Kajian ini menghuraikan konsep istihsan secara terperinci bagi memberikan penjelasan terhadap konsep istihsan dari sudut teorinya dan aplikasi konsep dalam proses penyelesaian hukum syarak serta pemakaiannya di mahkamah syariah. Hasil kajian ini menunjukkan bahawa istihsan merupakan salah satu sumber hukum yang diiktiraf oleh syarak, manakala perselisihan para ulama hanya perselisihan dari sudut penggunaan istilah semata-mata. Dapatan ini diperkuat melalui analisis terhadap laporan kes mahkamah syariah di Malaysia yang menunjukkan terdapat penggunaan konsep istihsan secara tidak langsung di mahkamah. Harta sepencarian boleh dianggap sebagai amalan adat masyarakat di Malaysia dan juga masyarakat-masyarakat lain di kepulauan Nusantara. Amalan adat ini telah mendapat pengiktirafan dari sudut undang-undang di mana ia telah didengar di mahkamah sebelum negara mencapai kemerdekaan daripada British. Harta Sepencarian di Malaysia telah ditadbir di bawah Undang-Undang Keluarga Islam yang berkuat kuasa di negeri-negeri seluruh Malaysia. Oleh itu, Harta Sepencarian hanya terpakai kepada masyarakat Islam di negara ini. Bagi masyarakat bukan Islam pula, pembahagian harta suami isteri dikenali sebagai harta perkahwinan dan pihak-pihak yang terlibat perlu mengemukakan tuntutan di mahkamah sivil. This study explores the intricate connection between Zakat, in-game transactions and the related ethical issues in the realm of Islamic law specifically in the contemporary digital age. This study reassesses traditional religious commitments in response to the rising issues presented by the gaming industry. This study employs a dual methodological approach. First, it relies on intensive library research. This action serves as the basis for gathering a wide range of scholarly materials, historical texts and contemporary publications. This methodology guarantees a comprehensive comprehension of the established tenets of Islamic jurisprudence, their historical backdrop and their pertinence to contemporary matters. This study employs a comprehensive investigation guided by Islamic jurisprudence. The ethical framework devised by Imam Shafi'e, which prioritises factors such as purpose, benefit and the greater good is employed to evaluate the ethical ramifications of in-game transactions. This entails analysing the parallels between them and gambling as well as the possibility of manipulating players. The research also employs talfiq, a flexible approach that enables the harmonisation of different jurisprudential viewpoints. It is important to consider whether virtual assets should be included in Zakat calculations as this allows for a detailed and thorough examination. This study highlights the significance of well defined concepts in Islamic law and the advancement of financial literacy within the gaming community. Furthermore, it emphasises the necessity for ongoing academic dialogues in order to establish a connection between religious convictions and gaming behaviours. The primary objective of this research is to promote the concepts of Zakat while advocating for ethical gaming practises. Its objective is to ensure the continued relevance and efficacy of Islamic traditions in solving modern difficulties in the digital age. Talfiq is one of the methodologies to create the resolution of hukm based on the treasure of fiqh introduced by classical Islamic scholars. Despite that, the use of this methodology is still debatable and remains as mahal al-khilaf by scholars. The mut’akhkhirin scholars are most of the numerous groups that are against this concept. This contradicts the modern scholars who tend to adopt this concept to arrive at an opinion that is suitable with modern and current issues. Therefore, this article will analyse several views from the muta’akhkhirin scholars regarding the use of talfiq. This study was conducted with the qualitative method, collecting data from turath literature (classical textbooks) written by the muta’akhkhirin scholars, and it will end with analyse with the thematic methods. The result of the study found that the stick of view by the muta’akhkhirin scholars against the practice of talfiq has their own basis. The study found three main bases against the practice of talfiq; 1. The use of talfiq will lead to arriving at an opinion that is rejected by the majority of the scholars; 2. The use of the talfiq will lead to the practice of tatabbu‘ al-rukhas; and 3. The use of talfiq will lead to harm to religion.

