【発明の属する技術分野】
本発明は、著作物の管理を行うことができる著作物管理装置に関する。
【０００２】
【従来の技術】
近年、インターネット等のネットワークを介して、テレビ番組やビデオ、音楽、または、コンピュータプログラム等の著作物をユーザの端末に配信する著作物配信装置が開発されている。このような著作物配信装置は、複数種類の著作物を記憶しておく記憶手段を有し、ユーザの要求に応じて特定の著作物をユーザの端末に配信するように構成されている。また、著作物配信装置は課金システムを備えており、配信する著作物の内容や、情報量、配信時期に応じた金額がユーザに請求されることになる。
このような著作物配信システムは、同一の著作物を複数のユーザに対して配信するためのものであって、例えば、テレビ番組の配信サービスの場合は、複数のユーザが、同時に、または、所定の時間差をもって、同一のテレビ番組を各ユーザの端末で鑑賞することが可能となる。また、ユーザの端末の記録装置にテレビ番組を記憶させた場合は、ユーザの好きな時間にそのテレビ番組を鑑賞することが可能となる。

【発明が解決しようとする課題】
しかしながら、このような著作物管理装置は、各ユーザが購入した著作物を差別化することを考慮していないため、ユーザ間の著作物の交換や、ユーザの所有する著作物の認証を可能とするような構成を有しておらず、いわゆるトレーディングカードといった収集性や交換性を特徴とする著作物や、リトグラフのように製作枚数の管理や真贋の確認が必要な著作物の管理には不向きであった。
従って、本発明の解決する課題は、著作物の収集性や交換性を担保することで、著作物の流通を促進することができる著作物管理装置を提供することである。

【課題を解決するための手段】
前記の課題を解決するために本発明の請求項１に係る発明は、著作物を閲覧するユーザが使用するユーザ端末装置と接続可能な著作物を管理する著作物管理装置であって、前記著作物を蓄積する著作物データベースと、前記著作物を購入したユーザであるオーナーを識別するオーナー識別情報を記憶した取引結果データベースと、を備える記憶手段と、前記ユーザ端末装置に対して、相互に関連付けられた前記著作物、著作物識別番号及び前記オーナー識別情報を含む送信用ファイルを送信する著作物管理手段と、前記ユーザ端末装置から、前記ユーザによって前記ユーザ端末装置に対して入力されたオーナー識別情報と前記送信された送信用ファイルに含まれるオーナー識別情報及び著作物識別番号を伴うオーナー認証要求を受信し、前記受信した送信用ファイルに含まれる前記著作物識別番号に基づいて前記取引結果データベースを検索し、対応するオーナー識別情報を取得し、前記入力されたオーナー識別情報、前記送信された送信用ファイルに含まれるオーナー識別情報、及び、前記取得したオーナー識別情報の三者を比較し、前記三者が一致しない場合は、前記ユーザ端末装置に対して、オーナー認証に失敗した旨の信号を送信する認証手段と、を有することを特徴とする著作物管理装置とした。

このように構成した著作物管理装置は、著作物とオーナーの情報および著作物認識番号を一つのファイルとして取り扱うことにより、著作物の特定や、著作物のオーナーの確認を行うことができる。特に、個々の著作物に付与された著作物認識番号は、著作物の収集家に収集活動の進捗状況の目安となったり、管理者が著作物の管理を容易にすることができる。また、オーナー識別情報により、著作物のオーナーの正当性を容易に判別できるので、著作物の取引の公正さを担保することが可能となる。なお、照合とは、著作物の特定や、ユーザが登録されたユーザであるか否かを判断する処理をいうものとする。
認証手段は、ユーザ情報および二箇所から取得したオーナー情報を比較するので、著作物のオーナーを確実に特定することができるので、著作物の所属の確認作業における信頼性を担保することができる。

また、本発明の請求項２に係る発明は、請求項１に記載の著作物管理装置において、著作物管理手段は、送信用ファイルの作成時に、著作物認識番号を増加または減少させる編集手段を備え、編集手段は、増加または減少させた後の著作物認識番号を記憶手段に登録するように構成した。

