The paper intends to explore the roots of Polish ‘constitutional crisis’ by utilising the concept... more The paper intends to explore the roots of Polish ‘constitutional crisis’ by utilising the concept of constitutional drift. The paper argues that while Polish 1997 Constitution contains provisions that would enable for interpreting it by using the lenses of Sciulli’s societal constitutionalism (which we call the ‘societal imaginary’), such opportunity was disregarded by more dominant liberal and communitarian imaginaries present in the political and constitutional discourse. The latter contributed to fostering a governance structure that strengthened the executive (the cabinet) at the expense of all social actors whose rights are strongly embedded within the Constitution – social partners (trade unions and employers’ organizations), civil society (NGOs), and professional self-government organizations (associations of professions of public trust). The executive marginalised these actors in law- and policy-making by using the arguments of protection of public interest and requirements of Europeanization – which we show are false and which we define as a case of constitutional drift. Overall, we explore that the processes similar to those happening to the juridical power after 2015 in Poland, had been happening to other competitors to power prior to 2015, and that constitutional crisis should be seen as a relatively late phase of the constitutional drift resulting from overlooking possibilities granted by societal imaginary.

The article deals with the normative patterns of communication of judges in a theore tical perspe... more The article deals with the normative patterns of communication of judges in a theore tical perspective. Their identification is thus taken as a universal problem, occurring in all legal cultures and regardless of current disputes concerning them. It is assumed that normative patterns of communication among judges are built on the under standing of the role of the judge and the place of the judiciary within checks and balances. Based on the assumption that the role of judges and the status of the judiciary have evolved, three successive historical models of judicial communica tion were proposed, i.e. the first model-impersonal, the second-selfrestrained, and the third-accurate communication. The thesis was also put forward that the last of the models may prove to be inadequate in the face of contemporary challenges, resulting primarily from cultural changes driven by the development of new communication technologies.

The purpose of this article is to clarify the nature of legal professions as experts. In particul... more The purpose of this article is to clarify the nature of legal professions as experts. In particular, an attempt has been made to answer the question of what, in the case of these professions, is the social role that requires the application of abstract knowledge to specific cases. The starting point for consideration is social theories that see this role as a mediation and integration of the social structure. Next, using the methodology of cognitive metaphor, this characterization is further clarified by juxtaposing it with another type of expert activity, i.e., translation. Thus, practical problems were identified in the work of a lawyer, related to mediating in the social structure between abstract knowledge of law and solving individual legal problems. These problems were characterized primarily as difficulties in the use of different languages by institutions and citizens.

The paper tries to conceptualize the social and structural change that self-governments underwent... more The paper tries to conceptualize the social and structural change that self-governments underwent during systemic transformation in Poland. First, the situation of professional self-governments before the systemic transformation is discussed, including their liquidation at the onset of communist rule in Poland as well as the beginnings of their revival at the end of it, which was described as the first wave of development of professional self-governments. Both the reasons for liquidation, as well as revival of professional-self-governments are described. After this we discuss the second wave of this development, covering the first years after the fall of communism up to the adoption of the Polish Constitution of 1997, which regulated the status of professional self-government in the “social constitution”. Next we analyse the third wave of development of professional self-governments, which lasted until 2001 and was a portent of the conflict discussed at the end of the article between two ways of understanding what professional self-governments are and what role they should play (one focused on social constitution and other on efficiency). It is argued that from 2001 onwards professional self-governments have been treated more like a tool of effective governance (and very often – as something that hinders this governance) rather than an expression of civic society.

