After the fall of the Soviet Union Caucasus found itself in the sphere of interests of large states and superpowers. If the United States and western countries have economical interests, which is stipulated by large reserves of Azerbaijani oil, its transportation to western markets, the idea of creating
transnational transport corridor from Europe to Asia - The Silk Road, and many others, Russia's interest is in neutralizing the given above interests and putting the region into the sphere of its own political and military influence.
In the Caucasus, there are weak central governments and poorly developed civil society. In such conditions Caucasian states have to take care of solving inner-state problems (political, economical, and social); of strengthening
western democratic values in the society; of rebuilding democratic institutions; of balancing interests of other states; of satisfying its own interests by way of satisfying the interests of these states, and, eventually, of reaching stability in these states, which is crucial for stability of the region and will
increase significance of the Caucasus in the world. The countries of the Caucasus encounter many problems on this way. More importantly, we think that Caucasian countries are the children of armed coups of 1992-1999. In such circumstances issues of civilian control over armed forces acquire special urgency.
Creation and development of military forces sufficient in contemporary conditions is crucial for the Caucasian states. And this, in turn, takes a clear definition of the purpose and place of military forces in the society.
From the constitutions of the Caucasian states we can clearly see that the constitutions of these states have been passed after armed coups, and that there is an attempt to exclude the possibility of an armed coup in the future by means of constitution. This is certainly positive, but not sufficient because, first, statutes of the constitutions are to be firmly secured (in particular situations this is not the case), and secondly, these norms ought to be implemented.
Civil-Military Relations and civilian democratic control over the military in the Caucasus have not been properly studied, the issues have not received the attention they deserve. Moreover, the Caucasian states have no experience and traditions of democratic control over military forces.
There is no unique model of civil-military relations and civilian democratic control over the military, as there is no one of democracy. An existing model in one state may work will only in this society, taking into consideration its peculiarities, traditions, social, cultural, political and other factors, but its adoption by another state and society is impossible - and possibly it will become a source of many problems. Civil-military relations and civilian democratic control over military forces are developing, there is no unique model, for it is, like democracy, a process of perfecting.

The construction of a well-functioning and durable national security architecture, which corresponds to modern democratic standards, requires a clearly defined regulatory framework, a strict division of the competencies between the institutions, as well as an effective system of checks and balances.
The new Constitutional model of governance has changed the security architecture: it has increased the competencies of the Cabinet and decreased the presidential powers over the Security Sector. This change requires adequate, effective and systemic legislative changes that will guarantee efficient mechanisms of coordination, collaboration and interaction
among Security Sector institutions.
This report provides a comprehensive review of the institutional, functional and legal aspects of the Georgian security sector, the mechanisms for parliamentary and civic oversight and engagement of the non-governmental sector in the security sector reform. It is mainly focused on the state agencies working within the national security sector, namely:
the Ministry of Defense, the Ministry of Internal Affairs, and intelligence agencies. The report also analyzes the inter-agency mechanisms for security policy planning and coordination.

საქართველო-ევროკავშირის ასოცირების დღის წესრიგით, უახლოესი სამი წლის განმავლობაში, პრიორიტეტულია დეცენტრალიზაციის სტრატეგიის განხორციელება „ადგილობრივი თვითმმართველობის შესახებ ქარტიის“ შესაბამისად, აგრეთვ ადგილობრივი თვითმმართველობის გაძლიერება ევროპული სტანდარტების შესაბამისად. ეს არის
გამოწვევა, რომლის წარმატებით განხორციელება განაპირობებს როგორც რეალური თვითმმართველობის სისტემის შექმნას და გადაწყვეტილებათა მიღების პროცესში დემოკრატიული ჩართულობის გაზრდას, ასევე საქართველოს ევროკავშირთან
ინტერგრაციას და დემოკრატიულ სახელმწიფოთა ოჯახში ღირსეულ პარტნიორად დამკვიდრებას.