著作物は、編集手段により、常に唯一の著作物認識番号を有することになるので著作物の特定を容易に行うことが可能となる。従って、オーナーの認証作業や、著作物の加工データの登録、および、オーナーの書き換え作業を行う際の作業効率を向上させることができる。

そして、本発明の請求項３に係る発明は、請求項１又は請求項２のいずれか一項に記載の著作物管理装置において、ユーザが加工または作成した著作物を登録する登録手段を有し、登録手段は、加工または作成した著作物およびその著作物認識番号を記憶手段に記憶させるように構成した。

このように構成した著作物管理装置を用いると、ユーザが、購入した著作物に軽微な加工をしたり、カードをユーザが作成することが可能となるので、著作物の収集活動に創作的な要素を付加することができる。また、加工、作成した著作物の登録を可能にすることで、ユーザが加工、作成した著作物であっても安心して交換等の流通を行うことが可能となる。

また、本発明の請求項４に係る発明は、請求項１乃至請求項３のいずれか一項に記載の著作物管理装置において、前記認証手段は、著作物のオーナーが変更される場合は、当該著作物の著作物識別番号と変更後のオーナーのオーナー識別情報とを関連付けて、前記取引結果データベースに記憶し、変更前のオーナーのユーザ端末装置に対して、当該著作物識別番号及び変更後のオーナーのオーナー識別情報を含む訂正ファイルを送信し、変更後のオーナーのユーザ端末装置に対して、相互に関連付けられた前記著作物、前記著作物識別番号及び前記オーナー識別情報を含む送信用ファイルを送信することを特徴とする著作物管理装置とした。

【発明の実施の形態】
本発明の実施の形態を図面を参考にして詳細に説明する。
図１は本実施の形態における著作物管理システムの構成図である。
著作物管理装置は、記憶手段２に記録された著作物を、ユーザの要望に応じてネットワーク３を通じてユーザ端末４に送信したり、オーナーの認証等の管理を行うものであり、本実施の形態においてはネットワーク３に接続可能なサーバから構成されている。

ここで、本実施の形態における著作物について図２（ａ）、（ｂ）を用いて説明する。
図２（ａ）に示すように、著作物は、画面上に表示されるカード５ａであり、中央部に配置されたコミックの主人公等の画像６と、画像６の回りを縁取るフレーム７ａと、フレームに埋め込まれた著作物識別番号であるカードＩＤ８ａと、各種ボタン９ａ，９ｂ，９ｃから構成されている。さらに、カードＩＤ８ａは、カード５ａの種類ごとに設定された識別番号１５ａと、種類ごとのカード５ａの通し番号であるシリアル番号１１ａとから構成されている。
なお、カード５ａの形態は図２（ａ）に限定されることなく任意の形態を取ることが可能であり、画像６は、コミックの主人公の他に、小説の挿絵等の絵や、人物等の写真とすることができる。
また、このカード５ａは、図２（ｂ）に示すようなコンテンツファイル１０として取り扱われる。コンテンツファイル１０は、画面上に表示されるカード５ａを主体とするカードデータ５ｂと、カード５ａの種類ごとに設定される通し番号であるシリアル番号１１ａを示すシリアル番号データ１１ｂ、カード５ａの購入者であるオーナーを特定するためのオーナ識別情報を構成するオーナーデータ１２、ならびに、カード５ａの表示の制御や後に説明するカード５ａの認証作業を行うためのシステムプログラム１３とからなる。なお、シリアル番号データ１１ｂおよびオーナーデータ１２はカード５ａのダウンロードが要求された段階でカードデータ５ｂに追加され、送信用ファイルであるコンテンツファイル１０を形成する。

次に、コンテンツファイル１０の各構成要素について、カードデータ５ｂから順番に説明する。
図２（ｂ）に示すように、カードデータ５ｂは、著作物のデータである著作物データ１４と、著作物を表示する際のフレーム７ａを構成するフレームデータ７ｂ、ならびに、カード５ａの種類を特定するための識別データ１５ｂとから構成されている。