Talfiq secara amnya merujuk kepada menghimpunkan beberapa pandangan sehingga terhasilnya satu pandangan yang tidak diakui oleh mana-mana mujtahid. Sebahagian besar fuqaha muta'akhirin menolak keras pengaplikasian konsep talfiq dalam menyelesaikan sesuatu permasalahan hukum berikutan kesan-kesan negatif yang terhasil daripada konsep tersebut. Namun realiti semasa sebaliknya, keperluan kepada konsep talfiq merupakan perkara yang tidak dapat dielakkan dalam pelbagai keadaan. Oleh yang demikian kajian bertujuan mengkaji faktor-faktor pengaplikasian konsep talfiq disisi ulama mu'asirin berasaskan realiti semasa. Kajian ini bersifat kualitatif data-data dikumpul melalui metode kepustakaan dan temubual. Seterusnya dianalisis melalui metode tematik. Kajian mendapati faktor-faktor yang mendorong kepada penggunaan konsep talfiq dalam pengaplikasian semasa adalah berasas namun pengaplikasiannya mestilah berpandukan dawabit hukum yang betul dalam memastikan ia tidak disalah guna sehingga terjerumus kepada tatabbu' rukhas di dalam hukum.

Some scholars of Malay classics believe that Malay traditional religious books or Kitab Jawi, being a mere translation from Arabic sources, have little practical purposes outside the realm of beliefs, rituals, and family. Considering current commercial development, especially in Islamic banking and finance, the above claims need some qualifications, especially considering no further studies have been conducted to support their conclusion. This is especially so to determine the extent of the remarks made by the authors of Kitab Jawi in their texts whether merely a literal translation of the Arabic texts or containing some new and specific contributions worthwhile investigating. It is therefore the aim of this article to analyse the contents of these Kitab Jawi and compared them with the Arabic sources that they claimed to refer to. It is hoped that this analysis should provide an understanding of these Kitab Jawi can be considered original in respect of discussion and elaboration of translated texts. The analysis will focus on Shaykh Dawud’s work of Nahj al-Raghibin with special reference to the essentials of the sale contract. The selection of the subject of the sale contract is to demonstrate that the authors of Kitab Jawi had some appreciation on the trade and business prevailing during their compilation. The article argues that Nahj is not simply a translation of the Arabic texts, but it is an academic exercise, which consists of selecting, rearranging, and supplementing and presenting ideas and concepts of law.

The depiction of heaven as a supernatural thing that is hard for human beings to perceive is understandably difficult. Thus, the person who delivers divine messages about it to the masses requires a high level of language ability and delivery skills in order to be able to convince the audience. This study aims to examine the style of language in the hadiths containing descriptions of heaven from the perspective of mubālaghah. The research objectives are achieved through content analysis through which, hadiths related to description of heaven in Ṣaḥīḥ Muslim are probed and the elements of mubālaghah in them are identified and analyzed. The mubālaghah approach by al-ʿAlawi is used as a theoretical basis in identifying and analyzing the elements of mubālaghah. The findings show that Rasulullah SAW decribed the inhabitants, the nature of heaven and the blessings provided to its inhabitants by using various mubālaghah approaches such as applying the elements of bayan, repeating sentences with the same meaning and completing sentences with hyperbole. Objects used as symbols were chosen from the socio-cultural environment of the society at that time such as the moon, stars, musk, horses, gems and significant rivers such as the Nile, Saihān and Jaihān. The most prominent characteristic is that his words are rich in elements of balaghah and delivered effectively to strengthen the audience’s understanding of the theme, which subsequently leads to acceptance and belief.

Estate planning is a process in which estates are being distributed during one’s lifetime to meet a testator’ intention. In this context, innovation is vital in selecting and applying appropriate instruments which are in accordance with the Islamic principles. In Malaysia, various conflicts of distribution of estates or wealth occur among the beneficiaries and non-beneficiaries, mainly due to the sole reliance on faraid, delayed application of distribution of estates by the beneficiaries, bureaucratic challenges which lead to the lock down of Muslims’ estates and other related issues. The main objective of this article is to explore the concept of innovation in the planning of the distribution of estates according to the Quran and Sunnah. In achieving this objective, the content analysis methodology is applied by using primary and secondary data. The study has found that the innovation in estates planning needs to be applied regularly to resolve the problems and difficulties faced by Muslims in their estates distribution, due to the current limitations and restraints. The guidance of the innovation has been ordained in the Quran and Sunnah and they are to be explored by the Muslims themselves.

