warrant.

BEFORE ME, the undersigned authority, on this day personally appeared the undersigned Affiant, who
after being duly sworn on oath deposes and says; My name is DETECTIVE F. Serra III, 2167, FORT
WORTH POLICE DEPARTMENT, and I have good reason to believe and do believe that on or about
the 21st day of April, 2008 in Tarrant County, Texas, Jay Allen, a Black male 04.30.1989 did then and
there commit the offense of Capiud,;11Mtmfer in that he did THEN AND THERE INTENTIONALLY
CAUSE THE DEATH OF AN INDIVIDUAL, Michael Myers, BY SHOOTING AT WITH A GUN
AND STRIKING Michael Myers IN THE NECK AND TORSO AND CAUSING HIS DEATH, AND
THE SAID DEFENDANT WAS THEN AND THERE IN THE COURSE OF COMMITTING OR
ATTEMPTING TO COMMIT THE OFFENSE OF ROBBERY OF MICHAEL MYERS AT THE
BEST WESTERN INN.

My belief is based upon the following facts and information:

1. That on Monday, April 21st 2008, at approximately 0500 hrs, Det. F. Serra III, 2167 of
the Homicide Unit was contacted by Police Communications advising that Sgt. Bridges
en
was r~questing. \hp.ta lillmicide Detective contact her in reference to the call she was
route to. Det. Serra contacted Sgt Bridges who stated that she was en route to 6500 South
Freeway on a Sig 37 (shooting) with a confirmed Sig 12 (deceased person).

2. That at approximately 0550 hrs Det. Serra arrived on the scene and met with Officer V.
Tapia 3559, who briefed Det. Serra on the details of this offense as he knew them at the
time. Officer Tapia stated that the call came in at 0453 hrs and that he was dispatched at i
0455 hrs arriving on the scene at 0456 hrs. When he arrived on the scene Officer Ia,la · ·
entered the front a.ors ofthe Best Western Motel and went to the check in counJer.
Officer Tapia stated h& saw witnessl Gobert inside the hotel office, talkifii<mhis cell

phone and standing by the decedent. Officer Tapia ascertained that wi~sl Gobert was
on the phone with emergency personnel and instructed him to hangup. Officer Tapia
instructed Witnessl Gobert to open the door. Once Witnessl Gobert opened the door,
Officer Tapia instructed him to come out of the office without touching anything. Once
outside Officer Tapia placed Witness 1 Gobert in his patrol car pending arrival of
Detectives. Medstar arrived on the scene and pronounced the decedent at 0502 hrs.
Shortly before that, Officer Tapia noticed Witness2 Griffeth coming into the hotel lobby
and stopping to look at the decedent. Officer Tapia and anotherOfficer went inside the
business and had Witness2 Griffeth step outside and then placed him in a patrol car
pending the arrival of Detectives. By this time Witness3 Caplinger had come outside and
told the Officers on the scene that she had heard a gunshot early this morning, but wasn't
sure as to what time it had been.

3. That at approximately 0600 hrs Detective Serra met with the building owner, Piyush
Niak, who stated that the clerk that was working at the time of the offense was Michael
Myers, who was employed during the week as a painter at a company on the North side
and that he worked at the motel on the weekends from l lp.m. to 7a.m.

Det. Serra then called Officer Troy Lawrence with the Fort Worth Police Department
Digital Forensics Lab and requested that he report to the offense location to assist in
retrieving video from the surveillance system at the hotel.

4. That at approximately 0620 hrs Det. Serra met with Witness3 Caplinger who stated that
she heard one pop early in the morning and that the reason she came outside later was
because she heard the sirens and saw the police lights and Witness! Gobert's car was still
in front of the building.

5. That at approximately 0628 hrs Det. Serra met with Wimess4 Griffeth who stated that he
was staying in room #220 and did not hear any gunshots. He said thatwhen Offioe.m
approached him in the lobby he had just noticed the decedent lying on the floor in the
office.

6. .TJ:J.at,at a,pJi)TOxim~t~ly 0636 hrs Det. Serra met with Witness! Gobert who stated that~
was awakened at approximately 0400 hrs when he heard several gunshots at .·
apProximately 0400 hrs but that when he looked out his window that faces the entry wayi
there·\'!;:ere no vehicles in sight but he did hear tires squealing.

7. That at apptqximately 0645 hrs Det. Serra met with Jason Cordell who stated that he is ,
staying in r®m #218 and that early this morning he heard 4 gunshots in quick successioti,t

had heard any girtrabots. Cordell said it sounded like the shots came from right pext door.

