JUDICIAL AFFIDAVIT OF WITNESS
MARY ANN G. SUMAYOD
This judicial affidavit is in Waray-Waray which is a language known
to the Witness, and the lawyer conducting the examination is Atty.
Shemiah Jona B. Estrella at her office in RTR Bldg, 2nd floor Moot
Court Room 2, Tacloban City, Leyte.
The Witness is MARY ANN G. SUMAYOD, of legal age, married,
Filipino citizen, resident of Brgy. 65, Sagkahan, Tacloban City,
Leyte, Philippines. Her testimony is offered:
1. To corroborate the testimony of Maria Dela Cruz;
2. To identify the accused in the case;
3. To prove that the victim was shot by the accused;
4. To prove that she was able to contact the police officers who
responded to the crime;
5. To prove other matters relevant to this case;
The Witness is answering the questions fully conscious that she does
so under oath, and that she may face criminal liability for false
testimony or perjury.

Sagkahan, Tacloban City, Leyte, Philippines. (I am MARY
ANN G. SUMAYOD, of legal age, married, Filipino citizen, resident
of Brgy. 65, Sagkahan, Tacloban City, Leyte, Philippines.)
2. Q: Manunumpa ka ba nga magsusumat ka hit tinuod ngan
tinuod gud la bahin hini nga mga pamakiana nga akon
paghihimuon ha imo? (Do you swear to tell the truth and nothing
but the whole truth only in this query that I am going to conduct with
you?)

is your purpose in making this affidavit?)

A: Gusto ko tumestigo kontra kan Jude Dimaupay, Pedro
Salikway, ngan Paulo Collegio tungod han ira pagpatay kan
Jose Dela Cruz. (I want to testify against Jude Dimaupay, Pedro
Salikway, and Paulo Collegio because they killed Jose Dela Cruz.)
4. Q: Nakilala ka han paragreklamo ngan han biktima? (Do you
know the complainant and the victim?)
A: Oo. (Yes)
5. Q: Kay ano man na nakilala ka ha ira? (Why do you know them?)
A: Nakilala ako ha ira kay magsapit it amon balay ha Brgy.
65, Tacloban City. (I know them because we are neighbors at Brgy.
65, Tacloban City.)
6. Q: Nakilala ka han mga akusado? (Do you know the accused?)
A: Oo. (Yes.)
7. Q: Kay ano man na nakilala ka ha ira? (Why do you know them?)
A: Nakilala ako ha ira kay paragkada hira ha balay han mga
Dela Cruz ngan danay nag-iirignom hira ngan an akon asawa
kay magsarangkay man ito hira han biktima ngan an mga
akusado. (I know them because they would usually go to the Dela
Cruz’s residence and my husband would sometimes have a drinking
session with them since the victim and the accused are friends.)
8. Q: Ano an imo mayayakan parte han reklamo nga ginpasaka
ni Maria Dela Cruz? (What can you say about the complaint filed
by Maria Dela Cruz?)
A: Nasuporta ako han reklamo ni Maria Dela Cruz nga
ginpatay han mga akusado hi Jose Dela Cruz. (I am supporting
the complaint filed by Maria Dela Cruz that the accused killed Jose
Dela Cruz.)
9. Q: Han naglabay nga Agusto 8, 2019 mga alas 5 han kulop,
nakain ka? (Last August 8, 2019 around 5 in the afternoon, where
were you?)
A: Nakadto ako ha sulod nam balay.(I was inside our house.)
10.Q: Nag aano ka hadto na mga oras? (What were you doing
around that time, if any?)
A: Nag aandam ako han am pangiklop. (I was preparing for our
dinner.)
11.Q: Samtang nag aandam ka, ano an nahinabo? (While
preparing, what happened?)

A: Nakabati ako hin dagko na boses ha gawas. Kahuman,
humiling ako nam bintana kun ano an nahihitabo. Nakakita
ako na may nag aaragway gud man ha gawas. (I have heard loud
voices outside. Afterwards, I looked from our window to see what was
happening. I indeed saw people fighting outside.)
12.Q: Ano an sunod na nahinabo, kun mayda man? (What
happened next, if any?)
A: Kumita ako hin duha ka tawo na gin aatake hi Jose Dela
Cruz ngan usa pa nira na upod na nakasakay ha motor.
Nakakabati gihap ako nga sige an guliat ni Maria. (I saw two
people attacking Jose Dela Cruz and another person on the
motorcycle. Also, I have heard Maria shouting.)
13.Q: Nayakan ka na kinmita ka hin duha ka tawo nga naatake
kan Jose Dela Cruz ngan usa liwatha motor, nakakakilala ka
ha ira? (You said that you saw two persons attacking Jose Dela Cruz
and another one on the motorcycle, do you recognize them?)
A: Oo. (Yes.)
14.Q: Hira hin o man hira? (Who are they?)
A: Hira Jude Dimaupay, Pedro Salikway, ngan Paulo
Collegio. (They were Jude Dimaupay, Pedro Salikway, and Paulo
Collegio.)
15.Q: Kay ano mo hira kilala? (Why do you know them?)
A: Nakadamo ko na ini hira kakit i nga nabisita kanda Jose
balay kay masukot hira mag irignom. Ginpakilala gihap kami
nak asawa ha ira han birthday ni James Dean. (I have seen them
several times visiting Jose’s house because they would usually have a
drinking session. My husband and I were also introduced to them
during the birthday of James Dean.
16.Q: Ano man an sunod na nahitabo, kun mayda man? (What
happened next, if any?)
A: Nakakabati ako nga sige an kurahab na ni Maria. Hi Jose
sige gihap hin kurahab para sumakob an iya asawa ha sulod
han ira balay. Kahuman, nakabati ako hin buto hin pusil. (I
heard Maria shouting, Jose was also shouting in order for her wife to
go inside their house. Afterwards, I heard gunshots.)
17.Q: Pira ka buto hin pusil an im nabatian? (How many gunshots
have you heard?)
A: Tulo. (Three.)

18.Q: Ano man an sunod na nahitabo? (What happened next?)
A: Gumawas na ako ha balay pangusyoso kay
nagkakasaramok na ha gawas ngan nagtitikadamo gihap an
tawo. Amo adto na nakakita ako na hi Jose nakahigda na ha
karsada tapos damo an dugo. Sige gihap an kurahab ni Maria
kay naaro hin tabang. Nakit an ko gihap na may dugo hi
Maria ha iya lawas. (I went outside to check what was happening
because there was already a commotion outside and there were already
a lot of people. That’s when I saw Jose lying on the road with lots of
blood. Maria was also shouting for help. I also saw her covered in
blood.)
19.Q: Ano an imo sunod nga ginhimo, kun mayda man? (What
did you do next, if there’s any?)
A: Tumawag ako hin pulis para igsumat an insidente.
Gintawag ko gihap nak asawa para bumulig pag alsa kan Jose
didto han tricycle ni Jojo ngan para maasisteran gihap hi
Maria pagkadto ha hospital. (I called the police to report the
incident. I also called my husband in order to help in carrying Jose to
Jojo’s motorcycle and to assist Maria in going to the hospital.)
20.Q: Waray na ako iba nga pakiana. Mayda ka pa iba nga gusto
iyakan? (I don’t have any other question. Do you have anything else
to say?)
A: Waray ha pagkayana. (None as of the moment.)