著作物データ１４は、コミックの主人公、小説の挿絵等の絵や、人物等の写真からなる画像データ（例えば、ＪＰＥＧ形式、ＭＰＥＧ形式）を基本とし、この画像データにコミック等のあらすじや、解説、作者等のコメントからなる文字データ（テキスト形式等）や、コミックの主人公や作者等の声、ナレーション、効果音等の音データ（ＷＡＶＥ形式やＭＰ３形式等）を付加することもできる。
著作物データ１４は、画像データのみで構成することも可能であるが、文字データと音声データのみで構成しても良い。また、画像データは、動画データを含んでも良い。さらに、著作物データ１４には、著作物に対する著作権を表示するデータを含むことが出来る。

フレームデータ７ｂは、あらかじめ決められたパターンからなる画像データである。フレームデータ７ｂにより表示されるフレーム７ａは、図２（ａ）に示すように、右上にカード５ａの識別番号１５ａおよびシリアル番号１１ａからなるカードＩＤ８ａが表示され、フレーム７ａの左下にはカード５ａの情報を表示するためのカード情報ボタン９ａが配置される。また、著作物データ１４に音声データや動画データが含まれている場合は、再生ボタン９ｂや停止ボタン９ｃも表示される。なお、カード５ａの種類により図２（ａ）には図示しない異なる機能を付加しても良い。

次に、図２（ｂ）に示すシリアル番号データ１１ｂについて説明する。
シリアル番号データ１１ｂは、カード５ａの表示時に、フレーム７ａの右上に表示されるシリアル番号１１ａを与えるデータであり、シリアル番号１１ａは、ユーザがカード５ａを購入する際に、著作物管理装置１において設定される通し番号である。このシリアル番号１１ａと前記の識別番号１５ａによりカード５ａを特定することができる。

また、オーナーデータ１２について説明する。
オーナーデータ１２は、ユーザがあらかじめ著作物管理装置１に登録したユーザＩＤを、カード５ａの購入時に、そのカード５ａのオーナーとして記録したものであり、オーナーデータ１２を参照することによりカード５ａのオーナーを特定することができる。オーナーデータ１２は、図２（ａ）に示すカード５ａには図示されていないが、カード情報ボタン９ａをクリックすることで表示させることができる。なお、オーナーデータ１２には、オーナーが登録している氏名を付加しても良く、これらをフレーム７ａや画像６に埋め込んで表示することも可能である。

さらに、システムプログラム１３について説明する。
システムプログラム１３は、カード５ａの表示の制御や、カード５ａやオーナーの認証等を行うためのプログラムから構成される。カード５ａの表示の制御とは、例えば、ユーザ端末４上でのカード５ａの表示位置をユーザ端末４の設定ファイルに書き込んだり、再生ボタン９ｂがクリックされた際に、音声データをユーザ端末４にインストールされているプレーヤで再生する等の処理を行うことがあげられる。また、カード５ａやオーナーの認証とは、これらの表示のみならず、著作物管理装置１に対してカードＩＤ８ａやオーナーの認証を要求する機能も含まれる。

なお、コンテンツファイル１０には、この他にも、後に説明するユーザによるカード５ａの加工において、カード５ａに加えられた加工に関するデータや、ユーザが加工したカード（ユーザ加工カード）のカードＩＤなどのデータが付加される場合もある。

次に、このようなコンテンツファイル１０の管理を集中して行う著作物管理装置１の各構成要素について説明する。
図１に示すように著作物管理装置１は、記憶手段２と、ネットワーク３に接続するための通信手段２０と、著作物管理装置１の各処理を制御する制御部２１とを有している。また、著作物管理装置１は、キーボード、マウス等の入力手段２２と、ディスプレイ等の表示手段２３、管理記録等を出力するための出力手段２４を備えることもできる。

