SXSW Photography Terms and Conditions

By downloading and using photographs supplied by SXSW (“Photo(s)”), you agree to the following guidelines (“Terms & Conditions”). SXSW reserves the right to require immediate removal or modification of any Photos at any time if they are not used in compliance with these Terms & Conditions.

Quitclaim Basis. All Photos are being provided on a quitclaim basis and SXSW makes no representations, warranties, or indemnities of any kind in connection with the Photos.

Use of Photos

Photos can be used in the following ways:

Editorial Purposes. This includes publication in a magazine or a newspaper, or on a blog or website to describe SXSW.

Limited Promotional Purposes (non-commercial).

This includes usage that promotes your direct participation in SXSW and does not include any advertising, sponsorships, or other sales-oriented calls to action.

Photos CANNOT be used for commercial, sponsorship or advertising purposes, such as online and print ads, product packaging, web or mobile applications, books or book covers, or any other usage that requires a purchase by an end user or suggests an endorsement by SXSW of any business or individual.

Credit

Photographer must be credited whenever and wherever the Photo is published, as follows:
• A prominent, legible credit line must be included in every use instance in print, web, all forms of social media, etc.
• Preferred example: “Photo credit: Jane Smith”
• the camera emoji can be used in place of “Photo credit:” in social media applications

• To find the Photographer's name you can double-click on a Photo to view the asset information panel. You should be able find the photographer’s name listed in the asset information panel. If you are unsure of Photo credit, please contact photography@sxsw.com.

Rights

• The rights to use Photos provided by SXSW are not sub­licensable, assignable or transferable in any manner.

• SXSW does not grant any rights, permissions, or clearances to use the name, likeness, or image of any person depicted or the trademark of any brand in the Photos. All necessary rights, permissions and clearances must be obtained by you prior to use of any Photos.

• SXSW trademarks (including, SXSW and SOUTH BY SOUTHWEST) may be used incidentally as they appear in the Photos (without being inserted through editing or other means) and in the text describing the Photo in accordance with the guidelines above and the SXSW Trademark Guidelines available here: https://www.sxsw.com/trademark-guidelines/.

Indemnity and Liability

You hereby indemnify and hold harmless SXSW and its successors, assigns, parents and affiliates, shareholders, employees, officers and directors from and against any and all third-party claims, losses, actions, damages, expenses and all other liabilities arising out of or in connection with breach of these Terms & Conditions. This obligation to indemnify will survive the expiration or termination of this Release.

Choice of Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to its principles of conflicts of laws.

Updates to Terms

SXSW reserves the right to make changes to these Terms and Conditions as posted, so be sure to check back and review the Terms and Conditions from time to time prior to purchase. Any dispute between you and SXSW will be governed by the Terms and Conditions agreed to at the time of your use or download of the pictures.

General Provisions

Nothing in these Terms and Conditions establishes an agency, partnership or joint venture between the parties, or relationship of employer or employee, between the parties (or between either party and the other party’s personnel). Headings are included for convenience only and will not be used to construe these Terms and Conditions. In the event that any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability will not affect any other term or provision hereof (which will remain in effect), and the parties agree thereafter to use their best efforts to substitute a provision of similar economic intent and effect.

You acknowledge and agree that you have read and understand the Terms and Conditions and intend to be legally bound by its terms. You acknowledge that your use of the Photos will not violate any third-party rights or laws of any kind. By submitting a press photo request or by using any other electronic mechanism presented to signify acceptance of these Terms and Conditions, you agree to and accept these Terms and Conditions.
