Özet
Bu makalede, Şiilik ile Sünnilik arasındaki yakınlaştırma çalışmaları ele alınmıştır. Bu çerçevede ilk olarak, bazı erken dönem âlimlerin yazdıkları kitaplara değinilmiştir. İkinci olarak Kübreviyye tarikatının yaşadığı deneyim üzerinde durulmuştur. Daha sonra Nadir Şah’ın Caferiliği Sünnî mezhep olarak kabul ettirme girişimi, ardından Osmanlı Devleti’nin “İslam birliği” siyaseti tartışılmıştır. Daha sonra da “Dârü’d-Takrîb” müessesinin çalışmaları ayrıntılı olarak incelenmiştir. Son olarak ise konuyla ilgili yaklaşımlara yer verilmiş ve bu çerçevede değerlendirmeler yapılmıştır.
Summary
In this article, the studies on the reconciliation between Shiism and Sunnism are discussed. In this frame, firstly, books written by some early scholars are mentioned. Secondly, the experience of the Kubraviyyah is emphasized. Later, the Nadir Shah attempted to impose the Jafarite as a Sunni sect, and then the politics of the "Islamic Union" of the Ottoman State were discussed. Later on, the studies of the "Dârü'd-Takrîb" institution were examined in detail. Finally, the approaches related to the subject are included and the evaluations are made in this framework.

«تشیع علوی و تشیع صفوی»، نظریه‌ای است که 44 سال قبل توسط علی شریعتی طرح شد و مباحث، نقدها و حتی تنش‌های قابل توجهی را برانگیخت. اینک، پس از گذشت بیش از چهار دهه از طرح این نظریه، شاید وقت آن باشد که با نگاهی به مختصات درونی این متن، به بررسی منتقدانه‌ی آن بنشینیم. چرا که فراتر از میزان دلبستگی، نوع ارزشگذاری و نقدهای سلبی و ایجابی وارد بر این نظریه و سایر آراء شریعتی، از یک واقعیت نمی‌توان چشم پوشید: این نظریه و برخی دیگر از نظریه‌های اجتماعی بومی در یک‌صد سال اخیر، بخشی مهم از میراث فکری، حافظه‌ی جمعی و سنت علمی مطالعات اجتماعی دین در ایران هستند.

لقد كرّست اهتمامي في السنين الأخيرة لمطالعة وتصحيح تفسير الوزير المغربي المسمّى بـ: المصابيح في تفسير القرآن، وكتبت بعض المقالات في هذا الخصوص، وقد تطرّقت في مقالتي هذه إلى وصف النسخ الثلاث الموجودة منه، ومناقشة الأخطاء والنواقص التي وردت في تصحيح نسخ هذا الكتاب والتي جاءت في إطار رسالة الدكتوراه المقدّمة من قبل الدكتور عبدالكريم بن صالح الزهراني والتي تمّ الدفاع عنها في جامعة أمِّ القرى في مكّة المكرّمة سنة (2000 ميلادي)، علماً بأنّ هذه الرسالة موجودة على صفحات الشبكة المعلوماتية (الإنترنيت) بالرغم من أنّه لم يتمّ نشرها رسميّاً ولم تطبع بعد.

El presente  ensayo  tiene  como  propósito  fundamental  reconstruir  el  contexto histórico-cultural en el que tiene lugar la formación de la dinastía safaví. Para ello, en un primer momento, se repara en los elementos políticos, sociales y religiosos que  desempeñaron  un  papel  decisivo  en  la  instauración  de  la  dinastía.  A continuación se refieren las dinámicas  artísticas, generadas en Tabriz, primera capital del imperio.

To be a “Shi‘at Ali” means to follow closely in the footsteps of ‘Ali, the cousin and son-in-law of Prophet Muhammad. For Shi‘is, ‘Ali was the rightful successor of Prophet Muhammad and the first Imam. Shi‘ism is the second largest denomination in Islam after Sunnism. Shi‘is constitute roughly 10–20% of all Muslims in the world. This chapter provides an overview of contemporary Shi‘is doctrines, bodily pious habits, as well as quotidian and annual rituals.

