PRÓLOGO.
En un mundo en constante cambio, donde las realidades sociales y legales evolucionan a un ritmo vertiginoso, la custodia de menores y la justicia restaurativa emergen como campos de vital importancia en el desarrollo de políticas efectivas y humanistas para la protección infantil. Este libro, titulado "Custodia y Conciliación: Forjando Caminos de Justicia Restaurativa para un Futuro Infantil Resplandeciente", representa una colaboración trascendental entre Luis David Fernández Zambrano, Director de la Cátedra Cultura para la Paz y Derechos Humanos de la Universidad de Buenos Aires, y Robert Mnookin, profesor emérito de la Facultad de Derecho de la Universidad de Harvard-USA.
El presente volumen explora en profundidad las intersecciones entre la custodia legal de menores, la justicia restaurativa y la conciliación, ofreciendo una visión renovada y multidimensional sobre estos temas críticos. La obra se sumerge en la complejidad de las disputas de custodia, abordando no solo las normativas jurídicas que han moldeado la protección infantil, sino también las dimensiones humanas y emocionales que afectan a los niños y a las familias.

In the author’s opinion, the aim to strengthen the protection of the welfare of the child and to improve the level of legal security for children should be considered the right direction to make changes to the law. Nevertheless, not all the proposals contained in the Senate bill fully achieve the intended purpose. The author evaluates the proposed solutions, pointing out their advantages and disadvantages. To a certain extent, the author proposes a clarification of the code provisions in order to strengthen the implementation of the principle of the protection of the child’s welfare in the judicial process.

Datafication is the activity of the 21st century. If ‘data is the new oil’, children’s data is invaluable. The persistent, generalised monitoring activity we are all victims of nowadays, is particularly stronger and, at the same time, completely ‘normalized’ and accepted when it comes to children. In this case it is done by family members – mainly parents – and raises a lot of questions. This paper addresses the topic regarding the employment of geo locations tracking applications on children from the parental responsibility’s, the evolving capacities of the minors’ and the State’s or the institutions’ role, perspectives. Analysing these three dimensions, the article argues that only a child-centered approach is able to maintain the balance between these three elements, and suggests that the UK Age- Appropriate Design Code (Children’s Code) can be in fact elected as a model to other legal systems, preserving the very essence of each of these elements, protecting and promoting children’s rights as well.

Las repercusiones legales y socio familiares de los “permisos de viaje de menores en el Perú” no suelen ser detallados en la doctrina nacional debido a la coyuntura temporal de estos casos. No se toma en cuenta el contexto de autonomía y desarrollo del menor frente a los derechos e intereses de sus progenitores y su análisis permite detallar la incidencia de tres fuentes autónomas de derechos y condiciones que deben ser analizadas generándose en caso de inconvenientes o situaciones de conflicto, el interés superior del niño ante las condiciones que desarrollen sus progenitores en el caso de un eventual “viaje”.

Recent decades have seen the facilitation of unconventional or even extraordinary reproductive endeavours. Sperm has been harvested from dying or deceased men at the request of their wives; reproductive tissue has been surgically removed from children at the request of their parents; deceased adults' frozen embryos have been claimed by their parents, in order to create grandchildren; wombs have been transplanted from mothers to their daughters. What is needed for requests to be honoured by healthcare staff is that they align with widely shared expectations about what people's reproductive potential ought to be, what marital relationships ought to result in, and which kinds of ties are desirable between parents and children. Costly and invasive technologies are not considered excessive when they are used to support the building of appropriate families. However, deviations from dominant reproductive norms, even if technologically simple and convenient to the participants, are unlikely to receive support. In this paper, we offer examples of such deviations and explore their implications. If reproduction is important as a way of creating genetic relationships, should reproductive material in storage be offered to genetic relatives other than the people from whom it originated? And if parents are allowed to have reproductive material collected from their offspring, or even to use it to create babies, should offspring likewise be allowed to use their parents' reproductive material? We tackle these questions and suggest ways in which interests in genetic ties could be operationalised in a more coherent and less-invasive manner than they currently are.

EU social policies should be complemented by contributing to a harmonious development of society, by reducing structural and regional imbalances, developing a balance between the a localized community and the national society, and improving the living standards of citizens and families of member states (Garrido 2002). Such important social policy principles as freedom and justice are addressed and represented in family laws in the EU regulations introduced during the period of 2000–2016. In this article, we studied the EU’s legal solutions in reference to national (Spain) laws on these matters: children and parental responsibility (adoption, child abduction, family benefits) and couples (matrimonial, regimes, prenuptial agreements, provisional measures). Data suggest that humanity, regardless its size, can have a better population in 2050 than in 2020 only if climate change is successfully tackled. In the case of climate action failure, the human population size ought not to be much bigger than 8 billions.

El concepto de “órgano jurisdiccional” en los Reglamentos europeos de Derecho internacional privado está planteando numerosos problemas en la práctica de los últimos años. La razón es que se ha pasado de una concepción estricta de tribunal a una concepción amplia basada en la función jurisdiccional. Esto obliga a determinar un concepto autónomo que sirva para la aplicación de las normas de competencia judicial internacional y de reconocimiento de resoluciones.