8. That at approximately 0744 hrs Det. Serra, with the assistance ofOffi~'froy Lawrence
and Officer Michael Ornelas, also of the Fort Worth Police Department Digital Forensics
Lab observed the video surveillance recordings. These recordings showed a suspect
entering at approximately 0400 hrs the Best Western Inn through a door on the west end
of the building, he is seen walking east to the foyer with a silver or. chrome gun in his
right hand and quickly jumps over the counter into the hotel office.

9. That at approximately 0800 hrs Det. Serra requested that Witness 1, 2, 3 and 4 be
transported to 350 W. Belknap for depositions.

10. That at Approximately 0915 hrs Det. Serra received a signed deposition from WI Gobert
in which he states that was awakened at approximately 0400 by the sound of 4-5
gunshots. He stated that he got up and looked out his window that faces to the front of
the hotel but did not see anything. Gobert said that when he left for work he passed the
front desk and that as he was about to go out the door he realized that the telephones had
been ringing and no one was answering them and this was odd to him. Gobert then went

to the counter and saw the decedent lying in a pool of blood inside the office. Gobert
immediately called 911 and was told to get into the office as he could and see if the
decedent needed medical attention.

11. That at approximately 1630 hrs Det. Serra provided the FWPD PIO with a CD with
images to be disseminated to the media to be aired on the 5 pm news.

12. That at approximately 1725 hrs Det. Serra and Det. Brannan met with Officers Lawrence
and Ornelas at 6600 So•h Freewaythe Motel 6 in room #114 where the surveillance
equipment was kept. Officer Ornelas retrieved video from the system showing 2 black
males entering the Best Western Inn at approximately 0136 hrs and only stay for a very
short period of time. OJicer Ornelas showed the video of surveillance from the Best
Western Hotel to Officer Ramirez who works security at the Motel 6. Officer Ramirez
stated that the images from 0136 hrs are the same people that he had to chase off the
Motel 6 property at 014() hrs. 0200, and 0220 hrs. Offi~Ramirez stat~d$a,t~ach time
he had to do this the individuals shown in the video would runto tbe:Sttnridge ••ents
directly south of the Motel 6. ,

13. At approximately 2010,hrs Det. Serra received a call from Crime stoppers operator Jana
Robertson whost<1<ted she had a female on the phone who had information that might~
pertinent to this investigation. The caller was willing to talk to Det. Serra and was
tlferefore patched through to Det. Serra's cell phone. Det. Serra spoke to the caller who
stated that one of the actors had just left the apartment where she was at in Bedford and
had been,bragging about the commission of this offense with another male. The caller
provided Det. Serra with her name and phone number. The caller provided Det. Serra
with a possible name for one of the actors in this offense. She stated that a black male by
the name of Jay Allen, who .she described as 6' tall with dark complexion with slanted''
eyes and dressed in all blade. The caller said that the 2nct actor was a black male ruuned
Malcolm and that he was 18 years old and was possibly due to tum 19 on June2nct. The
caller said that during her conversation with Jay Allen he told her thatjrey had taken
$183.00 during the robbery and shooting of the decedent. The caller also stated that both
the suspects were possibly members of the criminal street gang "Ciips".

14. That at approximately 2120 hrs Det. Serra called the crime stoppi::rs caller who provided
the information on Jay Allen and Malcolm, who a@reed to allow ~t. Serra to pick her
and her step sister up for the purpose of getting signed dq>ositions 'from them.

15. At approximately 225 hrs Det. Drake prepared a photo spread of 6 black males with
similar features with Jay Allen in spot #2 and gave them to Det. Serra to present to
potential witnesses.
16. That at approximately 2230 hrs Det. Serra picked up Mary Bradley, the crime stoppers
caller, and Taliesha Slater from Ms. Bradley's residence and transported them to 350 W.
Belknap.

17. That at approximately 2300 hrs Det. Serra showed Ms. Slater a photo spread of 6 black
males with similar features with Jay Allen in the #2 position. Ms. Slater immediately
pointed at photo #2 and said that it was Jay Allen. Ms. Slater circled the picture and
placed her initials in the circle. Ms. Slater also noted at the top of the page that this was
Allen.

18. That at approximately 2305 hrs Det. Serra showed Mary Bradley a photo spread of 6
black males with similar:feahires with Jay Allen in place #2. Ms. Bradley immediately
identified picture #2 as Jay Allen. Ms. Bradley circled the picture and placed her initials
inside the picture. Ms. Bradley also noted at the top of the page that it was Jay Allen.