სტატიაში განხილულია საქართველოს პარლამენტის მიერ ფორსირებული წესით მიღებული საკანონმდებლო ცვლილებების პაკეტი, რომელიც ითვალისწინებს საბანკო ზედამხედველობისა და საქართველოს ეროვნული ბანკის, როგორც 'ბანკთა ბანკის" და საფინანსო სექტორის სტაბილურობის ხელშეწყობაზე პასუხისმგებელი კონსტიტუციური ინსტიტუტის არსებითად შეცვლილი, პოლიტიკური გავლენისაგან ნაკლებად დამოუკიდებელი სისტემის შექმნას, და ამ პაკეტის შეუსაბამობა საქართველოს კონსტიტუციასთან.

დემოკრატიული სტანდარტების შესაბამის, ეფექტურად მოქმედ და ანგარიშვალდებულ ეროვნული უსაფრთხოების უზრუნველყოფის სისტემას განსაკუთრებული მნიშვნელობა აქვს სახელმწიფო მმართველობისთვის. ეს უზრუნველყოფს საზოგადოების დაცვას სხვადასხვა საფრთხისგან, მის სტაბილურ და მშვიდობიან განვითარებას.
უსაფრთხოების უზრუნველყოფის სისტემის ინსტიტუტები თავისი ბუნებით კონფლიქტშია ინდივიდისა და ღია საზოგადოების თავისუფლებებთან. ეს სისტემა თავისი არსით ეწინააღმდეგება გარე კონტროლის, ზედამხედველობისა და ანგარიშვალდებულების პრინციპებს. ამიტომ, ეროვნული უსაფრთხოების დემოკრატიულ მართვაში გადამწყვეტია პარლამენტის, როგორც ხალხის ინტერესებისთვის მოქმედი უმაღლესი პოლიტიკური ორგანოს, როლი.
ეფექტური საპარლამენტო ზედამხედველობა ზრდის ეროვნული უსაფრთხოების უზრუნველყოფის ინსტიტუტების ანგარიშვალდებულების ხარისხს და საზოგადოებას აზღვევს თვითნებური, არასათანადო თუ რეპრესიული მმართველობისაგან.
ეროვნული უსაფრთხოების უზრუნველყოფის სისტემის რეფორმა და მისი ინსტიტუტების დემოკრატიული სტანდარტებით ფუნქციონირებად მექანიზმებად ტრანსფორმაცია გარდამავალი დემოკრატიის ქვეყნებში მიმდინარე რთული პროცესია, რომელიც დიდ ძალისხმევასა და საზოგადოების ჩართულობას მოითხოვს.
ეროვნული უსაფრთხოების უზრუნველყოფის სისტემის რეფორმის წარმატებას განაპირობებს სრულყოფილი საკანონმდებლო ბაზის არსებობა-განვითარება. უსაფრთხოების უზრუნველყოფის ინსტიტუტები და მათი მოქმედება მხოლოდ მაშინ არის ლეგიტიმური, როდესაც მათი ძალაუფლება არ სცდება კანონით განსაზღვრულო მანდატს. საკანონმდებლო საფუძვლების ბუნდოვანება ან წინააღმდეგობრიობა ზრდის ეროვნული უსაფრთხოების უზრუნველყოფის ინსტიტუტების კანონის ჩარჩოდან გასვლისა და არალეგიტიმური საქმიანობის რისკებს.
სტატიაში მოცემულია საქართველოს ეროვნული უსაფრთხოების უზრუნველყოფის სისტემის სამართლებრივი საფუძვლების ანალიზი, გამოკვეთილია აქტუალური საკითხები და პრობლემები. საქართველოს ეროვნული უსაფრთხოების სისტემის სამართლებრივი საფუძვლები წინააღმდეგობრივია. საქართველოს ეროვნული უსაფრთხოების უზრუნველყოფის წამყვანი ინსტიტუტების უფლებამოსილება, რიგ შემთხვევაში, არ არის კანონით მკაფიოდ განსაზღვრული და მანდატი გაფართოებულია მთავრობის გადაწყვეტილებით, პარლამენტის მონაწილეობის გარეშე. ანალიზისას გამოვლენილი პრობლემების გადაწყვეტა შესაძლებელია უსაფრთხოების სისტემის ინსტიტუტების უფლებამოსილებისა და ანგარიშვალდებულების ახალი საკანონმდებლო ჩარჩოს შექმნით.
სტატიაში გადმოცემულ აქტუალურ საკითხებზე მსჯელობა საპარლამენტო თუ აკადემიურ ფორმატში, წვლილს შეიტანს ეროვნული უსაფრთხოების მდგრადი და დემოკრატიული სტანდარტების შესაბამისად მოქმედი სისტემის დამკვიდრებაში.

