Clerical abuse of children

This chapter presents a sociological analysis using the social disorganization theory on the crucial role of the family and married priesthood in the social control of clerical behavior and prevention of clerical deviance. It draws on a wide range of researches to stress the social disorganizing factor of mandatory celibacy to the communal life of the Catholic hierarchy against sexual abuse. It argues that obligatory celibacy with its culture of clericalism deprives secular clergy of direct guardianship against clerical sexual abuse, given the lack of intimacy and social bonding among priests and between priests and their bishops in dioceses and parishes. Living a relatively autonomous life, diocesan clergy finds themselves without direct and indirect social controls offered by marital and family relations and obligation. Social disorganization theory recognizes the crucial role of social bonding and intimate groups in the monitoring and prevention of deviant behavior in loosely-knit communities such as the Catholic hierarchy.

Was ist ein Priester? So einfach die Frage klingt, so schwer ist sie zu beantworten. Es gibt nicht nur verschiedene Arten, das Priestertum auszuüben – an einen Priester werden zudem sehr unterschiedliche Erwartungen gerichtet: Kirchliche Lehre und kirchliches Recht, aber auch Bischöfe, Theologen und Gläubige formulieren Erwartungen, was und wie ein Priester zu sein hat.
Die aktuelle Systemkrise der katholischen Kirche lässt die Spannungen zwischen den unterschiedlichen Priesteridealen deutlich zu Tage treten. Die unvollendete Rezeption des Zweiten Vatikanischen Konzils, der fortschreitende Relevanzverlust der Kirchen in der Gesellschaft und nicht zuletzt Konsequenzen aus den Missbrauchsskandalen konfrontieren Priester mit schwerwiegenden Anfragen. Hinzu kommen Fragen, wie eine solide Ausbildung von Priestern in der Zukunft geleistet werden kann.
Dieses Buch nimmt die Anfragen auf und bearbeitet sie aus unterschiedlichen theologischen Perspektiven. Die internationale Autorengruppe bleibt nicht an der Oberfläche bekannter Streitthemen, sondern wagt den Blick in die Tiefe grundsätzlicher Fragen: Gibt es eine priesterliche Identität? Welche Aussagekraft hat die Praxis in unterschiedlichen Formen und Tätigkeitsfeldern? Welche Konsequenzen sind für die Ausbildung von Priestern zu ziehen?

What is a priest? As simple as the question sounds, it is difficult to answer. Not only are there different ways of exercising priesthood - there are also very different expectations towards a priest: Church doctrine and canon law, but also bishops, theologians and believers formulate expectations of what and how a priest should be.
The current systemic crisis of the Roman Catholic Church clearly reveals the tensions between the different priestly ideals. The unfinished reception of the Second Vatican Council, the progressive loss of relevance of the churches in society and not least the consequences of the abuse scandals confront priests with serious questions. In addition, there are questions about how a solid formation of priests can be provided in the future.
This book takes up these questions and deals with them from different theological perspectives. The international group of authors does not remain on the surface of well-known controversial topics, but ventures to look into the depths of fundamental questions: Is there a priestly identity? What is the significance of practice in different forms and fields of activity? What consequences are to be drawn for the formation of priests?

The study will consider the topic of right to claim social security under effects of canonical penalty primarily in the context of the clerical sex abuse crisis. The contextual approach means, in this study, some legal examples of canon law will be made of applying relevant penal law according to the nature of the delict regarding sexual sins. Similarly, recent canonical legal cases (often reported in media) will be presented in order to make a precise point about the laws in question. In addition, supportive material in the nature of media commentary centred around the abuse crisis will be referenced in evaluation.

The issue of loss of pension as a result of criminal conviction is also a topic studied under social security laws of the nation states as well as under international law. Azinas v Cyprus and Banfield v United Kingdom are two ECtHR cases that deal with the legitimacy of national law’s removal of social security benefits by outcome of criminal conviction. The sources of law related to the topic of right to social security is wide and deep. The analysis of the right to social security will gain practical meaning when the scope of the study becomes defined to a region.

Los protegidos de McCarrick, algunos ahora obispos, corrieron a esconderse, insistiendo en que no sabían nada de sus delitos. Las víctimas fueron inmovilizadas. Hasta el punto que hubo un esfuerzo episcopal estruendoso, dedicado a mantener en secreto un problema supurante. Algunos sacerdotes tomaron la línea de que el celibato se refiere al acto conyugal, no al sexo estéril entre hombres. Un amigo que pasó un tiempo como principiante jesuita durante esa década encorvada me dijo que los maestros novatos consideraban que las relaciones homosexuales eran saludables, incluso necesarias para una formación sacerdotal adecuada. A veces los maestros en noviciado insistían en que ellos eran los agentes de esta "formación". Desde las revelaciones sobre McCarrick, varios hombres más jóvenes han relatado historias espeluznantes sobre sus experiencias en seminarios corruptos, eventos que tuvieron lugar después de 2002 y causaron indignación pública sobre el abuso sexual por clérigos.

The article provides historical context for the continuing problem of military- and Church- based sexual and other abuse and argues that such abuse can be understood in the light of Western theology’s tradition of male bonding within a context of femiphobia, the culturally constructed fear of being feminine or being perceived as feminine.

The history of sexual abuse within the Irish Catholic Church that has come to light in the past decade was primarily a betrayal of victims and their families, of course, but the abuse was so extensive and so closely tied to civil and religious authorities that the betrayal was, in fact, much wider. Even those not directly affected by abuse experienced the social unmooring that resulted from such a profound betrayal of political, spiritual and personal trust. Such a betrayal, of course, creates a need that performance is ideally suited to fill. And in the last few years, there have been a number of performance events that have tried to respond to the crisis in some way. Victim groups have staged rituals of healing or anger, with or without the Church’s participation. And the Church has convened services of repentance and healing, without or (controversially) with the participation of victims. There are few traditional liturgical models for such performances, and thus they are the novel creations of their performers. If this level of betrayal is a serious political issue, so is the attempt to respond to it, even if the performative vocabulary of that response is apolitical, or even sectarian. This chapter looks at four performative responses to this issue. In particular, I will look at the way these performance affect the assertion of Irish national life, which has traditionally had close formal and informal ties to the Catholic Church .
