RESUMO Refletimos os processos de produção de sujeitos perigosos na governamentalidade neoliberal, onde o Estado pauta suas ações no regime de verdade do mercado. Questionamos a lógica do direito penal para pensar em que medida o encarceramento de indivíduos é definido em torno de utilidade ao mercado. A proliferação de rótulos sobre as subjetividades foi analisada paralelamente ao sucesso do neoliberalismo como prática governamental. Concluímos que a subjetividade moderna foi produto de agenciamentos de poder resultantes na categorização do sujeito perigoso. Adotamos como pano de fundo as implicações entre direito e norma que justificam enquadramentos punitivos específicos na contemporaneidade. ABSTRACT We reflect the subject of dangerous production processes in neoliberal governmentality, which the state bases its actions on the regime of truth of the market. We question the logic of criminal law to consider to what extent the incarceration of individuals is set around the market utility. The proliferation of labels on the subjectivities was analyzed in parallel with the success of neoliberalism as a government practice. We conclude that modern subjectivity was assemblages product resulting power in the categorization of dangerous subject. We adopt as a backdrop the implications between law and norm justifying specific punitive frameworks in contemporary.

RESUMO Analisamos a origem do tributo na Modernidade e as razões que o legitimaram no contexto da governamentalidade neoliberal descrita por Foucault. Traçamos um paralelo entre tributação e biopoder sob outro prisma que não o do contratualismo. Soma-se a tal reflexão a associação de Agamben entre exceção soberana e vida nua. Para ele, o núcleo que sustenta a criação de direitos está intrinsecamente relacionado à suspensão de direitos. O controle da vida está por detrás da história do tributo. O objetivo foi discutir o fundamento biopolítico do tributo e seus reflexos no gozo das liberdades públicas e no desenvolvimento social. ABSTRACT We analyze the origin of the tribute in modernity and the reasons that legitimised in the context of the neo-liberal governmentality described by Foucault. Plot a parallel between taxation and biopower under another way than the contractualism. In addition, such considerations the association of Agamben between sovereign exception and life. For him, the core that supports creation of rights is intrinsically related to suspension of rights. The control of one's life is behind the history of tribute. The objective was discuss the merits of the biopolitical tribute and their reflections in the enjoyment of public freedoms and in social development.

RESUMO Defendemos a importância de estudar o tratamento discriminatório do direito penal a partir da análise dos discursos sobre as subjetividades, resultantes na dicotomia cidadão/inimigo. Racionalizações acerca da categoria do inimigo nas chamadas " sociedades do risco " , parecem justificar o exercício desigual do poder punitivo e a neutralização de indivíduos rotulados como nocivos e desviantes, ainda que em detrimento dos princípios, direitos e garantias fundamentais do Estado de Direito. Tais discursos também favorecem o ambiente neoliberal, na medida em que traduzem toda a conflitividade social em punição e legitimam processos estigmatização, criminalização da pobreza e seletividade penal. ABSTRACT We defend the importance of studying the discriminatory treatment of criminal law from the analysis of discourses on the subjectivities, resulting in dichotomy citizen/enemy. Rationalisations about the category of enemy in so-called "law of risk", seem to justify the unequal exercise of power punitive and the neutralization of individuals labelled as harmful and abnormal behavior, even if this is at the expense of principles, fundamental rights and guarantees of the rule of law. Such discourses also favors the neoliberal environment, to the extent that translate the entire conflitividade on punishment and legitimized stigmatization processes, criminalization of poverty and criminal selectivity.