The interconnection of astronomy with various fields of knowledge and different intellectual outcomes in today’s digital era is becoming more apparent. The contemporary advancement of science, technology and innovation (STI) has been the most important catalyst of the interconnection, which is now concentrating on the integration level. Among the current intellectual outcome integrated into astronomy is the DIKW model. The problem is that the integration brings the values derived from the determinism of positivist science and the indeterminism of post-positivist science. It is due to the weakness of the integration process, which is not based on any scientific framework that concerns the values. As such, the main objective of this research is to address the weakness by studying the integration of the DIKW model into astronomy based on the Islamic science framework. Data collection for this study is through library research, while data analysis methods employed inductive, deductive and comparative methods. As a result, the framework of Islamic science was formulated consisting of three components, namely (i) knowledge methodology, (ii) nature’s essence and occasionalism, and (iii) knowledge classification. Thus, the framework addresses the determinism of positivist science through the understanding of occasionalism. Meanwhile, the unguided combination of knowledge caused by the indeterminism of post-positivist science can be organised through a knowledge classification component. The classification guides the difference between Shariah’s complied and praised knowledge from rejected and reprehensible knowledge.

Modern science historiography views astronomy development since antiquity solely on human interaction with nature. Such a secular evolutionary view is derived from the positivistic paradigm. In contrast, the Islamic science historiography perspective explains astronomy development since antiquity primarily based on revealed knowledge, while the scientific method is employed accordingly. Even so, there are differences among scholars in elucidating Islamic science historiography which is classified into two dimensions. The first dimension focuses on the philosophical aspects that underline the historical narrative and the second dimension prioritises scientific evidence. The question is how these differences could be reconciled so that the historical narrative of astronomy development that emerged from modern science historiography would be more coherent with Islamic science historiography. Therefore, this library study was conducted using data collection based on the documentation method and a content analysis method was employed for data analysis. As a result, the Priority Principle from fiqh al-awlawiyyat as a strategic locus to reconcile the differences in Islamic science historiography was identified. The principle prioritises the role of Allah, the prophets and the revelations according to Shariah and the scientific method is used suitably. It is also crucial to be emphasised in addressing the secular evolutionary view that underlie astronomy development. It is thus concluded that astronomy development from antiquity to Islamic civilization can be marked as starting from the time of Prophet Adam and will be over at the end of time.

Tulisan ini menyimpulkan bahwa: pertama, walaupun kekuatan hukumnya masih diperdebatkan, akan tetapi dalam praktek, Kompilasi Hukum Islam ini telah dijadikan hukum material atau rujukan oleh hakim di pengadilan agama Indonesia dalam memutuskan perkara. It can, however, be found among Muslims who negligently fail to pay zakah within the stipulated period. Every obligatory practise must be performed within the time determined by Allah SWT in the discourse of fiqh. Hence, this article will look at the aspect of qada’ zakah in view of the shara‘ discussion. Thematic content analysis of themes based on the schools of thought will be used to thoroughly discuss this topic. In conclusion, Shariah allows and provides exemption to zakah payers in unavoidable situations. As a result, zakah should be paid even if it is not within the timescale provided if there is justification allowed by shara‘.