Effective and accountable national security assurance system, which corresponds to the democratic standards, has crucial significance for state governance. It ensures protection of society from different threats, peaceful and stable development.
The institutions of security assurance system by their origin are in conflict with individual  liberties and open society. This system by its essence contradicts to the principles of external control, oversight and accountability.  Therefore, the role of parliamet as a high political organ  serving to the interests of people, is crucial.
Effective parliamentary oversight enhances a quality of accountability of security assurance institutions and insure society from willful, improper and repressive governance.
In transitional democracies reforms of security assurance system and transformation its institutions to the decmoctratic standards, requires huge efforts of states and public inclusiveness.
Reform of security assurance system seems unsuccessfull without proper and consecutive legal framework. Security assurance institutions and their activities are legitimate when thier power does not exceed a mandate defined by the law. Contradictions and obscurity enhances the risks of illegitimate activities of national security assurance institutions.
In the article is provided an analysis of legal basis of national security assurance system of Georgia, actual issues and problems. The legal basis of national security assurance system of Georgia is contradictive. In some cases the competences of leading institutions of national security assurance of Georgia, are not clearly defined by the law and mandate is enhanced by the decision of government, without parliamentary engagement. Solution of identified problems is possible by creation of new legislative framework of competences and accountability of national security assurance institutions.
Academic or parliamentary discussion of actual issues of this article will benefit to creation of sustainable and democratic system of national security.

