In a digitally networked environment, the balance between freedom of speech and the protection of private life and reputation is necessarily conditioned by the activities (or inactions) of intermediaries that make our online conduct possible. This article examines how United States law imperfectly combines these interests by delegating to private actors the fundamental role of establishing conditions for democratic participation and deliberation. It also examines possible legal reforms in that country hoping to illuminate the situation in other jurisdictions (paper in Spanish)
