The article analyzes the historical process of legal cod-ification during the liberal Triennium. The research examines the circumstances and constitutional condi-tions of elaboration, possible models and parallel texts, and the content of the Penal Code and the in-complete draft of the Civil Code. The article investi-gates the relationship between such codes, recalling the doctrinal proposals and the strategies followed during their elaboration process, as well as undertak-ing a cross-reading of their texts. Comparing the Spanish codes with other texts will make it possible to highlight their uniqueness in a legislative history that was not yet dominated by the Napoleonic Cinq codes.

The article presents a work plan on the legal
journals published in Spain, Portugal and the in
American republics that were once their colonies
(ca.1830-1950). Our aim is, firstly, to recall the
origins of legal historiography on journals.
We focus, secondly, on some conceptual issues

gathered from my own experience, that should
be taken into consideration when studying
these materials. We do then a quick review of
the repertories and inventories consulted in
this embryonic phase of the work. We finally
describe briefly how ambitious the project is.

Since the beginning of the last century, Wigmore has promoted several collections (in English) of works by renowned European jurists in the fields of criminal law, the legal history, the philosophy of law. These pages offer keys to interpreting the collections and developing the strategies adopted in a dynamic of "nationalisation" of foreign texts.

Franco Cipriani’s historical research on the great authors of “scientific proceduralism” (Giuseppe Chiovenda, Francesco Carnelutti, and Piero Calamandrei) made it possible to elaborate a theory of the civil process: “guaranteeism.” The theory holds that the lawsuit is a legal relationship between private parties, and the judicial authority only acts in the trial as an impartial bystander. This is opposite the procedural tradition of the twentieth century that accentuates the legal–public nature of the process and therefore the autonomy and activity of the judge to come to a fair resolution. The wide acceptance of the Italian classic authors on civil procedure in Spain and Latin America explains the impact that Cipriani’s “revisionist” work had in several countries and the tension between guaranteeism and activism in their codified regulation of the trial. From that point of view, this Article analyzes the most recent codes of civil procedure, those of Colombia and Brazil. If historiography has led to theory, it is interesting to find out whether theory leads finally to legislation.

A study of the (incomplete) draft of the Civil Code drawn up by the Cortes in 1821, within the framework of the ideas and texts of the contemporary European codification. It reconstructs the parliamentary life of the text in the Spanish Cortes and the biographies of the deputies who worked on it, in particular Nicolás Mª Garelly. The analysis of three relevant issues addressed by Garelly and his colleagues – namely the theory of legislation, the conditions affecting the legal status of individuals, their civil rights - completes the monograph, which also includes a new edition of the printed booklet (December 1821) that constitutes our sole source of knowledge.

Studies on Spanish legal journals of the 19th and 20th centuries (La Escuela del Derecho, Revista de los Tribunales, Revista General de Legislación y Jurisprudencia, Revista de Ciencias Jurídicas y Sociales) and on issues of legal relevance addressed by the daily press (the crime in Calle de Fuencarral, the celebrity of Cesare Lombroso). There are two theses - one, in fact - that run through the works. The first deals with the dominant model of the lawyer in liberal Spain. The old Ciceronian lawyer was replaced in the 1880s by a 'scientific' jurist; an extraordinary example was Rafael de Ureña and the law review that he created at the University of Madrid. Secondly, it is maintained that before those years and even after, there were no great differences between the so-called "legal reviews" and the "political journals", due to the invasive projection of the same public discourse. The Sevillian lawyer and politician Joaquín Francisco Pacheco, founder of professional magazines but also of newspapers, can embody like no other the archetype of the jurist-public man who, like Cicero, acted in defence of his sponsored but also in favour of the collective cause

A new edition of Rafael de Ureña y Smenjaud's (1852-1930) admission speech to the Real Academia de Ciencias Morales y Políticas (1912). "Una tradición jurídica española" studied the local charters or fueros of the Castilian-Aragonese Extremadura that consecrated the power over the children as a "joint and solidary" power of both the father and the mother; a legal rule in open contrast, according to the speaker, with the "Roman" solution of the criticized Spanish Civil Code. Based on the argument and the sources addressed in the speech, Carlos Petit's study examines Ureña's position in Spanish legal historiography, a speciality constituted as a discipline around his contemporary Eduardo de Hinojosa y Naveros (1852-1919), archivist and medievalist and mentor to some of the founders of the influential Anuario de Historia del Derecho Español (1924). To this end, the study recovers some unpublished documents as well as several memories that illustrate the particulars of the aforementioned journal.