Heidegger radikális filozófia-kritikája egyfelől neoplatonikus keresztény misztikus alapokra épül , másrészről a preszokratikus bölcseletre, Parmenidészre. Ezért is érthető, hogy az arisztotelészi kategóriákat és karteziánus szubjektum-objeektum kettősséget miért támadja. Heidegger nyit a rejtező feltárulkozásának ezoterikus fenomenológiájára. Corbin számára azért is volt fontos Heidegger, mert „ontologizálta a tudást”. De mindez nem volt elég Corbinnek, hiszen az a horizont, amit Heidegger megnyitott és a perzsa kultúra megtermékenyített egy sokkal szélesebb távlatot nyújtott számára. Úgy tűnt, hogy „a heideggeri hermeneutika egy theofánia nélküli teológia.” És pontosan ez Corbin egyik fő kritikája Heideggerrel szemben. Corbin a Dasein értelmezését a misztikus tapasztalás kozmoszába helyezte, így a Logos is visszatérhetett eredeti teológiai-teleológiai jelentéséhez.
Corbin spiritualizálta a hermeneutikát és fenomenológiát, egyfajta spirituális exegézist hajtott végre, mely visszavezeti a jelentést és szimbólumot a transzcendens eredetire/eredetére/hez. Mindennek erős kozmológiai voatkozása van, hiszen csakis egy szakrális kozmoszképen belül lehetséges mindez. Corbin számára az ehhez vezető út a mundus imaginalis  lesz, mely az ősképek és ős-fenomének tárházaként személyes-angyali vonatkozású.