ადგილობრივ თვითმმართველობას ორი მეცნიერული გაგება აქვს. ერთის მხრივ ადგილობრივი თვითმმართველობა ეს არის უფლება რომლის რეალიზებით ადამიანს ეძლევა საშუალება მონაწილეობა მიიღოს საჯარო მმართველობაში, ხოლო მეორეს მხრივ ეს არის საჯარო მმართველობის ინსტიტუციური მოწესრიგების ფორმა. ადგილობრივი თვითმმართველობის ინსტიტუციური მოწესრიგება და თვითმმართველობის განვითარება სახელმწიფოს კონსტიტუციური ვალდებულებაა. სახელმწიფო ადგილობრივი თვითმმართველობის ინსტიტუციური მოწესრიგებით და გარანტიების შექმნით უზრუნველყოფს ადგილობრივი თვითმმართველობის უფლების დაცვასა და განვითარებას.
ინსტიტუციურად ადგილობრივი თვითმმართველობა გამოიხატება მუნიციპალიტეტების ფორმით, თვითმმართველი ქალაქის თუ თვითმმართველი თემის სახით. ადგილობრივი თვითმმართველობის უფლების რეალიზაცია მუნიციპალიტეტის არსებობით არის განპირობებული. არსებობს მუნიციპალიტეტი მისი კომპეტენციით, ორგანოებითა და რესურსებით? - არსებობს ადგილობრივი თვითმმართველობის უფლების გარანტია და განხორციელების საშუალება; არ არსებობს მუნიციპალიტეტი? - არ არსებობს არც უფლება და არც მისი განხორციელების საშუალება. სწორედ ამ კონტექსტში, კონსტიტუციურ და უფლებრივ ჭრილში განვიხილავთ საქართველოში ადგილობრივი თვითმმართველობის უფლების განვითარებას.
ადგილობრივი თვითმმართველობის გაძლიერება, დეცენტრალიზაცია და ძალაუფლების დეკონცენტრაცია სახელმწიფოს დემოკრატიული, სტაბილური და მშვიადობიანი განვითარების წინაპირობაა. ადგილობრივი თვითმმართველობის დამოუკიდებლობის უზრუნველყოფა არის სახელმწიფოს ერთ-ერთი მთავარი ამოცანა.
ადგილობრივი თვითმმართველობის განვითარება და მისი დამოუკიდებლობის უზრუნველყოფის გარეშე შეუძლებელია თანამედროვე სტანდარტების შესაბამისი, ეფექტურად ფუნქციონირებადი სახელმწიფო მართვის სისტემის ჩამოყალიბება. თვითმმართველობის განვითარებას სუბსიდიარობის პრინციპი უდევს საფუძვლად, რომლის შესაბამისადაც ძალაუფლება ხალხთან ყველაზე ახლოს არსებულ დონეზე ხორციელდება.
მნიშვნელოვანია დეცენტრალიზაციისა და თვითმმართველობის რეფორმის პროცესისა და მიღებული გადაწყვეტილებების სამართლებრივი ანალიზი, პირველ რიგში კონსტიტუციურობის თვალსაზრისით. ამ საკითხებზე დისკუსია ერთის მხრივ ხელს შეუწყობს თვითმმართველობის განვითარებას, ხოლო მეორეს მხრივ დაგვაზღვევს გადაწყვეტილების მიღების პროცესში ანალოგიური შეცდომების გამეორებისაგან.
საქართველლოს ხელისუფლების მიერ 2013 წელს დაწყებული რეფორმის გაგრძელებას განსაკუთრებული მნიშვნელობა აქვს საქართველოში ინსტიტუციური დემოკრატიის დამკვიდრებისათვის. მოსახლეობასთან ყველაზე ახლოს მდგომი ინსტიტუტების განვითარება და ურბანიზაცია არის თანამედროვე დემოკრატიის განვითარების მიმართულება.
ინსტიტუციური დემოკრატიის განვითარება წარმოუდგენელია კანონმდებლობით დადგენილი ჩარჩოს და პირობების დარღვევით. ასეთ შემთხვევაში, ხელისუფლება კარგავს ლეგიტიმაციას, რაც აზიანებს დემოკრატიის ხარისხს.
საქართველოს ხელისუფლების მიერ 2014 წელს მიღებული გადაწყვეტილება 2014 წელს შექმნილი 7 თვითმმართველი ქალაქისთვის თვითმმართველის სტატუსის გაუქმების შესახებ იყო ადგილობრივი თვითმმართველობის უფლებაში/გარანტიაში დაუსაბუთებელი და კონსტიტუციის საწინააღმდეგო ჩარევა. ამასთან, გადაწყვეტილების მიღების პროცესში სრულად იყო გამორიცხული ადგილობრივი მოსახლეობის ჩართულობა, რაც ასევე კონსტიტუციით დადგენილი ვალდებულებაა.
საქართველოს პარლამენტმა, როგორც მთავრობის საქმიანობაზე და კანონმდებლობით დადგენილი მოთხოვნების დაცვაზე ზედამხედველმა ორგანომ ვერ უზრუნველყო კონსტიტუციით მინიჭებული კონტროლის ფუნქციის შესრულება.
სტატიაში გაერთიანებული სახით თავმოყრილია სხვადასხვა დროს თვითმმართველობის რეფორმასთან და გადაწყვეტილებების კონსტიტუციურობასთან დაკავშირებულ საკითხებზე წარდგენილი მოსაზრებები.

Democratic governance is based on the accountability of the government to the parliament. Oversight of the government activities by the representative body that has absolute legitimation of population ensures democratic environment for decision-making and efficient accountability of the Government.  An effective system of accountability of the government to the parliament ensures the accountability of the government to its population.
