Role of Law in Transformation of Individual and Society

Theoretical approaches and methodological choices in the anthropological study of the “legal” share the assumption that normative phenomena and, more specifically, law is a social product, carrying the traces of the context in which they are produced. In this sense, norms/law can be understood as “metaphoric representation” of their social and political context. At the same time, anthropological legal research has looked abundantly at the ways in which law participates in the creation of social reality. In assessing the “performative” impact of juridical phenomena, or what Bourdieu refers to as the “power of law”, an analysis of the relation between legal processes, discursive practice and political and social changes is imperative. The central argument is, thus, that juridical phenomena “not only reflect but also produce and reinforce social processes”.

The title, like the report, alludes to applications and practice of law beyond the courtroom and court appearances. It documents field-based strategies in alternative law in different parts of India, setting out the relevance of alternative law practices for social justice in the context of India.

The Commissioner's recommendations. Taking into account the findings and conclusions of this issue paper, the Commissioner makes the following recommendations, with the aim of improving respect for the rule of law on the Internet and the wider digital environment.

I. On the universality of human rights, and their equal
application online and offline:

1. The basic requirements of the rule of law apply, and should be made to apply in practice, equally online and ofine. This means in particular that: the European Convention on Human Rights (ECHR) and all Council of Europe data-protection rules apply to all personal data-processing activities by all agencies of all Council of Europe member states, including the member states national security and intelligence agencies; rule of law obligations, including those fowing from Articles 8 (right to respect for private and family life) and 10 (freedom of expression) of the ECHR, may not be circumvented through ad hoc arrangements with private actors who control the Internet and the wider digital environment; Council of Europe member states should strive to ensure that non-European states similarly comply with their international human rights obligations in anything they do that afects individuals using the Internet or otherwise active in the wider digital environment; and no states (and none of their agencies, including their law enforcement and national security and intelligence agencies), European or otherwise, should access data stored in another country or passing through the Internet and e-communications backbone cables running between countries  without the express consent of the other country or countries involved, unless there is a clear, explicit and sufciently circumscribed legal basis in international law for such access and provided that such access is fully compatible with international data protection and other human rights standards.

Recently the great people of this once great nation have been roused
by their government’s atrocities against them to peacefully demonstrate
in support of their government allowing them to breathe the air of life and liberty their organic law promises. The People are clearly suggesting that the judicial departments of democratic republics, like ours, should heed the actual language of our Constitutions rather than their own court made precedents that too often elevate immunities for a totalitarian regime over the Natural Law our Founders and Framers intended we should enjoy.

For the People will not and should not accept a government that
seeks to protect its own workers’ best interests at the expense of the people who are being governed to promote the best interests of an
Oligarchy.

CONCLUSION

This Court should modify the Commissioner’s ruling so as to
allow the Larson’s attorney, who is a vulnerable person, from having to
prepare an Opening Brief based on an inadequate record during a
Pandemic in which he has been instructed by the Governor of Washington to shelter at home.

Our Supreme Court’s record has been by and large satisfactory in protecting civil liberties though there have been few anxious moments, decisions, when the Court behaved more like mere mouthpiece of the ruling government in the curtailment of rights by the  government. We believe that our Constitution, political leadership and the highest Court have performed well, despite ups and downs. India today is a successful democracy and a leading economic power, there have been authoritarian and autocratic leaders who come into power by popular votes but they were and will be thrown out of power and the Supreme Court has stand up in every challenging time to protect people’s rights from the rising authoritarianism tendencies. Chief Justice Patanjali Sastri observed in V.G.Row (1951), that the Supreme Court has been assigned the role of a sentinel on the ‘qui vive’. It is both the first Court as well the Court of last resort for the protection of rights