Judges and lawyers have to shape their moral competences in order to maintain their professional ... more Judges and lawyers have to shape their moral competences in order to maintain their professional ethics at a high standard if they want to effectively meet the challenges that modern society will throw at them. This requirement is due to the growing expectation that they will be socially and morally responsible for the law. Thus, the need to place ethics at the heart of legal education, and to make ethical reflection pervasive in academic courses, becomes more obvious every day. Using the concept and examples of moral dilemmas is a way of facilitating this task. The main purpose of this book is to analyse the concept of moral dilemma in context of judicial and legal ethics, and to provide material for legal education. The structure of this book is designed with this double aim in mind.
The theoretical part presents the concept of dilemmas on grounds of metaethics and the perspectives for its application in a professional legal context. The former encompasses situations of conflict of duties or obligations, in which the choice of one conduct necessarily prevents a different conduct, and therefore leads to an unacceptable outcome. Hence, the situation of dilemma always involves an issue of moral responsibility and the problem of “dirty hands”. How such situations are present in legal practice and how to deal with them is the main concern of this part. The considerations are divided into three levels of reflection – deontological, axiological, and moral responsibility.
The practical part of the book contains an overview of 150 dilemmas that can be useful in legal ethics or other legal courses. The dilemmas are divided into chapters covering the following branches of law: criminal law, civil and commercial law, family and custody law, labour and social security law, and constitutional law. Every dilemma presents a description of the facts, a reconstruction of dilemma, its standard solution and some critical remarks from a meta-ethical perspective. The dilemmas cover situations regularly met in everyday practice, as well as examples of more exceptional challenges in connection with constitutional crises that have occurred in Poland in recent years.

The aim of following paper is to reconstruct the discussion concerning reflexive justification on... more The aim of following paper is to reconstruct the discussion concerning reflexive justification on the basis of philosophy and philosophy of law. At first, presented proposition is a project of Immanuel Kant`s philosophy transformation, framed within the philosophy of language and realized by K.-O. Apel and W. Kuhlmann. The analysis concerns both its construct and its relation to the theory of argumentation, using the concept of ideal and unlimited communicative community. Next discussed issue are pleas concerning this approach, formulated by J. Habermas from reconstructive perspective, which rejects the reflexive justification, and instead of conditions of argumentation`s possibility, it examines conditions of possibility of communication as such. The analysis also concerns the R. Alexy`s transcendental-pragmatic argument, which shows similarities both to reconstructive approach of J. Habermas and reflexive justification of K.-O. Apel and W. Kuhlmann. In this paper, there are presented two streams of critique regarding this approach – first concerning justification of general practical discourse`s rules, and second concerning reception of discursive ethics in legal argumentation, therefore most of all, a so-called Sonderfallthese. The critique of R. Alexy`s legal discourse might be interpreted as a theory searching for difficult to accept third way between reflection and reconstruction.

What is usually acknowledged as a topicality indication of Gustav Radbruch’s legal philosophy is ... more What is usually acknowledged as a topicality indication of Gustav Radbruch’s legal philosophy is the theoretical interest in and practical application of his ideas - knownas the Radbruch’s formula - on abominable law, statutory non-law and the refusal to apply it by public authorities, the judiciary in particular. The article’s main argument is that we can point to other than Radbruch’s formula elements in his philosophy of law which are still applicable and present in the recent discussion on the concept of law itself, its validity and application. What this means is basic to Radbruch’s thought the distinction between the concept of law (Rechtsbegriff), the idea of law (Rechtsidee) and the relationship between the two. The solution accepted by Radbruch in this matter is very broadly applied by the representatives of the nonpositivist concept of law. However, the solution may be ascribed a more general meaning, which manifests itself in the “claim to correctness problem” (Anspruch auf Richtigkeit). Such a claim has to be an element not only of law itself but also of all legal statements including acts of applying the law. The point I endeavour to defend is that out of the three interpretations of the claim to correctness problem, the one which refers not only to the correctness of legal order and law application acts, but also to lawyers’ professional obligations and responsibility is the best justified. This is because such a view most fully addresses the challenges of modern law, which has become increasingly professional in character, but on the other hand more prone to factors typical to fully professionalised walks of life - to critical factors especially. The question of how much the interpretation is compatible with Radbruch’s perspective, is beyond the scope of this analysis. However, some arguments suggesting higher degree of concordance will be presented.

W perspektywie socjologicznej są jedną z form instytucjonalizacji praktyk społecznych, a dla nauk politycznych stanowią jeden z podmiotów władzy. W monografii wykorzystano wszystkie trzy spojrzenia. Przedstawiamy m.in. historyczną ewolucję samorządów zawodowych w ramach transformacji, nadanie im rangi ustrojowej w art. 17 Konstytucji RP, ich udział w tworzeniu prawa oraz polityki publiczne podejmowane wobec nich. Zgodnie z przyjętym interdyscyplinarnym podejściem i w oparciu o badania empiryczne ujęto samorządy zawodowe jako podmioty konstytucji społecznej, a ich losy jako przykład jej rozwoju i kryzysu.
