PETITION COMES NOW the petitioner, thru the undersigned counsel and unto this Honorable Court most respectfully alleges that:
1. Petitioner is a Filipino, 28 years old, single and a
resident of San Lorenzo, Gapan City, while respondents are likewise Filipinos, both of legal age and the incumbent City Civil Registrar of Gapan City, Nueva Ecija, with post office address at the City Hall Bldg., Bayanihan, Gapan City, Nueva Ecija and the Civil Registrar General (NSO) in Manila respectively, where they maybe served with summons and other legal processes from this Honorable Court;
2. Petitioner who was born in Gapan City, Nueva Ecija on
September 1, 1983, is the eldest among the 4 children of Spouses Mario V. Balbin and Lourdes R. Tuazon;
3. The fact of his birth was reported and recorded with
the offices of the respondents and prepared b y the Medical Record Clerk on September 07, 1983. Copy of petitioner’s birth certificate and certificate of live birth with Registry No. 1891, Book No. 26, page N. 96 are hereto attached as Annexes A and A-1 respectively and made as integral parts hereof; 4. Sometime in 2006 when he was applying for job, petitioner noted for the first time, that his date of birth appearing in his birth records is erroneous and must be corrected from September 09, 1983 to September 01, 1983, his real and correct date of birth;
5. Petitioner, since attaining the age of reason up to the
present has been celebrating his birthday every 1 st day of September of every year, up to the present, and in all his private, public and school records, he has been using September 1, 1983 as his date of birth and there is no occasion that she ever used September 9, 1983 as his date of birth;
6. This petition is being filed in good faith in order to
correct the entries appearing in petitioner’s Certificate of Live Birth and Birth Certificate on file with the offices of the respondents.
PREMISES CONSIDERED and in the interest of justice, it
is respectfully prayed that after due notice and hearing, judgment be rendered ordering the correction of entries appearing on petitioner’s birth certificate and certificate of live birth, specifically his date of birth, as follows:

premises are likewise prayed for.
