The Kuala Lumpur Bar Committee acknowledges receipt of your Petition for Admission
as an Advocate & Solicitor of the High Court of Malaya.
Under Section 14(2) of the Legal Profession Act 1976, this Committee is required to
submit to the Bar Council, after having made all due inquiries, a confidential report on
each and every pupil who served the whole or any part of his/her pupillage in Kuala
Lumpur.
To enable the Committee to discharge this function, you are required to comply with the
following:1. Complete and return the REFEREES FORM.
2. Complete and return the PARTICULARS OF PETITIONER FORM.
3. Attend an Introduction Session. The KL Bar Secretariat will notify you of the date for
your Introduction Session within two (2) months from the date of service of your
Petition on the Kuala Lumpur Bar Committee. Should you not be informed of the
date for your Introduction Session within the stipulated period, you are advised to
immediately contact the KL Bar Secretariat.
Kindly take note that no reminders will be sent to you to attend to the above. In this
connection, please read carefully the enclosed IMPORTANT NOTICE.
To acquaint yourself with the Rules pertaining to our professional conduct,
etiquette and practice, please peruse the Legal Profession (Practice & Etiquette)

Recognising the importance of professional development/continuing legal education
and to ensure that persons entering the profession are equipped for legal practice, the
Kuala Lumpur Bar, at its Annual General Meeting in March 2006, passed a resolution
strongly encouraging all pupils to attend at least four professional development/
continuing legal education sessions during their period of pupillage. Towards this end,
the Committee is pleased to introduce to you its Professional Development (PDC)
Programme which comprises of seminars/lectures covering different aspects of
practice. The Programme is available on the KL Bar Website www.klbar.org.my and
you are advised to take this opportunity and register for the different sessions as soon
as you are able to. You will be presented with a Certificate of Attendance for each
session that you attend to its completion. The Certificate will be presented at the end of
each session.
Further, in connection to your admission to the Bar, the Committee will be undertaking
the task of organising a Call tea reception for all the pupils who will be admitted to the
Bar together with you on the same day and yourself at a nominal cost to be advised
upon receipt of your Admission to the Bar Papers. It is a tradition of the Bar for a pupil
to have a Call tea reception after his/her admission to the Bar to celebrate this happy
occasion with his/her Master, family members, friends, colleagues at the Bar and the
admission Judge. In Kuala Lumpur, due to the large number of admissions on each
Call day, it is a little difficult for all the pupils to get together to have a joint Call tea
reception. The KL Bar Committee, recognising the situation and hoping to see this
tradition being kept alive here, has thus decided to assist in organising the same.
We are sure you take great pride in becoming a member of the Bar and hope that your
Admission to the Bar will be one of the most meaningful and memorable occasion for
you.

IMPORTANT NOTICE
The first thing a pupil does upon filing his/her Petition in the High Court is to serve
copies of the Petition on the Bar Council, the Attorney-General's Chambers and the local
Bar Committee. A pupil who reads the whole or any part of his/her period of pupillage
in Kuala Lumpur MUST serve on the Kuala Lumpur Bar Committee a copy of his/her
Petition. This is a statutory requirement.
There is a purpose for this statutory requirement: the Kuala Lumpur Bar Committee
must submit a confidential report on the pupil after having made all due inquiries.
Unless this report is submitted a Petition for Admission will not be fixed for hearing.
To enable the Committee to discharge this function, the Committee meets the pupils,
makes inquiries of the referees he/she has named and obtains further particulars about
the pupils. Therefore a pupil
MUST submit the names of two persons, other than, his/her Master or any other
person related to him/her and the two persons so named should be professionally
qualified or of a similar standing and must know the pupil for a minimum of five (5)
years;
MUST complete and return the Particulars of Petitioner Form; and
MUST attend an Introduction Session and return to the KL Bar Secretariat the
Letter of Introduction (which will be faxed or e-mailed to you once the date for
your Introduction Session is fixed) duly signed by members of the Committee
immediately after the Introduction Session. [Note: The KL Bar Secretariat will
notify you of the date for your Introduction Session within two (2) months from the
date of service of your Petition on the Kuala Lumpur Bar Committee. Should you not
be informed of the date for your Introduction Session within the stipulated period,
you are advised to immediately contact the KL Bar Secretariat (Tel: 03-2693 3585.]

