Pagus

Si definivano incolae, in diritto romano, gli individui domiciliati entro i confini di una colonia o di un municipio. Poteva darsi la presenza di incolae sia in colonie o in municipi romani, sia latini. Premesso uno studio delle comunità locali disseminate nei vasti dominii di Roma, l’indagine si è concentrata sulla posizione degli incolae, che comportava una collocazione giuridica ben precisa. Di conseguenza, per poter essere incolae, i soggetti domiciliati dovevano avere un riconoscimento formale o, secondo i casi, un’autorizzazione da parte della civitas. Sulla base delle fonti letterarie, giuridiche, gromatiche ed epigrafiche si è delineata la condizione giuridica degli incolae, differenziandola da quella di realtà affini quali, tra gli altri, gli adtributi e i contributi.

Useful elements have reconsider the marble cuirassed statue from Fuorigrotta (pagus of Naples) chronology and original position. On the basis of the available data the statue could be supposed to stand along the Via Puteolis-Neapolim per colles, near the bridge on the ancient San Lorenzo torrent, maybe as gift for emperor by the Fuorigrotta village: in fact, it actually reproduces an emperor (or a member of the royal family) of the middle of the 2nd century AD and the cuirass technical details and decorations show it. The sculpture, now in the Naples National Archaeological Museum, would be gone to “Rione Nicola Miraglia” (discovery spot) after falling down in the torrent, which has changed over the years in a farm road (called “Strada Comunale San Lorenzo”, obliterated by the urban excavations in the early 20th century). Furthermore, the Neapolitan pagus landscape in Roman age is reproduced in this contribute.

L’articolo prende in esame quattro cippi paganici rinvenuti nell’ager di Iulia Concordia e, a titolo di confronto, altri due analoghi reperti rinvenuti in Gallia Narbonensis, nei pressi di Arausio e Alba Augusta Helviorum. Viene quindi avanzata l’ipotesi che possa trattarsi di cippi che, posti lungo strade pubbliche in aree suburbane o rurali, indicavano la presenza e la lunghezza di strade vicinali costruite da singoli pagi, i quali ne detenevano la proprietà e avevano il compito di garantirne la manutenzione. Si ipotizza che una sistematica riorganizzazione della viabilità secondaria, di cui tali cippi sarebbero l’esito, risalga all’età augustea. A titolo di ulteriore confronto, viene infine analizzato un settimo cippo, rinvenuto nel Samnium, il quale potrebbe aver svolto la medesima funzione.

Si delinea come fossero disciplinati i rapporti giuridici fra i Romani e gli indigeni nelle colonie romane tra il quarto secolo a.C. e il 212 d.C. Le fonti attestano che esistevano diverse possibili soluzioni per disciplinare la presenza degli indigeni locali in una colonia romana. La prima era che gli indigeni ricevessero terre all’interno della colonia, venendo contestualmente assoggettati ai magistrati di quella. La seconda soluzione era che gli indigeni, pur ricevendo terre entro i confini della colonia, mantenessero una propria comunità politica parzialmente autonoma. Poi poteva darsi il caso che gli indigeni venissero resi cives Romani e così inclusi tra i coloni stessi. Infine, poteva accadere che essi restassero nella colonia, ma in stato di asservimento di fatto ai coloni romani.

Per il diritto romano erano incolae coloro che avevano il domicilio entro i confini di un municipio o di una colonia diversi da quelli in cui avessero la loro origo. È benvero attestata una differenza fondamentale tra coloro che si domiciliavano nell’oppidum e coloro che lo facevano nel territorium, in quanto per i secondi il domicilio non era sufficiente per ottenere la qualifica di incolae, ma era altresì necessario il possesso o la proprietà di un ager. Tuttavia, quando i rispettivi requisiti o adempimenti fossero stati rispettati, sia gli individui domiciliati nell’oppidum, sia quelli domiciliati nel territorium erano considerati tutti incolae a ogni effetto di legge, senza che possa affermarsi che la qualifica di incolae potesse più pienamente o più correttamente applicarsi ai primi, rispetto ai secondi, contrariamente a quanto ritenuto da gran parte della più influente dottrina moderna. S’è infatti visto che, dei testi che si sono utilizzati per negare quest’ultima affermazione, e cioè D.50.1.35, D.50.1.27.1 e C.10.40(39).3, il primo e il terzo non erano riferiti a individui domiciliati, ma solo a persone dimoranti nel territorio di una civitas, e il secondo non trattava della relazione tra città e territorio di una stessa civitas, ma dei rapporti tra due civitates. Il fatto che tanto i domiciliati nell’oppidum, quanto quelli nel territorium fossero in linea di principio considerati egualmente incolae di una stessa civitas, non impediva naturalmente, in chiave pragmatica, di ravvisare differenze di fatto notevoli tra gli uni e gli altri: quelli che abitavano nel centro urbano erano ovviamente molto più partecipi della vita cittadina, rispetto a quelli che vivevano in zone molto periferiche e spesso assai lontane dal capoluogo e, in confronto con questi ultimi, essi sfruttavano i servizi della città in modo molto più ampio. Tutto ciò giustamente non era considerato privo di conseguenze dal diritto e difatti gli incolae domiciliati nell’oppidum, perciò denominati urbani, oppidani o intramurani, erano soggetti a munera e, in età più avanzata, dovevano accettare honores in misura maggiore rispetto agli altri, che erano detti in contrapposizione ruris incolae o anche incolae extramurani.