さらに、著作物管理装置１にＣＤ（Compact Disk）、ＤＶＤ（Digital Video Disk）等の外部記録装置を設けたり、ＬＡＮ（Local Area Network）接続して、所定のクライアント端末に接続できる構成しても良い。
ここで、所定のクライアント端末としては、ネットワーク３を介して接続可能な出版社の端末３５およびソフトハウスの端末３６があげられる。このようにすると、これらの端末３５，３６から著作物管理装置１にアクセスして、新しいカードデータ５ｂをＦＴＰ（File Transfer Protocol）でアップロードしたり、各カード５ａの売れ行きを確認したりすることが可能となる。また、新しいカードデータ５ｂのアップロードに伴い、ユーザにカード５ａの更新の告知を行ったり、著作物管理装置１にアクセスすることで各カード５ａの売れ行き、つまり、ダウンロード数、ならびに、購買層に関するデータを取得することもできる。

以下、著作物管理装置１の各構成要素について説明する。
記憶手段２は、ＨＤＤ（Hard Disk Drive）等から構成され、カードデータ５ｂおよびシリアル番号データ１１ｂを蓄積する著作物データベースであるコンテンツＤＢ（Data Base）２５と、著作物管理システム１に登録したユーザのデータを蓄積するユーザ情報ＤＢ２６、ならびに、各カード５ａの売れ行きや、カード５ａを購入したユーザに関する情報が蓄積される取引結果ＤＢ２７とを有している。なお、図示しないが、所定のプログラム等やコンテンツファイル１０を構成するためのシステムプログラム１３もこの記憶手段２に記憶されている。

制御部２１は、ＣＰＵ（Central Processing Unit）、メモリ等から構成されており、ここに所定のプログラムが展開されることで各種の処理が可能となる。図１に示すように、この制御部２１は、コンテンツファイル１０の作成および管理を行うコンテンツ管理手段３１と、カード５ａの特定や、ユーザが登録されたユーザと一致するか否かの判断を行う照合手段３２と、ユーザがカード５ａのオーナーであることを確認するための認証手段３３、ユーザの登録や、オーナーが加工したカードやカードトレーディング時のオーナーＩＤの書き換え等を行う登録手段３４を構成する。

ここで、コンテンツ管理手段３１について説明する。なお、制御部２１の他の手段３２〜３４については、カード５ａのダウンロードや認証の各手順説明において順次説明する。
コンテンツ管理手段３１は、ユーザのダウンロード要求に対して所定のカードデータ５ｂに、シリアル番号データ１１ｂ、オーナーデータ１２、システムプログラム１３を付加して送信用のコンテンツファイル１０を作成するものである。
コンテンツ管理手段３１は、ユーザのダウンロード要求時に、シリアル番号１１ａを一つインクリメントして新しいシリアル番号１１ａを作成する編集手段としても機能する。編集手段は、新しいシリアル番号１１ａをユーザがダウンロードするコンテンツファイル１０に添付すると共に、新しいシリアル番号１１ａをコンテンツＤＢ２５に登録するので、このシリアル番号１１ａ（および必要に応じて識別番号１５ａ）によりカード５ａを特定することが可能になる。
さらに、コンテンツ管理手段３１は、ユーザがブラウザ上でカード５ａを鑑賞するためのＨＴＭＬ（Hyper Text Markup Language）ファイルの作成も行う。

次に、この著作物管理装置１からユーザに提供されるサービスについて図３を用いて説明する。
図３に模式的に示すように、著作物管理装置１が提供するウエブのサイト上には、ユーザがカード５ａを鑑賞したり、ダウンロードするカード鑑賞４１と、ユーザや、サイトの管理者が情報を提示するコミュニケーション４２と、カード５ａを購入したオーナーがカード５ａの交換や売却を行うためのカードトレーディング４３およびカードオークション４４、ユーザ情報を入力するためのユーザ情報入力４５と、ユーザがダウンロードしたカード５ａを自己の端末で管理するためのアプリケーション（ＡＰ）をダウンロードするための支援ＡＰダウンロード４６の各サービスが用意されている。

