Ordinary professor of Moral Theology at the Theological Faculty of Central Italy (Florence); invited professor of Eastern Moral Theology at the Alfonsiana Academy and at the Pontifical Oriental Institute in Rome; a member of the Board of Governors of the Intams (International Academy for Marital Spirituality-Bruxelles). La storia del rapporto che la chiesa cattolica ha avuto con tut- ta la problematica del fallimento matrimoniale è spesso letta co- me una storia di difesa eroica dell’assoluta indissolubilità matrimoniale. Forse in alcuni momenti può essere stato così, ma non lo è stato sempre. Essa può essere letta infatti anche in un altro modo, cioè come il tentativo costante di andare incontro alla concreta e difficile realtà della vita matrimoniale salvaguardando l’indissolubilità evangelica. Un tentativo assai difficile nel contesto latino di comprensione dell’indissolubilità.

The matter is to understand if and how Catholic Church recognizes or can recognize the failed marriages. To a first evaluation, it seems that it can offer only two solutions: to individualize a motivation of nullity or to invite to the conversion/return to the first union. The possibility of recognizing the failure of a valid union and, therefore, a potential new union is so excluded. Nevertheless, the things are so only at first glance: the Church effectively recognized and recognizes the existence of failed marriages; it wielded and wields effectively in their comparisons an articulated power - up to the supreme authority in Ecclesia of the Roman Pope - but always directed to show a way out, often a new union for the involved consorts.

The thesis of B. Petra is exposed. It could be resumed in this way : the validity and the lawfulness of the widow's marriages are legitimate in the thought and in the praxis of the Church. Yet it is discussable and even incoherent affirming that death extinguishes the celebrated and consummated marriage. Therefore it is still valid a kind of analogy between the irreversible separation of the consorts caused by death and the irreversible sepration of the living consorts cause by other reasons. Angel Rodriguez-Luno, in a passionate and articulated reflection, proves that death really extinguishes the celebrated and consummated marriage. As a consequence, it is not possible to establish any analogy between the two kinds of separation. B. Petra continues the dialogue, by analysing the critical observations and asks him two questions : why does the death loose the marriage ? Are all the matrimonial failures really repairable ? Petra states again that his position has been presented as an hypothesis which must be verified and deepened. Anyway, the canonical capacity's extension of the nullity of marriages is already introducing notable changes in the Church, especially about the value of marriage.

The A. sets a crucial question: what can ethics do in the century XXI to overcome the gap, left by the century XX, between Catholic norms of behaviour and believers' ethos, Catholic ethic and ethical sensibility of believers? Ethos means the ethical sensibility of believers, it indicates that type of behaviour that is felt as morally correct or faultless also when it is not observed. Besides, believers means those people who want to stay in the Church and consider themselves believers. Such gap is intimately connected to the crisis that the Catholic ethic has seen grown and finally explode in the last century. The Catholic ethic is in crisis not at a level formal and of general principles, but at a normative level, and this doesn't concern all the norms but those that have lost strength and evidence to the believers' reason.

Evidenziando che il rapporto tra sessualità e procreazione può essere compreso adeguatamente solo collocandolo nella storia, nella storicità delle culture, l’autore sottolinea che a partire dalla metà del secolo XIX si sta vivendo un passaggio culturale. Si abbandona il primato della procreazione sulla sessualità, cioè la rete ermeneutica plurimillenaria segnata dalla comprensione procreazionista della sessualità. Analizzando il rapporto tra sessualità e procreazione, il saggio intravede nel ‘procreazionismo’ occidentale un’origine pitagorica. Cercando di andare aldilà del procreazionismo, analizzando quelli che sono i documenti chiave del magistero ecclesiale nell’arco del Novecento, si afferma il cambiamento di orizzonte ermeneutico a partire dal Concilio Vaticano II.