Justeru, artikel ini akan membincangkan tentang konsep bejana menurut perspektif hukum Islam. Kajian perpustaakan melalui metode dokumentasi telah digunakan bagi mendapatkan data-data secara primer dan sekunder bagi penyempurnaan artikel ini. Hasil dapatan menunjukkan bejana boleh dihasilkan daripada pelbagai material khususnya daripada emas, perak, permata, tembaga, kulit, tulang dan seumpama dengannya. The issue of bid'ah has been a subject of polemic amongst Muslims in Malaysia for a long time. Generally, there are two main schools in interpreting the meaning of bid'ah. Some scholars view that there are two sides of interpretation as to the meaning of bid'ah, namely ḥasanah and ḍalālah. While some other scholars are of the view that there is no place for bid'ah in Islamic law especially in matters pertaining to worship. These scholars are of the opinion that every bid'ah is ḍalālah. Bid'ah is literally defined as an act which never done by Prophet Muhammad SAW. In this context, it is similar with the meaning of al-tark. This paper attempts to explore and analyze the differences and similarities between the meaning of bid‘ah and al-tark in Islamic law. The data collection
of this qualitative study is mainly based on the library research.
These data are deductively and inductively analyzed from
selected examples. Among the findings of this study is that, there
are significant differences between bid‘ah and al-tark. Al-Tark is
general in nature and it is not accepted as a source on Islamic
law, while bid‘ah ḍalālah is illegal and forbidden to be practised
by Muslims.

The scenario of the ummah currently is moving rapidly, causing the scholars to act fast in providing the best solutions for every problem arise. The concept of talfīq is a method frequently used by scholars nowadays although it is not categorized as one of the sources of Islamic law. Talfīq can be defined as mixing or combining various opinions of scholars in a specific problem without being bound to any of the madhhabs (schools of law). This concept still needs clarification from the experts of Islamic law, particularly the discussions on the arguments among the scholars. The scholars in the past strongly opposed the usage of this concept. However, the current development of Islamic jurisprudence has popularized the use of talfīq, making reference to all madhhab possible. This study found that the concept of talfīq requires further explanation as far as discussions on its authority, so that an accurate assessment can be made on whether to support the implementation of the talfīq or totally disapproved its use. Positive and negative impact from the use of talfīq will also need to be emphasized in order to act as a guidance for scholars

Amalan adat ini telah mendapat pengiktirafan dari sudut undang-undang di mana ia telah didengar di mahkamah sebelum negara mencapai kemerdekaan daripada British. Harta Sepencarian di Malaysia telah ditadbir di bawah Undang-Undang Keluarga Islam yang berkuat kuasa di negeri-negeri seluruh Malaysia. Oleh itu, Harta Sepencarian hanya terpakai kepada masyarakat Islam di negara ini. Bagi masyarakat bukan Islam pula, pembahagian harta suami isteri dikenali sebagai harta perkahwinan dan pihak-pihak yang terlibat perlu mengemukakan tuntutan di mahkamah sivil. Malaysia is among the countries, which have very close relations with Shafi'i madhhab in term of Islamic Law. This can be seen from the provisions of Syariah Law in Malaysia where the opinion of the Shafi'i madhhab is preferred than other madhhabs. However, the current situations and issues cause that the other opinions from the other madhhabs are also used and practiced in order to provide the best solutions. Namun secara teknikalnya, ia tidak jauh berbeza dengan instrumenùrf menurut mazhab Syafi'i. Tambahan pula, amalan pembahagian harta sepencarian ini diamalkan dalam masyarakat Melayu khususnya di Nusantara yang majoritinya berpegang kepada mazhab Syafi'i. Kajian ini menggunakan metodologi kajian perpustakaan dengan merujuk kepada kitab-kitab tulisan para ulama dalam mazhab Hanafi dan mazhab Syafi'i dalam usaha untuk menjustifikasikan penerimaan amalan harta sepencarian dalam hukum syarak. Kajian cuba mencari justifikasi dalam mazhab yang lain dalam usaha untuk mengembangkan amalan yang memberi manfaat dan pembelaan kepada kaum wanita khususnya ke negara-negara Islam selain daripada masyarakat Muslim Nusantara. Meskipun kemungkinan penyertaan wanita dalam lapangan pekerjaan belum menjadi satu 'urf yang boleh diiktiraf untuk mendapatkan harta dalam perkahwinan, namun tugas-tugas domestik kaum wanita dalam pengurusan rumah tangga boleh dijadikan asas dalam pembahagian harta yang diperolehi dalam perkahwinan antara pasangan yang telah bercerai. Ini secara tidak langsung mampu memperlihatkan keindahan Islam dalam menjaga hak kaum wanita yang sering kali dilihat sebagai golongan yang lemah dan akan menjadi mangsa kepada sesebuah perceraian yang berlaku. Dalam memperkemaskan amalan pembahagian ini pula, teori dan praktis perundangan di Malaysia dapat menjadi contoh dan boleh dikembangkan ke negara-negara umat Islam yang lain. Hasil kajian telah mendapati bahawa pemakaian instrumen ini sesuai dengan furuk Syafìiyyah di samping dapat mengukuhkan lagi amalan harta sepencarian serta boleh diamalkan di negara-negara umat Islam lain termasuklah yang berpegang kepada mazhab Hanafi.

