PETITION PETITIONER, through undersigned counsel, and to this Honorable Court respectfully avers and sets forth that:
1. Petitioner is of legal age, single, Filipino, with capacity to sue and be
sued, and a resident of Brgy. 4, Camalig, Albay, where he may be served with this Honorable Court’s processes;
2. Salvador Panin Relorcasa is of legal age, Filipino, with capacity to
sue and be sued, and a resident of Purok 6, Anislag, Daraga, Albay, where he may be served with this Honorable Court’s processes;
3. Joselyn Amoroso Cribe is of legal age, Filipino, with capacity to sue
and be sued, and a resident of Brgy. Pigcale, Legazpi City, where she may be served with this Honorable Court’s processes
4. The Local Civil Registrar of Manila City is the government agency
mandated to carry out and administer the provisions of law on civil registration located within the City of Legazpi. It may be served with summons and a copy of this Petition through the City Civil Registrar, Manila City Hall, Metro Manila;
5. The Philippine Statistics Authority is the government agency
attached to the National Economic and Development Authority which has also the responsibility of carrying out and administering the provision of the Civil Registry
1 Law and other laws on civil registration. It may be served with summons and a copy of this Petition through its central office located at Solicarel Building, Ramon Magsaysay Boulevard, Sta. Mesa, Manila 1016;
6. The Solicitor General is the government agency authorized to
represent the Republic of the Philippines in a proceeding for substantial correction of entries in the civil registry;
7. Petitioner was born on 21 October 1990 in Balut, Tondo, Manila.
Petitioner’s parents are Joselyn Amoroso Cribe and Salvador Panin Relorcasa, and are not married to each other;
8. The fact of Petitioner’s birth was only registered by his mother on 21
September 2018 before the Office of the Civil Registrar of Manila City;
9. Respondent Salvador Panin Relorcasa acknowledged Petitioner as
his illegitimate son as shown in the Affidavit of Acknowledgment/Admission of Paternity found at the dorsal portion of Petitioner’s Certificate of Live Birth, attached and marked Annexes “A” and “B”;
10. Considering that Petitioner was born prior to the effectivity of
Republic Act no. 9255 the Office of the Civil Registrar of Manila City did not allow him to use his father’s surname in his Certificate of Live Birth. Thus, the name of Petitioner as registered in his Certificate of Live Birth is “DARYL CRIBE”;
11. However, from his elementary years up to the present, Petitioner has been using the name “DARYL CRIBE RELORCASA”. Attached and marked Annexes “C” and “D” are Petitioner’s school records, Annexes “E” and “F” are his Certificate of Employment and Barangay Certification;
12. Petitioner had been known “DARYL CRIBE RELORCASA” since
childhood and was baptized by that name, attached and marked Annex “G” is a copy of his Certificate of Baptism;
13. Petitioner’s father continuously recognized and supported him and is
under his father’s custody from the year 1990 to 2018;
14. On 15 October 2018 Salvador Panin Relorcasa executed a notarized
Affidavit of Paternity and use of Father’s Surname in favor of Petitioner. Attached and marked Annex “H” is a copy of the Affidavit dated 15 October 2018;
15. To avoid confusion, it would be for the best interest of herein
Petitioner to allow him to continue to use the surname of his father and to reflect the same in his Certificate of Live Birth;
16. The filing of this Petition is not for the purpose of evading any law or judgment or any infraction thereof or for any unlawful motive but solely for the purpose stated above.
2 PRAYER
WHEREFORE, Petitioner prays that after notice, publication, and hearing,
judgment be rendered:
1. Allowing Petitioner to use the surname of his father “RELORCASA”;
2. Directing the Office of the Local Civil Registrar of Manila City and the Philippine Statistics Authority to Correct the Certificate of Live Birth of Petitioner under Registry No. 2018-50244 by changing his name from DARYL CRIBE to DARYL CRIBE RELORCASA;
Petitioner further prays for such other relief and remedies, just and equitable under the premises.
