JUDICIAL AFFIDAVIT
I, DR. ROWS E. DY, of legal age, married, a Physician at the Office of the City
Health Zamboanga City and a resident of Tetuan, City of Zamboanga,
Philippines, after having duly sworn to in accordance with law do hereby
depose and say:
The person examining me is Atty. Ruhfa M. Iklaman with address at JBC
Building, Baliwasan, Zamboanga City. The examination is being held at the
same address. I am answering her questions fully conscious that I do so under
oath and may face criminal liability for false testimony and perjury.
ATTY. IKLAMAN: Ma'am, kindly state your name, address and other personal
circumstances.
DR. DY: I am DR. ROWS E. DY, of legal age, married, a Physician at
Zamboanga City Medical Center and a resident of Tetuan, City of Zamboanga,
Philippines.
Qualifications of the Witness
Q: Witness, what is your educational background?
A: I finished Doctor of Medicine.
Q: From what school?
A: University of the Philippines, School of Medicine.
Q: What licensure your exam have you taken, if any?
A: Licensure exam for Physicians.
Q: When did you take and pass the licensure exam?
A: In the year 2000.
Q: After that did you have any formal training, if any?
A: Yes, I was a resident physician at the University of the Philippines,
Philippine General Hospital (UP PGH).
Q: What further studies have you pursued after medical school, if any?
A: I pursued a residency in Obstetrics and Gynecology at the University of the
Philippines, Philippine General Hospital (UP PGH) and passed the diplomate
exam.
Q: After that?
A: I was an Ob-gyn consultant at the University of the Philippines, Philippine
General Hospital (UP PGH) for 2 years, before I was hired by the Zamboanga
City Medical Center.
Q: As what?
A: As a Medico-legal Officer in the said office.
Q: What are your functions as a Medico-legal Officer?

A: I am responsible for examining bodies and cadavers and physical injuries of
any living victims.
Q: For how many years now?
A: 13 years.
Q: Have you attended cases involving rape?
A: Yes.
Q: How many cases of rape have you examined?
A: More or less about 100.
Q: Have you testified in court in connection with these cases?
A: Yes
Q: Was there a time when the court rejected your qualification as an expert?
A: None.
Testimony in relation to the Medico-legal Certificate
Q: Do you remember conducting a physical examination on September 23,
2019 involving Miss A?
A: Yes.
Q: What is the physical condition of Miss A when you received her?
A: Miss A was lethargic and had a Glasgow coma scale of 10.
Q: What examination did you conduct on her, if any?
A: I conducted her genital examination and followed by a request for a
toxicology report on her blood stream.
Q: What was your finding on her genital examination, if any?
A: Upon examination of the victim, I found that her hymen sustained
lacerations at 3 o’clock and 9 o’clock positions.
Q: What do these lacerations mean?
A: A 3 o’clock and 9 o’clock indicates the position of the injury sustained by the
victim in her private internal organ, ma’am.
Q: What could have possibly caused these laceration?
A: It could be caused by the introduction of a hard blunt object.
Q: Would an erect penis be considered a hard blunt object which caused these
lacerations?
A: Yes ma’am.
Q: What else did you find, if any?
A: There were rupture with remnants of the hymen within the vaginal opening
Q: What does it mean?
A: It simply means that if the hymen is ruptured, there is a penetration of the
vagina.
Q: The alleged crime was committed on September 23, 2019 at around 7:00 am
and you examined her at around 2:00 pm, could you tell us if the injuries

you found on the private organ of the victim are compatible to the date of
infliction?
A: There is a fresh injury. It could only be recent; it could be less than 3 days. I
examined her few hours after. Yes maam, the injuries are compatible with
the date of infliction.
Q: You said that you requested for a toxicology report of her blood. Were you
able to receive the result of such test?
A: Yes ma’am.
Q: What result did it yield?
A: It yielded positive of the substance ketamine.
Q: Have you encountered patients who have been positive for ketamine?
A: Yes
Q: How can an ordinary person acquire ketamine?
A: Usually it is acquired through prescription, however, people also buy this
from the black market.