The Committee will NOT BE SENDING REMINDERS to pupils to attend to the above. It
is the duty of the pupils themselves to ensure that the above requirements are complied
with without having to be reminded or prompted by the Secretariat.

PRIVILEGE OF AUDIENCE CONFERRED BY S36(2) LPA 1976


It has been reported that some pupils-in-chambers, whether inadvertently or otherwise, are
abusing the privilege of audience conferred by S36(2) of the Legal Profession Act 1976. Some
instances of the reported abuses are :

mentioning for an advocate and solicitor other than the master or a member of the master's
firm;
taking judgments in open court in the Sessions Courts;

representing or holding out as duly admitted advocates and solicitors.

The Bar Committee takes a serious view of these.

Pupils are reminded that they should act within the terms of section 36(2) of the Act and of any
orders made thereunder. Any breach of section 36(2) or of such orders would render the pupils
concerned liable to disciplinary proceedings. Pupil masters must ensure that their pupils observe
these provisions of the Act and of the orders.
Pupils should, whenever appearing in court or in chambers, inform the Court of their status as
pupils. The Legal Profession Committee of the Bar Council has made a ruling to this effect.

The Bar Committee would not hesitate to initiate disciplinary proceedings against pupils who
contravene the provisions of the act, the orders under section 36(2) or the rulings of the Bar
Council. The Committee hopes that all pupils would prepare themselves to begin, and continue,
their career at the Bar on the proper footing and in compliance with the provisions of the Legal
Profession Act.

LEGAL AID SERVICES


Pupils and Masters are reminded of the Bar Council Ruling 10.06 in relation to the 14-day minimum
Legal Aid Service period to be undertaken during pupillage.
Please note that all pupils are required to sign up for duty and to undertake such duties as are
assigned to them.

There has been a disturbing trend of pupils both failing to sign up for duty and of pupils failing to
turn up for the activity assigned to them.

Please note that the Bar Council Ruling has to be complied with and the Bar Council and Bar
Committee will be notified by the Legal Aid Centre of the pupils who fail to comply with the Ruling
or who fail to attend to their assignments.

To all pupils:
You would be aware that you are required to serve a minimum of 14 Days Compulsory Legal Aid
Duty pursuant to Bar Council Ruling 10.06, for Admission to the Malaysian Bar.
Accordingly, you must complete and return the registration form below immediately to the Legal Aid
Centre (LAC), so that we can arrange for you to be notified of the compulsory orientation session, the
clinic/program you will be assigned to, and the compulsory relevant briefing and training sessions.
The signed pupil-masters consent form must be returned promptly to the LAC, and in any event no
later than your compulsory orientation session.
No further notice or reminder will be sent to pupils or pupil-masters. Failure to comply with the legal

Pupils Awareness
Pupils (and masters), please take note of the following:

Photocopy of Short Call and Admission to the Bar Cause Papers at the Kuala
Lumpur Court Complex, Jalan Duta

There are photocopying services available at the following locations:


(a) The Bar Room, located on the 5th Floor, Left Wing. Charges are at 20 sen per copy;
(b) Joshua Legal Art Gallery, located at the court canteen. Charges are at 20 sen per copy;
(c) JAJ Mart Enterprise, located at the court canteen. Charges are at 20 sen per copy.
Pupils are reminded not to pay court clerks for photocopying without an official receipt being
issued by the court filing counter.
(ii)

Admission to the Bar Speeches

The Kuala Lumpur Bar Committee has streamlined and standardised the format of Admission to
the Bar speeches as follows:

(i) the petitioners name
(ii) the institution where the petitioner graduated from
(iii) post degree qualifications eg Bar Vocational Course, CLP
(iv) the chambers where the petitioner underwent pupillage
3rd paragraph
the mover to thank certain people on behalf of the petitioner (eg parents, spouse/master)
to state:

(i) the petitioner is a fit and proper person to be admitted and enrolled as an Advocate and Solicitor
(ii) all papers in order
(iii) no objections from the three bodies
to pray that the petitioner be admitted and enrolled as an Advocate and Solicitor
Please note that a copy of the speech need not be forwarded to the court.
(iii)

Robing of Pupils

It is the masters duty and obligation to arrange for an Advocate and Solicitor of more than 7
years standing to move his or her pupils Admission to the Bar. A master who robes his or her
pupil must be in open court attire. Please refer to Rule 10.04 of the Bar Council 2008 Rulings.