Maşiah(İbranice),Eski Ahit'e göre bir peygamber veya kohen tarafından yağlanmak/ kutsanmak suretiyle veya doğrudan Tanrı tarafından görevlendirilen kral, kohen veya baş kohen gibi kişilere denir. Bu anlamıyla özel olarak Mesih nitelendirmesi Kral Davud için kullanılır. Hz.İsa'nın lakabı olarak kullanılan kelime Yunancaya Christos ile tercüme edilmiştir. Anlamının " hafifçe dokunmak " olduğunu ve aslen Grek kökenli bir kelime olduğunu savunanlar da vardır. Terim olarak Tanrı tarafından yeryüzüne gönderilecek ve dünyayı hâkimiyet altına alacak bir peygamber veya bir liderdir. Mesih düşüncesinin oluşum süreci ve kökenleri incelendiğinde neredeyse bütün dinlerde mitolojik karakterde kurtarıcı şahsiyetlere ve bu fikrin beslendiği altın çağ/golden age mitlerine rastlanmaktadır.Mesihi hareketler idealize edilen ve tanrısallaştırılan mitsel bir döneme dönüş hareketleri olup tüm monoteist dinlerde gündeme gelen cennetten kovuluş/ cennetten düşüş miti ve genel anlamda insanın önüne kendisinden düştüğü cennete kavuşma amacının konulması,idealize edilen geçmişin geleceğe yansıtılması olarak tezahür etmektedir. Ne Mesih ne mehdinin temel gayesi bir yenilik ortaya koymaktır,aksine onlar geçmişte kalan ideal toplumsal düzeni yeniden yaşama geçirme arzusunu simgelemektedirler. Sümer ve Mısır'da, Antik Yunan'da, Uzak Doğu dinlerinde altın çağ olgusu farklı şekillerde karşımıza çıkmaktadır. Kurtarıcı Mitolojisi incelendiğinde Mısırlıların Osiris'i, Babillilerin Marduk ve Tammuz'u, Suriyelilerin Esmun ve Adonis'i, Mandelilerin/Mandeas ve Sabiler Manda d'Hayye ve Hibil Ziwa'sı, Hintlilerin Vişnu-Krişna-Vasudeva ve Şiva figürleri ilk öne çıkan kurtarıcılardır. Zerdüştlükte son kurtarıcı simgesi Saoşyant,ahir zamanda Tanrı Ahura Mazda tarafından kendine elçi olarak kıyametten önce gönderilecektir.Brezilya yerlilerinde Cargo Cults(Gemi İnancı) olarak ifade edilen deniz yoluyla gelecek bir kurtarıcı akidesi tespit edilmiştir.Brezilyalı Guarinislerde ise Mesihçiliğin temelinde dünyanın başlangıcında yaşayan mitolojik ataları gibi yaşama arzusu vardır.Yeni Gine halkı Menzren adlı bir kurtarıcının zenginliklerle dolu bir gemiyle gelip onları esaretten kurtaracaklarına inanmaktaydılar.Azteklerde müstakbel Mesih Tanrı Quetzal Coatl'dır.Yine Mecusilerde Brahman Warjawandi adlı bir kurtarıcı inancı mevcuttur.Eski Mısır Ameni adlı bir kurtarıcıyı beklemiştir.Hindulara göre henüz gerçekleşmemiş son Avatara bütün dünya için gerçekleşecektir.Son Avatar saflık ve mükemmelliğin sembolü olarak beyaz bir ata binmiş olarak ve elinde kılıç tutarken tasvir edilmiştir. Mesih fikrinin psikolojik ve sosyolojik kökenleri de konuya açıklık getirmesi açısından incelenmeye değerdir.İnsanlarda hükmetme ve egemen olma duygusu vardır ve insanlar bu amacı gerçekleştirmek için doğup büyüdükleri siyasi ve dini kültürden kendilerini meşrulaştıracak deliller ve motifler ararlar.Bu tip insanların bazıları kendileri politik-dini bir lider olarak ortaya çıkarken,bazen de toplumun kabulleri bunları kurtarıcı olarak görür. Bu tutum doğu toplumlarında daha yoğun görülür. İktidar kavgaları, toplumların siyasi-sosyal kriz dönemleri gibi depressive communal hareketlilikler yeni liderler üretmek ve bu duyguları alevlendirmek için en uygun zamanlardır. Özgürlükleri ellerinden alınan, zulüm ve baskı gören bazı insanlar, eylemleriyle bu olumsuzlukları değiştirmede başarısız kaldıklarında bu olumsuz yapıyı değiştirmek ve hakikati elde etmek için kendi dışında manevi güçler

The religious rites of Shia remain a mystery to Malaysia’s Sunnite majority. One such rite is the ziyarat (visits to sacred sites). This essay highlights the rituals conducted and performed by Malaysian Shi’ites during their seasonal pilgrimage to Iran and Iraq. Their rituals and behaviors during these pilgrimages to holy shrines in Iran and Iraq were documented from the standpoint of a cultural anthropologist. Rites from two sites, Mashad and Karbala, are presented in this study. Applying Herbert Blumer’s symbolic interactionism as a conceptual framework, and Charles Brooks’s methodology through social interaction and participant-observation, this essay aims to analyze and understand their rites, and the values and significance of these rites. By doing so, the axiological aspects of the rites were observed and clari-fied, thus enabling non Shi’ite Muslims to perceive greyest area of Shia rites, as per-formed by Shi’ites from Malaysia in their pilgrimage to Iran and Iraq.

This paper seeks to present a review and analysis of medieval Muslim historiography – especially that originating in what constitutes modern-day Iran, Iraq, and Syria, or the-then Seljuk Empire – with exclusive reference to its anti-Nizari Isma'ili content. The Nizari Isma'ili sect, also called the "Hashshashin" , was an offshoot of Isma'ilism that was created in 1094 AD after the death of al-Mustansir bi'Allah, the Caliph-Imam of the Fatimid Empire. The sect was primarily founded by Hasan bin Sabah, and was insultingly called the Hashshashin – better known to the English-speaking world as the Order of the Assassins. This paper would attempt to record and reflect upon the hateful opinions presented by the abovementioned writers about the Hashshashin, and would further attempt to relate their hateful rhetoric to intra-faith sectarian violence committed by Muslims in the modern world.

