La cuestión sobre la celeridad de los procesos de nulidad matrimonial no es una novedad. La doble conformidad pro nullitate fue un problema estudiado por la doctrina desde la promulgación del CIC de 1917. Esta preocupación por la celeridad fue constante antes, durante y después del Concilio Vaticano II, y en el Sínodo de los Obispos. Esta inquietud estuvo presente también en la primera fase de reforma codicial y en las Procedural Norms, de 28 de abril de 1970. Como consecuencia de ello, el MP Causas matrimoniales de 1971 emanó el processus brevior contenido en el CIC de 1983 y en la Instr. DC. Este processus brevior sigue parcialmente vigente en el MP Mitis Iudex Dominus Iesus, junto con el nuevo procedimiento abreviado.
The question about the celerity of the proceeding for the nullity of marriage is not a novelty. The dual compliance pro nullitate was a problem studied by the Doctrin, since the promulgation of the CIC of 1917. to the MP CM of 1971. This solicitude for celerity was constant before, during and after the 2nd. Vatican Council and in the Synod of the Bishops. This consideration was present too during the 1st. phase of the reform of the Code and in the Procedural Norms of 28. April 1970. Following this, the MP Causas matrimoniales of 1971 decreed the same processus brevior contained in the CIC of 1983 and in the Instr. DC. This processus brevior has a partial validity in the MP Mitis Iudex Dominus Iesus, against the new briefer process.

Papst Johannes Paul II. schrieb hinsichtlich der Veröffentlichung des neuen Codex Iuris Canonici, also dem kanonischen Recht, im Jahr 1983:

"Instrumentum, quod Codex est, plane congruit cum natura Ecclesiae, qualis praesertim proponitur per magisterium Concilii Vaticani II in universum spectatum, peculiarique ratione per eius ecclesiologicam doctrinam. Immo, certo quodam modo, novus hic Codex concipi potest veluti magnus nisus transferendi in sermonem canonisticum hanc ipsam doctrinam, ecclesiologiam scilicet conciliarem. [...]."

Das Teaching Document wurde im Rahmen eines Seminares für Anfänger:innen erstellt, die sich erstmals mit kanonistischen Perspektiven und dem kirchlichen Recht (Codex Iuris Canonici von 1983) beschäftigen. Das Paper verfolgt eine allgemeine Hinführung zu wesentlichen Kernbereichen des Kirchenrechtes, insbesondere zum kirchlichen Straf- und Verfahrensrecht (Bücher VI und VII). Da die Geschichte und Entwicklung des weltlichen Rechtes eng mit der Historie des kanonischen Rechtes verbunden ist, wurden die Teilnehmer:innen nicht nur mit der weltlichen, sondern auch mit der kirchlichen Rechtsgeschichte vertraut gemacht.

W czasie, gdy na Tronie Piotrowym zasiadał Papież Paweł IV, został po raz pierwszy opublikowany sławetny Index librorum prohibitorum (dokładnie w 1559 roku), co odbyło się nie bez wpływu Świętej Inkwizycji czuwającej nad czystością Wiary i obyczajów. Podobny zabieg wydawał się tym bardziej konieczny – zwłaszcza by zachowywać od błędów „maluczkich” i „prostych” chrześcijan – z powodu wynalezienia druku przez Gutenberga (1400-1468), co z kolei pozwalało wielu myślicielom na łatwiejsze rozpowszechnianie ich fałszywych i niebezpiecznych dla wiary i Kościoła idei.

Index – zbiór ksiąg zakazanych do czytania przez katolików – został zatwierdzony przez Stolicę Apostolską w 1564 roku. Siedem lat później (1571 rok), za pontyfikatu św. Piusa V, życzenie Soboru Trydenckiego stanowiące o utworzeniu instytucji odpowiedzialnej za badanie wydawanych pism i ksiąg zostało spełnione: do życia powołano Świętą Kongregację Indeksu (Sacra Congregatio Indicis). Jej zadaniem było egzaminowanie wszelkich publikacji celem wpisywania do Indexu tych, które były niebezpieczne dla Wiary i obyczajów. W 1917 roku Kongregacja Indeksu, na mocy motu proprio Alloquentes Proxime Papieża Benedykta XV, została włączona do Świętego Oficjum.