Brief information about the Kuala Lumpur Bar Committee


All pupils are welcome to participate in the respective sub-committees and their activities/
events information of which can be found on the KL Bar Website www.klbar.org.my.
Introduction
The Kuala Lumpur Bar is led by a Committee comprising the Chairman of the KL Bar and
ten (10) other members who are elected at the Annual General Meeting in February of
each year. The Committee is empowered to co-opt two (2) additional members. The coopted members can participate in the deliberations of the Committee but have no vote.
The Chairman is an ex-officio member of the Bar Council and a representative to the Bar
Council is elected by members of the KL Bar at the Annual General Meeting. The Honorary
Secretary is appointed by the Committee from amongst the members of the KL Bar.
There are nine (9) Sub-committees of the Kuala Lumpur Bar Committee (KLBC) that
undertake a host of projects and activities involving lawyers and others.
It is the KLBCs wish to see as many young practitioners as possible take part not only
in activities of the KL Bar but also to participate at the sub-committee level and in other
ways, and contribute their time and ideas for the improvement of our noble profession.
Although each sub-committee consists of practitioners, we welcome pupils-inchambers to join and participate in these sub-committees as observers. If you would like to
participate in any of these sub-committees, please feel free to contact the chairperson
concerned who will be able to provide you with more details of the objectives of each
sub-committee. However, the final selection shall be made by the chairperson.

Civil Practice Committee

Continuous engagement and discussions with the Judiciary for the improvement of the

Setting in place procedures and system to enhance the practice of law in the KL Courts;

Corporate & Conveyancing Practice Committee

To identify and resolve issues faced by members of the KL Bar in the area of corporate
and/or conveyancing practices, and to assist members in dealing with the Land Offices
and Registries, Stamp Duty Offices; Bahagian Pinjaman Perumahan Perbendaharaan
Malaysia, Banks, SSM, Securities Commission Malaysia, etc;

To enhance the relationship and communication amongst all parties and stakeholders
involved in the corporate and/or conveyancing practices;

To work hand-in-hand with the Conveyancing Practice Committee and the Corporate
and Commercial Law Committee of the Bar Council, the Selangor Bar and other State
Bars (as and when necessary) to achieve the above objectives.

Criminal Practice Committee

Continuous communication with the Criminal Courts, the Attorney General's


Chambers, the Police and other relevant stakeholders for the betterment of the
administration of criminal justice;

Setting in place a procedure and system to enhance the practice of criminal law in the KL
Courts;

Dealing with complaints of members of the KL Bar in relation to their criminal practice in
the KL Courts;

Expose and encourage young lawyers to participate in criminal practice by conducting


and organising talks, seminars, workshops and criminal practice mentoring programme.

Information Technology (IT) & Publications Committee

Promoting the use of IT by lawyers;

Exploring new ways in which IT can improve members' professional practice;

Responsible for improving the communication of the KL Bar Committee with members
on issues and concerns of members;

Overseeing the management of the KL Bar Website (www.klbar.org.my) and all other
Social Media network that it operates;

Creating public awareness on Laws related to Information Technology;

Assisting members on dealing with and improving Courts efiling system;

Suggesting Law Reforms on Laws related to Information Technology;

Professional Development Courses on Laws related to Information Technology for


members;

Focusing on the publication of selected materials on the KL Bar Blog for members of
the Malaysian Bar.

Professional Development Committee (PDC)

A dedicated committee designed for developing and implementing Professional


Development programmes for members of the KL Bar. It offers members and pupils,
through its various programmes, an opportunity to fortify their legal knowledge and
updates in the legal developments in their area of expertise. This would include
programmes designed to ensure that pupils and members are equipped with all relevant
skills to meet the challenges of this competitive industry;

The PDC is also designed to inculcate and imbue the importance of professional
development so as to ensure the overall objective of career development and
advancement;

The PDC will assist in organising programmes for members in order to have sufficient
avenues to collect CPD points, in light of the CPD Scheme.

Pupils Committee

Recommending remedies, solutions and courses of action in order to address any issues
raised by pupils, Masters and the Courts with regards to Pupils' Welfare;

dialogues etc;

Provide a platform for pupils to effectively voice their concerns over any issue that may
arise over the course of their pupillage;

Provide a social and networking platform by organising social events to bridge the gap
between pupils and practitioners and to create closer ties among pupils.

Social, Arts & Culture Committee

Young Lawyers Committee