Nell’autunno del 79 d.C., la catastrofica eruzione vulcanica che seppellì Pompei e tutta la fascia marittima vesuviana da Ercolano a Stabia, fu il teatro dell’intervento umanitario delle quadriremi della flotta imperiale di Miseno al comando di Plinio il Vecchio, che al termine di quella missione perse la vita. Tale epilogo personale, sul quale si è focalizzata la testimonianza del nipote, ha distolto l’attenzione dei posteri dalle navi romane e dalla loro coraggiosissima operazione di soccorso, i cui lineamenti generali possono tuttavia essere storicamente ricostruiti vagliando accuratamente i pochi dati pervenuti dalle fonti letterarie ed integrandoli con il complesso di conoscenze desumibili dalla storia, dalla vulcanologia, dall’archeologia e da molte altre discipline pertinenti, incluse le scienze marittime e navali.

L'inscription connue sous le nom de "lex rivi Hiberiensis" présente une importante lacune centrale, dont la dimension peut être estimée d'après la largeur des colonnes de texte. Il est ainsi possible de comparer plusieurs restitutions et de vérifier leur compatibilité avec l'espace disponible. De ce fait, il faut exclure une construction complexe impliquant plusieurs pagi étalés sur deux cités dont une n'est pas mentionnées dans les parties conservées du texte. La loi s'applique plutôt à un pagus et à un castellum de Caesaraugusta.
The inscription known as "lex rivi Hiberiensis" has a large central gap, whose size can be estimated from the width of the text columns. This makes it possible to compare several restitutions and their compatibility with the available space. Therefore, we must exclude a complex construction involving several pagi belonging to two cities, one of which is not even mentioned in the remaining parts of the text. The Act applies rather to a pagus and a castellum of Caesaraugusta.

RESUMEN: Se exponen en este artículo algunas precisiones sobre aspectos concretos de las canteras romanas de Almadén de la Plata, centrados en las relaciones que estas pudieron tener con el pagus Marmorariensis, el intento de identificarlas con el Mons Mariorum citado en un itinerario antiguo, su relación con la statio serrariorum Augustorum documentada en Italica y la problemática de la inclusión de las canteras en el Patrimonium Caesaris. Asimismo, se plantea la hipótesis de una actuación edilicia de los Severos en Italica.

ABSTRACT: Some remarks about specific aspects of the Roman quarries located in Almadén de la Plata are made in this paper. These issues are related to: the relationships that they might have with the pagus Marmorariensis; the attempt to identify them with the Mons Mariorum cited in an ancient itinerary; the links existing between them and the statio serrariorum Augustorum testified in Italica, and the subject of the inclusion of these quarries in the Patrimonium Caesaris. Likewise, it is suggested that there was an imperial building activity in Italica in Severan times.

The military character of Moesiae and a low anthropization favored both the born of agglomerates near the
numerous castra and of rural settlements of various legal nature, particularly in the eastern part of the territory, in nearest contact with the Greek towns on the shore and in Thrace. In these agglomerations gathered peregrini, veterani and cives Romani often consistentes. The vici of Moesiae, with own magistrates and territory, do not seem ever to have ever reached full autonomy.

When studying the territory of the Roman communities, recognising the ancient rules used for establishing borders is of the utmost importance. Closely linked to this topic is also the question of which criteria may be used by modern scholars in order to identify – or at least suppose with a good degree of certainty – the boundaries of a land belonging to a particular community. Among these criteria, the possible identification of some pagi as witnesses of areas located at the borders of civic lands has rarely been taken into account. Through the analysis of some case studies from Italy and the Western Provinces, this paper aims to point out the widespread presence of territories belonging to pagi at the border between two or more communities.

