She has conducted research stays in Germany (University of Hamburg, 2010-2011), the United States (University of Georgetown, 2016), and Luxembourg (University of Luxembourg, 2017). Fellow of the national program FPU (2009-2011), she speaks English, German, and Italian. Her doctoral thesis on the legal regime of private takings was awarded a Prize of Honour in the European Group of Public Law Thesis Prize and the Doctoral Extraordinary Prize by the University of Castilla-La Mancha.
Her areas of interests are Administrative Law, European Union Law, Public Economic Law, Human Rights Law and Multilevel constitutionalism.

En un escenario jurídico multinivel que, como el europeo, tiene consagrado al máximo nivel normativo el principio de subsidiariedad, el diseño de un procedimiento que permita a los distintos niveles la representación política participar en el control ex ante de su cumplimiento ostenta la máxima de las relevancias. Por ello, un diseño normativo y una aplicación práctica adecuadas del Sistema de Alerta Temprana para el control de subsidiariedad, introducido en el Derecho primario de la Unión a través del Tratado de Lisboa, pueden propiciar una implicación cada vez más intensa de las regiones en la gobernanza de la Unión, así como el desarrollo del autogobierno y, por ende, de un marco más coherente con los principios de democracia y de autonomía regional.
La investigación analítica recogida en estas páginas pretende servir para evaluar la efectividad práctica del Sistema de Alerta Temprana, así como para identificar posibilidades de mejora en su regulación y aplicación a la luz de sus condicionantes jurídico-políticos. Para ello, en la obra se examinan, en primer lugar, los presupuestos institucionales y constitucionales (tanto europeos como internos) de la participación de las asambleas legislativas autonómicas en el Sistema. Los resultados derivados de este análisis se utilizan, a continuación, para realizar un enjuiciamiento crítico de su regulación positiva y de su aplicación práctica en España durante los siete primeros años de su vigencia (2010-2016).

El ejercicio de la potestad expropiatoria en beneficio de sujetos privados plantea varios problemas jurídicos característicos a los que el Derecho público debe ofrecer una respuesta adecuada. Ello exige reconsiderar ciertos extremos de la configuración normativa de la expropiación forzosa como institución de Derecho público, en la cual el beneficiario ocupa un lugar central en tanto que sujeto que encarna al interés público a que la expropiación, como instrumento, viene a servir. La concepción del beneficiario como sujeto favorecido por la producción de un daño legítimo o autorizado por el ordenamiento, así como la integración sistemática de la potestad expropiatoria en el marco que proporcionan el Derecho constitucional, el Derecho europeo y el Derecho administrativo general y sectorial, permiten ofrecer un modelo dogmático parcialmente renovado de la expropiación forzosa y de la figura subjetiva de su beneficiario. Modelo éste que resulta acorde con las dos funciones principales que al Derecho administrativo corresponde desempeñar: proteger los derechos individuales frente al poder, y procurar la actuación eficaz de la Administración en la tutela y promoción de los intereses generales.

Este estudio aborda la tutela del derecho de propiedad privada frente a intervenciones administrativas en el seno de dos grandes sistemas jurídicos de ámbito europeo: el Derecho de la Unión Europea y el del Convenio Europeo de Derechos Humanos. Para ello, se exponen de modo sistemático las estructuras de protección existentes en ambos sistemas, analizando los requisitos y límites de las figuras de la expropiación y de la delimitación del contenido del derecho, así como el papel de la responsabilidad patrimonial para la construcción de una cláusula de cierre de la garantía patrimonial del ciudadano. Desde el paralelismo estructural entre la tutela del derecho de propiedad en ambos sistemas jurídicos, se examinan, a través de un amplio análisis jurisprudencial, las divergencias y particularidades propias de cada uno de ellos, plasmadas en elementos tales como el margen de apreciación concedido a los Estados o las diferencias en la configuración y aplicación judicial del principio de proporcionalidad.

The COVID-19 pandemic has posed unprecedented legal challenges to the EU institutions and to the EU Member States. On the firstanniversary of the pandemic, the European legal space is immersed in a process of profound reflection and envisaging a redesign of some of its core features, reaching from fundamental principles and values such as the rule of law or solidarity, to sector specific-elements related to the Economic and Monetary Union, health and risk regulation, and State aid control.
This book looks at the EU’s legal response to the pandemic across a wide spectrum of areas of law. La gestión de la escasez es una tarea característica de la Administración, que se enfrenta a la adjudicación de recursos escasos en situaciones de concurrencia en numerosos ámbitos materiales: de la adjudicación de licencias y concesiones para la prestación de servicios de transporte, a la de cuotas de emisión a la atmósfera de gases contaminantes; de la asignación de bienes y derechos patrimoniales, a la concesión de títulos habilitantes para el uso de bienes demaniales; del otorgamiento de ayudas y subvenciones, a la selección de contratistas y funcionarios; de la adjudicación de plazas en centros docentes, en fin, a la gestión de infraestructuras culturales de titularidad pública. La ordenación sectorial de la adjudicación de estos y otros recursos escasos refleja una imagen caracterizada por la diversidad. Al mismo tiempo, sin embargo, el hecho de que la Administración ejerza en todos esos ámbitos una misma función, consistente en adjudicar recursos en situaciones de escasez, tiene como consecuencia que algunos elementos de su régimen jurídico (procedimiento, decisión, tutela) tiendan a converger. Se trata de una nueva confirmación de un viejo principio: el régimen jurídico de las técnicas e instrumentos propios de la actuación administrativa no resulta sólo de su naturaleza jurídica, sino también (y, quizás, principalmente) de la función que el Derecho administrativo les asigna.

