1. Sri L. Gangadhar filed Complaint on 02-08-2014 and this Commission received the same on 05-08-2014.
Complaint was taken on file on perusal of material available on record.
2. The Complainant herein submitted an application under section 6(1) of RTI Act to the Public Information
Officer on 07-03-2014 to provide the copy of the educational society registration certificate of Sri Vani
Vidya Nikethan, Guntakal and the aims and objects mentioned in the byelaws of the said society and the
details of the office bearers of the society and other informaitn.
3. The Public Information Officer failed to provide the information in time as stipulated under the RTI Act,
hence the complainant-preferred complaint under section 18(1) of the RTI Act.
4. Notices were issued to both the parties. On the day of hearing, the Complainant is present. The PIO Sri
Venugopal, MEO is present. Heard both parties.
5. The PIO submitted that he has furnished the information, which is available with him i.e. with regard to
information pertaining to point No. 1 and 2 and for the remaining information management refused to
provide the information hence, he could not furnish the same.
6. Now the point for consideration is whether the complainant is entitled to seek such information pertaining
to private and unaided schools, which is not available with public authorities. A perusal of application
shows that the complainant has sought annual accounts statements, annual administration report and the
internal arrangements of managing committee. Now it is very clear that no private institution which is not
aided or substantially financed by Government in any way will not come within the preview of the RTI Act.
The public authorities who are having access or holding any information relating to any private institutions
which are unaided can divulge the same if it is available with them. It is also now settled law that the public
authorities cannot compel private institutions to provide such information for which they have no
authority or sanction from the government orders.
7. In this case, the PIO has already furnished the available information to the complainant and complainant
acknowledges the receipt of such information, Commission do not find any merits in the compliant and the
same is closed.