Ahmad al-Katib is an Iraqi Shiʿi dissident intellectual and an interesting
voice in the religious, intellectual, social and political discourse of the Shiʿite world today. He is a fairly well-known figure in Shiʿite circles but
is virtually unknown to western academic research. This paper examines
al-Katib’s life and writings and attempts to understand how a devout Shiʿi came to question the axioms upon which he was educated and raised. The doctrine of the Rule of the Jurisprudent is discussed, the criticism of it reviewed and al-Katib’s claims for it are evaluated. The ecumenical dialogue between Shiʿa and Sunna in al-Katib’s writings is discussed and the theoretical and practical aspects of his approach are reviewed. This will be followed by a discussion of al-Katib’s “Shi’ite Manifesto”, and an examination of the problems in al-Katib’s thought.

آنچه می خوانید ترجمه آزادیست از روایت یک آخوند از صیغه دختران حزب اللهی در قم که از کتابی آکادمیک در مورد صیغه در ایران اخذ کرده ام. برای محافظت از نویسنده از آوردن نام ایشان و کتاب خودداری می کنم و به ذکر عنوان «نویسنده» بسنده می کنم. راوی داستان را «آخوند قمی» می نامم چون وی اهل قم است.

روایت از آن جا شروع می شود که روزی ضمن جستجو در کتابخانه «مرعشی نجفی» در قم، نویسنده به کتابی بر می خورد که وقتی از کتابدار در مورد نویسنده اش جویا می شود کتابدار «آخوند قمی» را به وی معرفی می کند. نویسنده ملاقاتی با آخوند قمی ترتیب می دهد و از وی در مورد صیغه سوالاتی می پرسد. نحوه ترتیب دادن ملاقات هم خواندنی است، آخوند قمی که نمی خواهد هویتش فاش شود از گفتگو در ملا عام می پرهیزد و خواهان دیدار در خفاست. نویسنده راه های مختلفی را برای دیدار مخفیانه طراحی می کند.

اولین چیزی که آخوند به وی می گوید این است که نویسنده باید به جای «صیغه» در مورد «برده داری» تحقیق کند چرا که در فقه شیعه اصول صیغه و اصول برده داری در بسیاری موارد مطابقت دارند. آخوند قمی صیغه را امری صحیح و «مطابق با طبیعت انسان» می داند. طبق عادت معمول حوزه، انواع داستان ها و استدلال ها به هم بافته می شود تا درستی صیغه ثابت شود (۱). از استدلال های آخوند قمی در اثبات صیغه به چند مورد بسنده می کنم:

⁃ «اقلیم گرم جغرافیایی خاورمیانه نیاز جنسی را تشدید می کند»
⁃ «نیاز جنسی مانند نیاز به آب و غذا باید تامین باشد»
⁃ «در فرهنگ بسته نیاز جنسی قویتر است»
⁃ «زنان به نگهداری و تامین مالی نیاز دارند»
⁃ «صیغه حق مرد است»

در واقع، آخوند قمی لزوم صیغه را با ارجاع به کلیشه های فرهنگی-جنسیتی اثبات می کند.

قسمت اصلی اما داستان هایی است که آخوند در مورد «صیغه گروهی» دختران مذهبی توسط آخوندها روایت می کند. آخوند قمی توضیح می دهد که در ایران دو نوع صیغه وجود دارد، یکی آنچه در سطح جامعه (در خانه های عفاف و زنان خیابانی) شاهد آن هستیم که به قول آخوند قمی «تفاوتی با تن فروشی ندارد و تنها ده درصد واقعیت صیغه است.» و دیگری «صیغه واقعی» که در بین خانواده های مذهبی و در«کلاس های درس (مذهبی)» اتفاق می افتد. «نود درصد» صیغه در ایران به گفته وی از این دست است.