カード鑑賞４１は、カード５ａをジャンル４１ａ、４１ｂ、４１ｃ・・ごとに表示することで、ユーザがカード５ａを鑑賞し易くする構成となっており、ここから、所望のカード５ａのダウンロード４７や、カード５ａのオーナーを特定するためのオーナー認証４８や、オーナーが加工したオーナー加工カードの登録４９を行うことができる。
コミュニケーション４２は、ユーザどうしのチャットやＢＢＳ（Bulletin Board System）、また、サイトの管理者がユーザに対して発信する情報を提示する告知等から構成されている。なお、チャットやＢＢＳの利用は、登録したユーザのみに限定しても良い。
カードトレーディング４３とカードオークション４４は、ユーザが所有する特定のカード５ａを、他のユーザが所有するカード５ａと交換したり、売却するためのものである。カードトレーディング４３の場合は、ユーザが所有するカード５ａと、そのカード５ａと交換したいカード５ａをカードトレーディング４３に登録する。そして、交換に応じるユーザが現れたら、著作権管理装置１を介してカード５ａの交換を行う。また、カードオークション４４の場合は、オークションにかけたいカード５ａが登録されると、そのカード５ａを欲しいユーザが希望落札価格を登録し、所定の期間内に最高の条件を提示したユーザに、オークションにかけられたカード５ａが落札される。

ユーザ情報入力４５は、このサイトの利用者がユーザの個人情報を登録するものである。各種サービスを利用するためのユーザＩＤを取得したり、パスワードを設定することができる。なお、ここで設定したユーザＩＤおよびパスワードが特許請求の範囲に記載のユーザ識別情報を構成する。また、ユーザ情報が変更になった場合も、このユーザ情報入力４５で登録データの更新を行う。なお、ユーザ登録の際にマーケティングの一環としてアンケートを付加しても良い。
支援ＡＰダウンロード４６は、ユーザ端末４においてダウンロードしたカード５ａの管理を支援するために、カード５ａのアルバムとなる所定のアプリケーションをダウンロードしたり、ダウンロードしたカード５ａに対する加工を可能にする加工ツールをダウンロードするためのものである。なお、このサービスの利用には、前記のユーザ登録が必要である。

ここで、アルバムは、ユーザの端末上で起動するアプリケーションで、ユーザがダウンロードしたカード５ａを識別番号１５ａごとや、入手時期ごと等に配置させるためのものである。アルバムは、各シートに複数のカード５ａをフルサイズで配置したり、サムネイル形式で配置できるようにしたり、特定のカード５ａを検索できるようにプログラムされているので、ユーザはこのアルバムを使用することで多数のカード５ａの保管を簡単に行うことができる。

加工ツールは、ユーザが所有するカード５ａの画像６の一部の色彩をユーザの好みに合わせて変更したり、フレーム７ａのパターンを変更するためのもので、この加工ツールを使用することでユーザのオリジナルカードを作成することが可能となる。ただし、画像データそのものを変更することはできない。また、この加工ツールはそれ自体を一つのアプリケーションとすることもできるが、アルバムの一機能とすることもでき、さらに、コンテンツファイル１０のシステムプログラム１３に加工用のモジュールを付加することもできる。なお、専用の加工ツールを使用しなくてもカード５ａの加工が行えるように構成しても良い。

さらに、ユーザ端末４について説明する。
ユーザ端末４は、ＣＰＵ等からなる処理部５０と、モデム等からなる通信手段５１と、受信したコンテンツファイル１０を記憶する記憶手段５２を備えている。また、購入したカード５ａを表示するための表示部５３や、プリンタ等の出力部５４、ならびにキーボード等の操作部５５を備えることも可能である。購入したカード５ａは、記憶手段５２に作成された著作物記憶手段である購入コンテンツＤＢ５６に収容され、ユーザの要求に応じて随時、表示部５３に表示されたり、出力部５４から出力される。また、常に表示部５３の所定位置に表示することも可能である。