O GOVERNO DA VIDA QUE "NÃO VALE NADA": CAPITAL HUMANO E EXTERMÍNIO NA AMAZÔNIA
Resumo: O presente trabalho visa abordar a problemática do extermínio da juventude popular da região amazônica, analisando a sua relação com a consolidação do neoliberalismo como conjunto de práticas governamentais. Partindo do referencial teórico foucaultiano de capital humano e racismo de Estado e tendo como base a análise de entrevistas realizadas com familiares de vítimas de extermínio da região, buscamos compreender em que medida os dispositivos da racionalidade neoliberal de governar, típica da atual fase do capitalismo contemporâneo, tem contribuído com o processo de legitimação da morte da juventude das camadas populares na Amazônia. Constatamos, no final, que essa razão neoliberal, por meio de seus dispositivos normativos e institucionais, tem possibilitado o extermínio dessa população à medida que apenas considera como sujeito de direitos àqueles indivíduos que se adaptam à regra da consolidação do mercado, devendo os inadaptados à ordem mercadológica enfrentar as diversas formas de violência, dentre as quais, sendo o extermínio o símbolo maior. Abstract: The present work aims to address the problem of the extermination of the popular youth of the Amazon region, analyzing its relation with the consolidation of neoliberalism as a set of governmental practices. Based on the Foucaultian theoretical reference of human capital and state racism and based on the analysis of interviews with relatives of victims of extermination in the region, we sought to understand to what extent the devices of the neoliberal rationality to govern, typical of the current Phase of contemporary capitalism, has contributed to the process of legitimizing the death of the youth of the popular strata in the Amazon. In the end, we find that this neoliberal reason through its normative and institutional mechanisms has allowed the extermination of this population, since it only considers as subject of rights to those individuals who adapt to the rule of market consolidation, Those who are not adapted to the market order, to face the various forms of violence, of which extermination is the greatest symbol. What are our lives worth to a neoliberal government? As Michel Foucault taught us, neoliberalism is an "art of governing". Based on the "regime of truth " of the market, this governmentality normalizes and moralizes subjectivities under the horizon of capital accumulation (economic, social, cultural, symbolic). Neoliberalism has shaped a biopolitical "way of the world" which, through the logic of a radical utilitarianism based on competition, individual responsibility, economic inequalities and the universal empire of value, downgrade the value of human lives in favor of profit opportunities. In the neoliberal order, the value of human life has always been a critical issue; with the COVID-19 pandemics, this issue is even more relevant and needs to be addressed urgently. More recently, neoliberal governments have deployed authoritarian neoconservative political agendas that promote a policy of destruction of the Commons, that is also combined with a policy of death (necropolitics) towards the populations or social groups considered as useless (or surplus) under the neoliberal processes of normalization and moralization. This is the reason why we are witnessing today, in the political field, clashes that radically oppose identities, nationalities, religions, and ways of life. These clashes embody a somehow "global civil war", where violence is felt everywhere and by everyone, and where hegemonic groups intend to neutralize the lives of those who represent obstacles for the implementation of their political agenda. The aim of this scientific colloquium is therefore to put into perspective critical interdisciplinary reflections on the issue of the value of the human being under a neoliberal and bio-necro-political capitalist order. Que valent nos vies pour un gouvernement néolibéral ? Capitalisme, Guerre et Biopolitique dans l'ère pandémique Que valent nos vies pour un gouvernement néolibéral ? Comme nous l'a enseigné Michel Foucault, le néolibéralisme est un « art de gouverner ». Fondé sur le « régime de vérité » du marché, cette gouvernementalité nous incite à normaliser et moraliser nos vies et nos actions pour les consacrer à l'accumulation d'un capital (économique, social, culturel, symbolique). Le néolibéralisme nous a imposé une « raison du monde » biopolitique qui, par les logiques d'un utilitarisme radical fondées sur la compétition, la responsabilité individuelle, les inégalités économiques et l'empire universel de la valeur, n'hésite pas à mettre en balance des vies humaines et des opportunités de profit. Dans l'ordre néolibéral, la question de la valeur de la vie humaine se posait déjà avant la pandémie du Covid-19 ; elle se pose aujourd'hui avec d'autant plus d'acuité. Plus récemment, les gouvernements néolibéraux ont volontiers recouru à des programmes politiques néo-conservateurs autoritaires qui promeuvent une politique de destruction des Communs assortie d'une politique de mort (nécropolitique) eu égard aux populations ou groupes sociaux jugés inutiles ou excédentaires dans le projet néolibéral, normalisateur et moral. C'est pourquoi nous assistons aujourd'hui, dans le champ politique, à des affrontements qui opposent radicalement les identités, les nations, les religions, et les modes de vie. Ces affrontements mettent en scène une véritable « guerre civile mondiale », dont la violence est ressentie partout et par tous, et dans le cadre de laquelle les groupes hégémoniques proposent que soient neutralisées ou éliminées les vies de ceux et celles qui constituent des obstacles pour la mise en oeuvre de leur projet politique. L'objectif de ce colloque scientifique est donc de