Mimo kontrowersji, które towarzyszyły współczesnym aktualizacjom Indexu (ostatnia za pontyfikatu Papieża Jana XXIII w 1961 roku), nie został on zniesiony w burzliwych czasach soborowych. Stało się to dopiero – rzecz jasna z powodów czysto praktycznych i pastoralnych – w 1966 roku, gdy Biskupem Rzymu był Papież Paweł VI.

Czy jednak Index, z punktu widzenia Prawa Kanonicznego, został rzeczywiście zniesiony lub nawet zakazany? Jeśli tak, to czy jego zniesienie (zakazanie) jest równoważne z usunięciem wszelkiej cenzury kościelnej, jak powszechnie zwykło się uważać? Spróbujmy odpowiedzieć na te pytania opierając się o dane historyczne oraz źródła kanoniczne, a przede wszystkim CIC z 1917 i CIC z 1983 roku.

Sowohl die Welt als auch die Kirche befinden sich aktuell im Umbruch. Nicht nur der weltliche Gesetzgeber war aufgrund der Ereignisse rund um Sars-CoV-2 (COVID-19) seit dem Jahr 2020 gefordert, neue positivrechtliche Normen zu etablieren bzw. bestehende Vorschriften zu novellieren, sondern auch die kirchliche Legislative. In Bezug auf das kanonische Recht der lateinischen Kirche (Codex Iuris Canonici, CIC/1983), konnten unterschiedliche Spannungsverhältnisse in verschiedenen Bereichen beobachtet werden, die gerade in der praktischen Umsetzung zu (pastoralen) Schwierigkeiten und Missverständnissen führten.

Als Exempel hierfür kann, neben Fragen der Religionsfreiheit und der Beziehungen zwischen Staat und Kirche, die Spendung des Bußsakramentes dienen, das einer kirchenrechtlichen Klärung bedurfte. Ist es beispielsweise möglich, vom Fahrzeug aus zu beichten, wenn dadurch die Abstandsregeln gewährleistet werden? Was ist, wenn eine im Sterben liegende Person eine Beichte per Telefon wünscht?

Die vorliegende Handreichung versucht, die Problemfelder, die sich bei der Spendung des kirchlichen Sakramentes der Versöhnung (= Buße) während des pandemischen Geschehens seit dem Jahr 2020 ergaben, hervorzuheben und diskutiert gleichzeitig diese (möglichen) Formen der Spendung des Versöhnungssakramentes. Die Kontemplation umfasst u. a. eine allgemeine Einleitung hinsichtlich der Buße und eignet sich insbesondere für Anfänger:innen, die sich bisher kaum mit kirchenrechtlichen Themenbereichen befasst haben, aber auch für andere Interessierte aus unterschiedlichen Fachbereichen.

Equity and charity: Prescribed aequitas and caritas upon leaving the monastery and in some similar cases. On the relevance of Catholic natural law.-The distinction between "principles" and "laws" helps us to understand the relevance of the natural law principle of aequitas (equity, fairness) and the Christian principle of caritas (charity) as they appear in codified Catholic canon law of the twentieth century. Based on these principles, the Codex Iuris Canonici 1983 contains several provisions that require an ecclesiastical institution to provide benefits in several similar cases of hardship which the institution would not be obliged to provide under strict law.

Regulation of interpretation in CIC 1971 and CIC 1983:
status quo or novum?
The 100th anniversary of the promulgation of CIC 1917 is
the opportunity for reflections about the law in question. Many
scholars pay attention to the similarities and dissimilarities between
CIC 1917 and the CIC 1983. The paper’s aim is to juxtapose
the regulations of interpretation from the two codes of the
Latin Church. First, the paper presents the genesis of the normative
character of the rules of interpretation in the Church. Next, it
offers the explanation of raison d’être of the rules of interpretation
in the context of the rules of legislation. The center of the paper is
the third part, which presents the comparison and analysis of the
norms that regulate the interpretation. The general conclusion,
which is the answer to the research question of the paper, is that
the CIC 1983 in comparison with CIC 1917 maintains the normative status quo, introducing only a small amount of novum.
