proforma ETD. However, if there is any change in departure time, we will refer to delay or

3-Container will be held (NO LOAD) if late SI, no SI or No VGM. Charges occurred in these cases
are under shipper’s account
4-Containers no. are not informed to ONE CS before 17.00hrs of working day is subject to roll
loading
5- Swapping conts between bookings are not allowed. swapping fee will be applied if happened
6- Check the container condition carefully before gate out.
All damage of container and charges after gate out is under customer’s responsibility
7- Loss/damage caused by overweight or incorrect weight declaration by shipper will be on
shipper’s account
8- Commodity having batteries must be declared at time of booking. Without declaration
container will be held for checking.
9- Compliance to laws and regulations, and sanctions regulations:
9.1.1. By tendering the goods for shipment, you represent and warrant that shipment(s) booked
with the Carrier shall comply with all laws and regulations, and shall not be in any way
connected with any of the parties, regions, areas, or countries subject to the Specially
Designated Nationals and Blocked Persons list of the United States Office of Foreign Assets
Control or any sanction or prohibition imposed by any State, Supranational or International
Governmental Organization.
9.1.2. In the event a breach of this warranty is suspected by the Carrier, in its absolute
discretion, the Carrier reserves all rights to suspend performance, terminate the contract of
carriage, and/ or claim damages and cost resulting from the breach. The Carrier may at its sole
discretion return the Goods to the port of loading or make the Goods available to the Merchant
(see ONE bill of lading terms clause 1.1. definition) at any convenient port or place at the
sole discretion of the Carrier, all of which shall be at the Merchant’s own risk and expense
howsoever caused. The Carrier shall be entitled to full freight on the Goods received for
carriage, and the Merchant shall pay any additional costs of the carriage to, and delivery and
storage at such place or port. For the avoidance of doubt, the Goods shall participate in
General Average.
9.1.3. The Merchant shall indemnify Carrier, its servants and agents, subcontractors, and
carrying vessels and its owners against any and all (i) losses and damages in connection with
the breach of its warranty stated herein; and (ii) claims brought by the owners of the Goods,
Bill of Lading shipper, Bill of Lading consignee, and/or the holders of Bills of Lading,
waybills or other documents evidencing contracts of carriage and/or against Carrier by reason
of Carrier’s compliance with such alternative voyage orders or delivery of the Goods in
accordance with subpart 9.1.2 of this Section.
10-Customers are requested to pick up empty or return laden to the place we assigned on
booking. Deviation on place of empty pick up and laden drop off as assigned booking will be
charged