This articles reviews the results of the project «Research and valorisation of mining areas and civitates in NE Portugal (Bragança, Guarda and Castelo Branco districts bordering with Spain) (MinCiNEP)». Within it, archaeological areas of bordering Portugal have been studied, in order to detect processes of transformation witnessed on the Spanish side after the Roman conquest. Special attention has been paid to the identification of Roman mining activity, understood within an integrated view of settlement and territory. Likewise, Roman epigraphy from these areas has been revised.

This article summarizes the conclusions of a inter-university program devoted to human forms of aggregation in ancient Italy. The major papers presented at Ischia highlight the complexity of the systems memberships of the citizen in addition to its main civic identity. Clusters related to the city, space and sociability are discussed.

Istražena je površina od 17 946 m², a objekti su grupirani na dva položaja. Što se tiËe antiËkog naselja, radi se o ruralnom naselju koje
se datira od 2. do sredine 5. st. po. Kr. Otkriveni su tragovi stambenih i radnih prostora zajednice koja se bavila poljoprivredom i stoËarstvom
te sitni arheološki nalazi koji ukazuju na postojanje zajednice koja je koristila robu lokalne proizvodnje, a u manjoj mjeri importe.

Territoires et limites en Limousin dans le haut Moyen Âge

Les premières études sur les limites de la cité des Lémovices remontent au XIXe siècle et s’appuient sur le principe général, longtemps accepté, d’adéquation entre l’ancien diocèse et la cité antique qui l’a précédé. Force est cependant de constater qu’en Limousin, la plupart des auteurs qui ont travaillé cette question et notamment le pionnier, Maximin Deloche, l’ont toujours fait avec de grandes précautions et un réel pragmatisme, soulignant l’existence de nombreuses variations de limites entre la cité et le diocèse de Limoges au fil du temps. Il apparait cependant qu’en dépit de ces exceptions, le principe général de correspondance entre cité antique et diocèse médiéval a paru globalement valide. Dans les années 2000, ce principe de correspondance a été remis en cause de façon radicale par des chercheurs s’appuyant essentiellement sur les distorsions de limites constatées, ce qui a parfois conduit à l’idée de limites incertaines, floues, voire inexistantes dans le haut Moyen Âge pour ces espaces administrés. Est apparu alors le concept de « déterritorialisation » du diocèse selon lequel l’espace administré par l’évêque n’aurait dans un premier temps trouvé sa consistance que dans la reconnaissance par les habitants d’un lieu donné de tel ou tel évêque et donc de tel ou tel siège épiscopal. Par la suite cette idée cheminant, des auteurs ont fini par refuser toute idée de limites ou de frontières pour les subdivisions des comtés ou des diocèses du haut Moyen Âge et notamment pour les paroisses primitives. Cette vision semble en fait rendue possible par le fait que les sources sont pauvres et très lacunaires pour le haut Moyen Âge et autorisent toutes les interprétations. Si cette hypothèse de « territoire par consentement » est envisageable dans les régions situées à l’extérieur de l’Empire romain, comme par exemple dans les espaces germaniques, elle paraît difficilement envisageable dans des régions fortement marquées par l’administration romaine comme l’Aquitaine. Des exemples pratiques et bien documentés en Limousin pour les époques mérovingiennes et  carolingiennes, tant pour les contours externes que pour les subdivisions internes, entrent en contradiction avec cette théorie.

The first studies on the limits of the city of Lemovices go back to the nineteenth century and are based on the general principle, long accepted, of adequacy between the old diocese and the antique city that preceded it. However, it is clear that in Limousin, most of the authors who have worked on this issue, and especially the pioneer Maximin Deloche, have always done so with great care and pragmatism, underlining the existence of numerous variations of limits between the city and the diocese of Limoges during the Middle Ages. It appears, however, that despite these exceptions, the general principle of correspondence between the ancient city and the medieval diocese seemed generally valid. In the 2000s, this correspondence principle was radically questioned by different researchers based essentially on the observed distortions of limits, which sometimes led to the idea of uncertain, unclear or non-existent limits for these spaces administered in the High Middle Ages. Subsequently emerged the theory of the "deterritorialization" of the diocese according to which the consistency of a diocese of the High Middle Ages would rest only on the recognition by the inhabitants of the particular authority of a bishop  or a given episcopal seat. Following this theory, some authors rejected any idea of limits or boundaries for subdivisions of counties or dioceses of the High Middle Ages and especially for primitive parishes. This vision seems made possible by the fact that the sources are very poor and lacking for the High Middle Ages and allow all interpretations. If this hypothesis of "territory by consent" is conceivable in the regions outside the Roman Empire, as for example in the Germanic areas, it seems difficult to envisage it in regions strongly marked by the Roman administration as the Aquitaine. Practical and well-documented examples of Limousin for the Merovingian and Carolingian periods, both for external contours and for internal subdivisions, contradict this theory.