19. At approximately 231 frhrs Taliesha Slater provided Det. Serra with a deposition
describing her knowledge of this offense. In her deposition Ms. Slater states that earlier
on the date of the offense, she and her cousin ShakeithaTitus went to the Sunridge
apartments on the south side of Fort Worth and picked up Jay Allen 'and Malcolm, Ms.
Slater said that they dropped Malcolm off at the Millennium Cuts salon. Ms. Slater said
that they made several stops before returning to her apartment in Bedford. Ms. Slater Said
that while Malcolm and Jay Allen were in the car together in the back seat that she heard
both ofthelll taj.kiI}gand looked back just in time to see Malcolm show Jay Allen a gup.
She furtlier stated that the gun was either silver or grey and was a revolver.

20. That on Tuesday, April 22nct, 2008 at approximately 0100 hrs Mary Bradley provided Det.
Serra with a sworn deposition describing her knowledge of this offense. In her deposition
Ms. Bradley states that she was at her sister's apartment in Bedford, when her sister, her
cousin Shakeitha and a black male that she did not know arrived at a few minutes after
Spm after she had seen the news on the TV about the robbery that showed the vid~. Ms.
Bradley said that slie joked at the black male and said that he was just on televi~n
jumping over a counter'at the motel. Ms. Bradley said that the black male, .:who she later
found out from her sister Taliesha Slater was named Jay Allen, acted ~sed and then
acted like it was cool that he had done it. Jay Allen told Ms, Bradley that he wasn't the
shooter but that he was involved he was holding the door. When the news came back on
Jay Allen asked everyone in the apartment to be quiet so that he could see. After seeing
the broadcast about the robbery and murder Jay Allen got on his cell phone and made a
call. Ms. Bradley overheard Jay Allen tell somebody that they hadjust shown "it" on the
news and told whoever was on the line not to go to his mother's hoµse but to go to his
baby's momma' s house. Ms. Bradley said that when Jay Allen got off the phone she
asked him why they had killed that man for. And he said that it was because the guy came
at his homeboy. Jay Allen told Ms. Bradley that his girlfriend kicked him out of her
apartment in Butler Housing the night of the offense and that was why they did the
robbery. Ms, Bradley asked Jay Allen if the decedent had a gun to which he replied no.
Ms. Bradley told Jay Allen that they didn't have to kill him they could have hit him or
something and then asked him how much money did they get? Jay Allen responded that
they got $183.00. Ms. Bradley asked Jay Allen how old the guy that did the shooting was
and he said the shooter was 18 but would be 19 in June.

21. That at approximately 0120 hrs Sgt. JD Thornton was able to identify a Malcolm
Strickland from the FWPD gang files and gave this information to Det. Serra who then
prepared a photo spread of 6 black males with similar features with Strickland in place
#4.

22. That at approximately O134 hrs Det. Serra showed Ms. Slater a photo spread of six black
males with similar features with Malcolm Strickland in place #4. Ms. Slater immediately
pointed to picture #4 and stated that this was Malcolm. Ms. Slater circled the photo and
placed her initials inside'the cmle. M's. Slater then wrote this is Malcolm above photo #4.

23. That at approximately 0335 hrs Det. Serra went to the Motel 6 at 6600 S. Freeway and
met with Officer Juan Ramirez and showed him the photo spread that included Jay Allen
in place #2. Officer Ramirez pointed to photo #2 and said that this was one of the 2
people that he had run of from the Motel 6 property 3 times the morning of the offense.
The Motel 6 is very near the offense location. Officer R&nirez .said that ea.ch time that he
chased the 2 black males away, they always ran to the Sunridge Apart'mehts. Offieer
Ramirez explained thatthe reason he ran the suspects off of the property was because;of
their suspicious behavior, his concern that they might be "casing" the location for fut~e
criminal activity and W'@l"e trespassing after he told them to leave the first time.

24. Jhat Det..Serra w~ able to confirm through the FWPD Gang Unit that Malcolm
Strickland is in fact in the Gang database as a member of the "Funky Town Playas' (FTP)
a knowp_ violent criminal street gang in the city of Fort Worth.

That your Affiant has reason to believe, and does believe that Jay Allen committed the offense of
Capital Murder.

WHEREFORE, I request that,an arrest warrant issue for the suspect hereinbefore designated according
to the laws of this State.