Se analizó la figura de la guarda y custodia de los hijos menores de edad e incapaces y su relación con el prejuicio de género para su asignación, para lo cual se hizo una revisión de las legislaciones familiares y civiles de cada entidad federativa de México, encontrando que algunas establecen la preferencia por la madre hasta determinada edad, sin tomar en cuenta el interés superior del menor, fomentando además que se continúe con los roles de género que han perdurado durante generaciones, haciendo a un lado el principio de igualdad y no discriminación fundamentado en tratados internacionales y en la Constitución Política de México, ello a pesar de que la Suprema Corte de Justicia de la Nación ha emitido tesis recomendando evitar el prejuicio de género.

Due to the constant development of medicine and biotechnology, including the in vitro procedure, more and more infertile couples can fulfil their desire to have a child. Traditional rules of family law concerning the determination of status familiae of such children have then turned out to be insufficient. The situation is even more complicated when IVF procedure assumes the use of donated genetic material or the involvement of a surrogate mother. Therefore in the field of family law the intention to “create” a child starts to play quite an important role. Family law is then undergoing far-reaching transformations, especially in those countries where same-sex couples are eligible to start IVF procedures (Great Britain, USA, Germany, Austria).

RESUMEN: Se ocupa este trabajo de analizar el régimen normativo regulador de las cláusulas de elección de foro en el ámbito del Reglamento (CE) núm. 4/2009 del Consejo, de 18 de diciembre de 2008, relativo a la competencia, la ley aplicable, el reconocimiento y la ejecución de las resoluciones y la cooperación en materia de obligaciones de alimentos. Estudio del régimen de la sumisión expresa a favor de un órgano jurisdiccional de un Estado miembro: operatividad limitada frente a la libertad de las normativas anteriores al Reglamento 4/2009, así como, en particular, su juego respecto de los alimentos entre cónyuges y excónyuges, además de a menores de 18 años. Asimismo, del régimen de la sumisión tácita, especialmente en cuanto a lo que se refiere a alimentos para menores y su vinculación con el foro accesorio de la responsabilidad parental. Finalmente, y con base en la existencia de un pacto de elección de foro a favor de los operadores jurídicos de un Estado miembro, un breve apunte sobre la relación entre el Reglamento 4/2009 y el Convenio de Lugano de 30 de octubre de 2007 relativo a la competencia judicial, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil.

ABSTRACT: This paper studies the rules governing the choice of court clauses contained in the Council Regulation (EC) n. 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations. Express choice of court agreement in favor of a court of a Member State: limited nature, its role in case of maintenance obligations between spouses or former spouses, and prohibition of its exercise related to minors under 18. And international jurisdiction based on the appearance of the defendant, above all in disputes relating to maintenance obligations towards a child under this age and the proceedings concerning parental responsibility. Finally, faced with a choice of court agreement in favor of a court of a Member State, brief note about the relationship between Regulation 4/2009 and Lugano Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters on 30 October 2007.

It is worth noting that the main features of the Czech legislature on the civil effects of canonical marriage were stabilised in the ancient past.
Austrian State:
- Recognition of the civil effects of canonical marriage;
- Unequal position of individual Churches according to their specificities - for Catholics, obligation to marry canonically (but on the other hand, possibility of an alternate form of marriage only before a state official called Notzivilehe) and impossibility to divorce marriages of Catholics;
- The complete absoluteness of canonical jurisprudence (judicial and administrative) for the state legal system.
Czechoslovak Republic in the interwar period:
- Recognition of civil effects of canonical marriage against Hungarian tradition;
- Equal position of singles;
- Possibility to divorce all marriages without distinction.
The legislature during the totalitarian communist period radically differed from this tradition, even being part of the ideological struggle.
Therefore, it is understandable, after the fall of the communist regime, to return to the tradition of the Czechoslovak Republic of the interwar period with two changes: the administration of metrics only by public (state) offices and greater precision of the administrative procedure in close cooperation between public and church offices.
Against attempts to change this situation in the first decade of the 21st century, the solution clarified in the last decade of the 20th century was stabilised by its integration into the new Civil Code, adopted in 2012.

W prawie kanonicznym istnieje instytucja orzeczenia nieważności małżeństwa. Powodem takiego orzeczenia może być jakaś wada zgody małżeńskiej, zaś do kategorii wady zgody małżeńskiej zalicza się psychiczną niezdolności do podjęcia podstawowych obowiązków małżeńskich (kan. 1095 nr 3 Kodeksu prawa kanonicznego z 1983 r.). Z kolei w tej grupie umieszcza się różnego rodzaju uzależnienia. W artykule zaprezentowano przypadki spraw sądowych związane z uzależnieniami od alkoholu, hazardu, Internetu, gier komputerowych, seksu, pornografii, pracy, osób, które doprowadziły do orzeczenia nieważności małżeństwa. Celem takiej prezentacji jest pokazanie przykładów zachowań, które będąc z punk-tu widzenia medycznego uzależnieniami, były jednocześnie kanonicznymi przesłankami do orzeczenia nieważności małżeństwa.

Case-law of Spanish courts on international jurisdiction has been profoundly altered in the last forty years as a consequence, in part, of the contact of these courts with European legal instruments and the case-law of the Court of Luxembourg. In those cases, in which the EU Regulations are applicable,
such instruments and jurisprudence must be always considered; but they
also display indirect effects in cases outside their scope of application. Here,
the modification of the position of Spanish courts in relation to the “derogatio fori” is especially noteworthy. This influence of the EU instruments and the case-law of the Court of Luxembourg is based, to a large extent, on the way in which the EU rules have inspired Spanish domestic legislation. We should also consider that Spanish courts are not only recipients of the doctrine emanating from the Court of Justice, but also contribute to creating it through preliminary rulings requested by these courts; some of which have acquired special relevance.