آخوند قمی توضیح می دهد که خانواده های مذهبی در قم مجالس ماهانه ای با «آخوندهای معتمد» خود دارند که در آن کل خانواده من جمله «دختران و زنان» به آخوندها معرفی می شوند. وظیفه آخوند معتمد «جواب دادن به سوالات» زنان و دختران است، اما در اصل، به قول آخوند قمی، «ایجاد رابطه احساسی» و «نفوذ در قلب» آنهاست. آخوندهای معتمد «ولی نعمت» ‌این دختران و زنان می شوند و گاه تا آخر عمر حمایت از آنان را بر عهده دارند.

در جلسات ماهانه زنان و دختران به صورت خصوصی با آخوندهای معتمد صحبت می کنند و آخوندها آن ها را راهنمایی می کنند. برای حفظ «شوونات» ‌معمولن «صیغه محرمیت» بین آخوندهای معتمد و زنان و دختران خوانده می شود. این صیغه به قول آخوند قمی از دو جهت اهمیت دارد: یکی این که عملی شرعی است که ارج و قرب آخوند و زنان و دختران را در چشم خانواده ها بالا می برد، و دیگر این که فاصله ای بین زنان و دختران و خانواده شان ایجاد می کند که بر اختیارات آخوندهای معتمد می افزاید. از عملکرد اصلی آخوندهای معتمد «همسریابی» برای دختران مجرد است. آخوندها معمولن دختران را به صیغه پسران خود، پسران آشنایان خود، یا به صیغه خود در می آورند. آن طور که آخوند قمی می گوید صیغه آخوندها با زنان متاهل هم از نگاه خانواده های مذهبی بی اشکال است.

آخوندها گاهی دختران تحت قیمومیت را در بین خود رد و بدل می کنند و در قبال آن ها پول دریافت می کنند. از این رو هر آخوند دختران خانواده های زیادی را می شناسد و شبکه بزرگی از زنان صیغه ای در اختیار دارد. آخوند قمی داستان روحانی معروفی را نقل می کند که در قم مدرسه دینی دخترانه دایر کرده بوده و آموزش و در عین حال قیمومیت شصت و هفت دختر ده تا بیست ساله قمی و شهرستانی را در آن جا بر عهده داشته است. آخوند مدرس یازده تا از این دخترها را صیغه می کند و همسرش که از داستان با خبر می شود به مراجع قضایی شکایت می کند. راه حل قضایی این است که آخوند باید هر یازده دختر را صیغه کند و به آن ها خانه و وسیله معاش دهد. وی هم همان کار را می کرد. 

به قول آخوند قمی دختران و زنان خانواده های مذهبی طعمه های مناسبی برای آخوندها هستند چون گرایش خاصی به چهره ها و شخصیت های مذهبی دارند و به راحتی به خواست روحانیون تن در می دهند. خانواده های مذهبی هم این نوع معاشرت را به رسمیت می شناسند و از یک طرف از روی اعتماد و تعصب و از طرف دیگر از ترس بی آبرویی در اجتماع یا ترس از مقابله با مذهب رسمی مخالفتی با آن نشان نمی دهند.

صیغه که در زمان شاه اسماعیل صفوی به ایران معرفی شد و در دوره قاجار متداول و در زمان پهلوی تابو شد، بعد از انقلاب و با روی کار آمدن مذهب رسمی بیش از هر زمان در تاریخ رونق گرفت و به قول آخوند قمی به «مافیا»یی تبدیل شد که نه تنها شهوت آخوندها را برآورده کرد بلکه نان «قوادی» آن ها را هم در روغن انداخت و آنان را به خصوص در شهرهای مذهبی به مال و منال زیادی رساند (۲). 


۱- روش استدلال روحانیون شیعه اغلب مثل آکروبات بازی است. شاید «آکروبات بازی ذهنی» توصیف خوبی برای آن باشد.

