RESOLUTION NO. 15 -2023
A RESOLUTION REQUESTING THE MUNICIPAL MAYOR GADWIN E. HANDUMON TO
ALLOW THE COMMITTEE CHAIRMAN OR REPRESENTATIVE FROM THE
SANGGUNIANG BAYAN COMMITTEE ON PUBLIC WORKS AND INFRASTRUCTURE TO
BE A COMMITTEE MEMBER OF THE BIDS AND AWARDS COMMITTEE (BAC) OF THE
LOCAL GOVERNMENT UNIT OF PLARIDEL;
WHEREAS, the Sanggunian Bayan of Plaridel will have a direct knowledge on which
projects in the Municipality to advertise and/or post the invitation to bid, conduct pre-
procurement and pre-bid conferences, determine the eligibility of prospective bidders, receive
bids, conduct the evaluation of bids, undertake post-qualification proceedings, resolve motions
for reconsiderations and recommend award of contracts to the Head.
WHEREAS, under Republic Act 9184, otherwise known as the Government Procurement
Reform Act, an act providing for the modernization, standardization and regulation of the
procurement activities of the government and for other purposes.
WHEREAS, the (BAC) Bids and Awards Committee shall have at least (5) five members,
but not more than (7) seven members and it shall be chaired by at least a third ranking
permanent official of the procuring entity other than its head, and its composition shall be
specified in the (IRR) Implementing Rules and Regulations;
WHEREAS, Section 11 of Republic Act (RA) No. 9184 and its 2016 revised
Implementing Rules and Regulations (IRR) provide that of the five (5) members, three (3)
must be regular members and two (2) must be provisional members. Provisional members are
designated to sit in the BAC for a particular procurement activity, while regular members sit in
all the procurement activities of the agency.
WHEREAS, decisions made by a BAC with less than the required number of members
are therefore ineffective in accordance with Article 5 of RA No. 386, which provides that acts
executed against the provisions of mandatory or prohibitory laws shall be void, except when the
law itself authorizes their validity.
WHEREAS, the Municipal Mayor of Municipality of Plaridel, as the local Chief Executive,
Honorable Gadwin E. Handumon shall designate the members of the (BAC) Bid and Awards
Committee, who should occupy the plantilla positions. The members shall elect among
themselves who shall act as the Chairman and Vice-Chairman.
NOW THEREFORE, on motion to approved presented by SB Member Gerald G. Tatad
for the first, second and final reading, duly seconded by SB Member Myra L. Pluma, the
Sangguniang Bayan Members unanimously –
RESOLVED, as it hereby RESOLVES, to humbly request Mayor Gadwin E. Handumon
to include the Committee Chairman or one of the Representatives from the Committee on Public
Works and Infrastructure to be one of the members of (BAC) Bids and Awards Committee of
the Local Government Unit of Plaridel;
RESOLVED FINALLY that a copy of this resolution be furnished to the Municipality of
Plaridel Municipal Mayor, Hon. Gadwin E. Handumon, the Municipal Vice Mayor, Neite O.
Gornez, and to the Chairman of the Committee on Public Works and Infrastructure, Hon. Henry
M. Bulawin .