次に、この著作物管理装置１に、登録したユーザがアクセスし、所定のカード５ａをダウンロードする場合の手順について図４のフローチャートを用いて説明する。

まず、ステップＳ１として、ユーザがユーザ端末４から著作物管理装置１にアクセスし、特定のジャンル、例えばコミックのカード５ａの鑑賞を選択（鑑賞請求）すると、ユーザ端末４からの鑑賞請求を受けた著作物管理装置１は、図１に示すコンテンツＤＢ２５にアクセスし、コミックのカードデータ５ｂを鑑賞用カードデータとして組み込んだＨＴＭＬファイルをユーザ端末４に送信する（ステップＳ２）。ユーザは、受信したＨＴＭＬファイルをブラウザで表示し、鑑賞用カードを鑑賞する（ステップＳ３）。ここで、鑑賞用カードは、ブラウザ上でのみ鑑賞することが可能で、カード５ａを図１に示すユーザ端末４の記憶手段５２に記憶させたり、プリントアウトしたりすることはできないものとする。

ユーザは、この鑑賞用カードの中に欲しいカード５ａがあった場合は、ステップＳ４として著作物管理装置１に対してカード５ａのダウンロードを要求する（ダウンロード要求）。この際には、ユーザ登録時に割り当てられたユーザＩＤおよびパスワードを入力することになる。
ステップＳ５において、著作物管理装置１は、ユーザＩＤおよびパスワードを受信して、図１に示す照合手段３２によりユーザＩＤとパスワードの照合を行う。照合は、受信したユーザＩＤを基にユーザ情報ＤＢ２６に登録してあるパスワードを読み込んで、ユーザから提示されたユーザＩＤとパスワードのそれぞれがユーザ情報ＤＢ２６に登録されたものと完全一致するか否かを調べる。そして、ユーザＩＤとパスワードのそれぞれが完全一致した場合は、ステップＳ６に進み、完全一致しない場合は、ユーザＩＤおよびパスワードの再入力をユーザに促す。

ユーザの照合が終了したら、ステップＳ６として著作物管理装置１は、コンテンツ管理手段３１によりコンテンツファイル１０を作成する。ここで、コンテンツファイル１０の作成とは、コンテンツ管理手段３１が、コンテンツＤＢ２５からカードデータ５ｂおよびシリアル番号データ１１ｂを読み込み、ステップＳ５で照合したユーザＩＤをオーナーデータ１２として添付すると共に、システムプログラム１３を付加することをいう。なお、シリアル番号データ１１ｂとして記録されるカード５ａのシリアル番号１１ａは、コンテンツ管理手段３１の編集手段により、コンテンツＤＢ２５から読み込んだシリアル番号１１ａを一つインクリメントした新しいシリアル番号１１ａが用いられる。

このようにして作成されたコンテンツファイル１０は、ステップＳ７でユーザ端末４に送信される。そして、ステップＳ８としてユーザ端末４が、このコンテンツファイル１０を受信し、ユーザ端末４の購入コンテンツＤＢ５６（図４参照）にコンテンツファイル１０を記録すると共に、画面上に購入したコンテンツファイル１０を表示する。以降において、ユーザは購入したカード５ａのオーナーとなる。
コンテンツファイル１０の送信に成功したら、著作物管理装置１は、ステップＳ９として、編集手段が、前記の新しいシリアル番号１１ａをそのカード５ａの現在のシリアル番号１１ａとしてコンテンツＤＢ２５に登録する。

ここで、ユーザが画面上に表示されたコンテンツファイル１０をマウス等でクリックすると、購入したカード５ａが画面に表示される。このとき、シリアル番号１１ａは、識別番号１５ａと共にカードＩＤ８ａとして、図２（ａ）のフレーム７ａの右上に表示される。また、このとき、ＯＳ（Operating System）の設定ファイルにこのカード５ａの表示位置の設定が保存される。なお、設定ファイルに変更を加えずに、前記のアルバムに表示されるように構成しても良い。

次に、カード５ａのオーナーを認証する手続きについて図５を用いて説明する。なお、この認証処理は、カード５ａのオーナーの確認や、オーナー加工カードの登録の際に行われ、カード５ａのオーナーが正しいことを確かめるための処理である。