Le présent travail est en général un condensé de la version de L'Islam Chiite : Les origines, la foi et les pratiques (2003,ICAS Press) du même auteur. Cette version plus courte vise à souligner les principaux sujets relatés en Islam en général et en Islam chiite en particulier. Ces deux travaux représentent une contribution modeste pour combler certaines carences qui existent dans le domaine des études islamiques en général, les études des chiites en particulier. Ecrit de manière simple et claire, ils sont les résultats de vingt ans d'implications dans les études islamiques, et basés sur l'étendue de deux séries de cours sur l'Islam chiite exposées aux auditeurs anglais : une première série de cinquante exposés délivrés au Jami'at Al Zahra (Le principal Séminaire Islamique pour les Femmes) à Qom, Iran en 1995 et 1996, et une deuxième série de trente exposés délivrés à l'Institut Islamique de Manchester et Le Centre Social Chiite de Manchester, en Angleterre en 1998 et 1999.

Le premier chapitre commence par expliquer la signification aussi bien littéraire que technique du terme " chi'ah ", et des références de célèbres chercheurs sont citées dans ce domaine. Puis il propose l'étude des origines de l'Islam chiite et comment il a commencé à exister.

Le deuxième chapitre étudie les sources de pensées chiites, c'est à dire, le Saint Coran, La Sounnah (tradition prophétique), la raison et le consensus. Mettant en évidence les versets du Saint Coran, le chapitre cherche à établir que les chiites comme les autres musulmans croient que le Coran qui est en vigueur de nos jours est La Parole Divine révélée au Prophète Mohammad. Le chapitre continue en expliquant la deuxième source la plus importante, c'est à dire, la Sounnah, qui inclue les paroles et les actions du Prophète Mohammad. Le Coran lui même demande aux musulmans de prendre Le Prophète comme modèle principal, de se référer à lui pour juger et régler les conflits et de parler du Prophète comme celui qui récite, enseigne et explique le Coran. Dans ce chapitre, il y a aussi une discussion sur les gens de la maison du Prophète (Ahloul beyt) et leur rôle dans la présentation de la Sounnah. Puis vient la discussion sur l'importance de la raison et son rôle dans la compréhension des croyances islamiques, de ses valeurs et des lois pratiques. Enfin il y a une discussion sur le consensus légal (Al ijmà') et comment il est vu par rapport à la Sounnah dans la perspective chiite.

Le troisième chapitre étudie les doctrines fondamentales de la foi chiite. A savoir l'Unicité de Dieu, la prophétie et la résurrection qui constitue les Principes de la Religion (Islam et autres religions divines), quelques doctrines additionnelles importantes telles que la Justice Divine, l'Imâmat y sont étudiées. Ces doctrines peuvent être partiellement partagées par d'autres musulmans, mais les chiites sont ceux qui croient à toutes d'entre elles.

Le quatrième chapitre est un bref inventaire des pratiques chiites avec de brèves références de bases objectives. Ces pratiques sont en principe partagées par tous les musulmans, bien qu'il peut y avoir quelques différences en particulier en fonction de chaque école de pensée islamique.

Le cinquième et dernier chapitre discute brièvement du monde chiite d'aujourd'hui. Ce chapitre commence par un bref inventaire des dernières statistiques sur les musulmans et la population chiite du monde. Il y a aussi des détails des affiliations religieuses de certains pays avec une longue histoire de présence chiite dans ces pays. Bien qu'il n'y ait aucune statistique réelle ou approuvée sur ces populations chiites dans le monde, des efforts ont été faits pour en collecter les plus proches.

Je dois aussi noter que l'auteur est sincèrement et profondément attaché à l'unité islamique et espère que ce travail est comme une étape modeste vers la fraternité islamique. En fait l'un des meilleurs moyens pour achever cette unité et cette fraternité est de mieux se connaître et de vaincre les préjudices historiques qui empêchent une compréhension objective entre eux. Selon les paroles d'Imam Ali : " les gens sont les ennemis de ce qu'ils ne savent pas ".

