences during the examination process, a gradual transition to the examination process by altering the child's focus, directing the child in the exam room without the direct intervention of the doctor or the attendant, providing personalization opportunities which empower the child, keeping the stakeholders within the child’s visual field and at her/his eye level, and facilitating different examination positions.