It will be shown that despite their different object and the fact that only the two last areas
have been subjected to European harmonization, the three analyzed sectors are crossed by some horizontal or structural common elements regarding the allocation of limited authorizations. The identification and analysis of such structural elements are of interest in terms of general administrative law in so far as they are traceable to abstract elements of a general system of allocation of any limited authorization."

During the first few months of the COVID-19 pandemic, between March and July 2020, Spanish national and regional authorities made extensive use of soft law mechanisms to fight the spread of the virus and to tackle the consequences of the crisis. Soft law was used either as an instrument in and of itself, or as a justification for hard law instruments, more than 200 measures being enacted by the State and by the Autonomous Communities. Extensive use was made of soft law by the Spanish courts as an interpretative tool of existing hard law instruments, many of them related to the protection of the fundamental right to physical integrity. Such uses have relevant consequences from the perspective of the coordination, enforcement, transparency, and judicial review of multi-level administrative action. En el presente estudio se examina el rol desempeñado por la teoría de la relación jurídico-administrativa tanto en el Derecho administrativo vigente como en su tratamiento dogmático, y se mantiene la tesis de que la ciencia del Derecho administrativo español debe incorporar a la parte general de la disciplina una teoría renovada de la relación jurídico-administrativa, como herramienta dirigida a posibilitar un adecuado análisis del ordenamiento administrativo desde la perspectiva de sus sujetos. Se justifica que la renovación de esta parte del sistema de Derecho admi-nistrativo, decantando sus problemas regulatorios típicos de las relaciones jurídico-administrativas y desarrollando una tipología de sus concreciones más características, puede constituir un instru-mento valioso para diseñar, interpretar, aplicar y explicar el Derecho administrativo de manera 1 Trabajo finalizado el 18 de septiembre de 2020. La insolvencia sobrevenida del sujeto obligado al pago de una indemnización expropiatoria plantea problemas jurídicos de envergadura desde el punto de vista del derecho de crédito de los antiguos propietarios. Además, la articulación entre legislación concursal y Derecho administrativo suscita algunas dificultades interpretativas. Este estudio pone de relieve la necesidad de incorporar mecanismos normativos que prevengan el planteamiento de situaciones de este tipo, y analiza sucesivamente tres bloques de cuestiones: cuál es el tratamiento concursal debido al crédito por justiprecio; qué efectos despliega el concurso sobre la situación jurídica en cuya virtud el deudor adquirió la condición de beneficiario; y, por último, cómo puede conjugarse la insolvencia del beneficiario con las exigencias derivadas del artículo 33.3 de la Constitución.

Law, where it has raised a relevant constitutional debate. This study examines the terms in which such
debate has been developed in Germany, France and the United States. The main legal problems posed
by private takings are identified, and the solutions offered to them by the examined legal orders are
stressed. The results of the comparative analysis might be of interest for Spanish legal operators, both
at a positive and at a normative level.

Within the European legal area, the safeguard of the right to property takes place at the interface between international law, EU law and each national legal system. Each of these laws has its own scope of application and level of protection, which partially differs from those of the others, as well as its own supreme jurisdiction which seeks for itself the final word in the field of human rights law. This complex background raises questions concerning the law applicable to interferences in the relevant rights, as well as the terms of the interaction among legal orders and their respective supreme courts, in a context of dialogue and potential conflict that requires consistent articulation in a system in the interest of legal certainty of the right’s holders. This paper provides an overview of the current constitutional system of protection of the right to property in Europe against interferences caused in its sphere by public authorities, both national (and subnational) or European. To that end, this article considers both the legal pluralism perspective along with the need for a systematic scheme of relations between legal orders.

In De Luca v. Italy and Pennino v. Italy (2013), the ECHR examines the compatibility with the right of access to a court (article 6.1 of the Convention) and with the protection of property (article 1.1 of Protocol no. 1) of the italian legislation which prevents applicants from having a final judgment enforced in order to recover money owed to them by an insolvent Administration. This paper analyzes the legal doctrine of the ECHR in those and in other related judgments, putting it in relation with the limits that the Spanish legal order imposes on the enforcement of judgments against public authorities.

The European Union Law recognizes and protects the right to private property. The European Court of Justice distinguishes between two different interventions on the right: the delimitation of its content and the expropriation. Nevertheless, there exist some european measures that, affecting the right to property, can not be qualified as none of the measures mentioned above. This is specially important concerning those european undertakings whose legality can not be controlled by the European Court of Justice. Two possible solutions have been examined: the one coming from French Law (the liability without unlawfullness) and the one derived from German Law (the cuasi-expropiatory measures over property). Here we review the judicial treatment of this question, paying special attention to the FIAMM case (2008), the last one on this topic from the European Court of Justice, that seems to open new alternatives.