In the mid-90s, Lebanon’s Hezbollah movement and the Iranian Ayatollah Khamene’i both banned bloody forms of self-flagellation such as tatbir (cutting the forehead with a sword), calling them backward and un-Islamic. They argued that Shi‘a Muslims ought to imitate Husayn by actively fighting against oppressors rather than passively mourning Husayn’s martyrdom. This prohibition has not been unanimously applied in all Muslim
countries, including Syria, where such practices persisted until the Arab Spring (when virtually all Shi‘a Muslims left the shrine-town where these practices were performed). By closely reading the linguistic, conceptual, and juridical discourses that circulated in Syria in order to justify this position, the paper shows that the performers of tatbir conceived of these rituals in revolutionary, rather than reactionary, terms. By examining the performance and reception of flagellation processions in terms of differing modalities of affect, the paper opens up spaces for rethinking ‘revolution’ and ‘redemption’ in contemporary Twelver Shi‘ism.

Accusations of sexual perversion, of defying both the statutes of man and the laws of the almighty, have since Antiquity been a staple of heresiographic discourse. They had pride of place in Muslim heresiology as well, which charged many a heretical sect with engaging in group sex, incest, wine-drinking, as well as the shunning of the obligatory rituals such as prayer and pilgrimage. One group has fared particularly badly at the hands of Muslim heresiographers – the so-called Shiʿi ‘extremists’ (Ghulāt), who lived in Iraq in the eighth and ninth centuries. Scholarship has mostly taken a simplistic approach to accounts about their alleged antinomianism, by either rejecting them as hostile propaganda or, more frequently, by accepting them wholesale as accurate. Meanwhile the historical, polemical contexts in which such accusations were made have been ignored. This article evaluates within a broad historical context two bodies of evidence: the heresiographical accusations on the one hand, and the Ghulāt’s own writings on the other. My contention is that while the most hair-raising accusations are nothing by hostile polemics, others do reflect the Ghulāt’s actual beliefs and practices. I conclude by examining the cultural meanings which antinomianism had among the Ghulāt – namely, as boundary markers and tools for identity construction.

Within the Jafari school of thought it is mandatory to shorten one's prayer and to break one's fast when covering a certain space while travelling. The distance a traveller has to cover in order for this regulation to apply is provided in a fixed length, attributed to the Persian/Arabic farsakh. Within this article the possibility is historically examined whether the right way to approach the farsakh is by attributing it to space, or whether it is better to view the farsakh as a unit of measurement that is better expressed in time.

Arbitration and Mediation in the 9 th /15 th Centurie among the Druze of the Gharb.
In 9 th /15 th century Syria, the Gharb region was not entirely Druze, as some have written. The region hosted a group of Unitarians who had been initiated into the Druze tawḥīd, and who were organized at the margins of State institutions, and had developed their own law. This article analyses the social role of arbitrators and mediators, drawing from local chronicles and normative sources. Arbitration (taḥkīm) as documented during the archaic period of the Emir al-Sayyid (d. 884/1479), disappeared from later legal treaties, replaced by conciliation (ṣulḥ) carried on by a " College of mediators " and the " sāyis " , both a judge and a mediator. Among the Druze, the sulḥ soon emerged as the preferred mode for settlement of litigation, by solving conflicts outside the bounds of State justice.

Cet article examine le rôle social de l'arbitre et du médiateur, à partir de chroniques locales et de textes normatifs. L'arbitrage (taḥkīm), attesté à l'époque encore archaïque de l'émir al-Sayyid (m. 884/1479), disparaît des traités juridiques plus tardifs au profit de la conciliation (ṣulḥ) que tentaient le « collège de médiateurs » et le « sāyis », à la fois juge et médiateur. Chez les Druzes, le ṣulḥ semble avoir été le mode privilégié de règlement des litiges, soustrayant aux tribunaux étatiques des conflits internes à la communauté.