(This study focuses on the application of the instrument al-Istihsan bi al-`Urf in justifiation of “harta sepencarian” practice. Basically, this instrument motion derived from the Hanaf school. But technically, it’s not dissimilar to the instrument `urf according to Shafii school. Furthermore, the concept of “harta sepencarian” division is practiced in the Malay community, especially in Nusantara, which is the majority, upholds the Shafii school. This study uses library research methodology with reference to the writings of scholars in the Hanaf and Shafii school in order to justify the acceptance of the practice of “harta sepencarian” in Shari’ah law. This study tries to fid justifiation in the other school in an attempt to develop a practice that benefis and defense women, particularly to Muslim countries other than the Muslim community of the Nusantara. Despite the possibility of the participation of women in jobs has not become a custody or ‘urf yet that can be recognized for the property in marriage, but domestic duties of women in household management can be the basis for the division of property acquired during a marriage between couples who divorce. This in turn can keep the beauty of Islam in which women’s rights are often seen as the weak and will fall prey to a divorce case. In this division to streamline practice, the theory and practice of law in Malaysia can be an example and extended to other Muslims countries. The study has found that the application of these instruments is in accordance with furu‘ Shafiiyyah as well as to strengthen the practice of “harta sepencarian” to be practiced in other Muslim countries including the country that adhere to the Hanaf school.)

Kajian ini menghuraikan konsep istihsan secara terperinci bagi memberikan penjelasan terhadap konsep istihsan dari sudut teorinya dan aplikasi konsep dalam proses penyelesaian hukum syarak serta pemakaiannya di Mahkamah Syariah. Hasil kajian ini menunjukkan bahawa istihsan merupakan salah satu sumber hukum yang diiktiraf oleh syarak, manakala perselisihan para ulama hanya perselisihan dari sudut penggunaan istilah semata-mata. Dapatan ini diperkuat melalui analisis terhadap laporan kes Mahkamah Syariah di Malaysia yang menunjukkan terdapat penggunaan konsep istihsan secara tidak langsung di mahkamah. Selain itu, kajian ini juga menyimpulkan bahawa peruntukan undang-undang itu sendiri yang memberikan kebenaran kepada pihak hakim untuk mengaplikasikan konsep ini secara tidak langsung.

(This study elaborates in detail the concept istihsan (juristic preference) to give a comprehensive explanation of this concept, both theoretically and of the actual application of this concept in the Islamic law and Syariah Courts in Malaysia. This study shows that istihsan is one of the sources that is recognized under Islamic law, while disagreement between scholars is only concerning its technical defiition. This fiding is further reinforced with the analysis of reported cases in the syariah c ourts in Malaysia, which indicate the use of istihsan indirectly in the court. In addition, the study also concludes that the provisions of the law itself authorize judges to indirectly apply this concept.)

Some scholars of Malay classics believe that Malay traditional religious books or Kitab Jawi, being a mere translation from Arabic sources, have little practical purposes outside the realm of beliefs, rituals, and family. Considering current commercial development, especially in Islamic banking and finance, the above claims need some qualifications, especially considering no further studies have been conducted to support their conclusion. This is especially so to determine the extent of the remarks made by the authors of Kitab Jawi in their texts whether merely a literal translation of the Arabic texts or containing some new and specific contributions worthwhile investigating. It is therefore the aim of this article to analyse the contents of these Kitab Jawi and compared them with the Arabic sources that they claimed to refer to. It is hoped that this analysis should provide an understanding of these Kitab Jawi can be considered original in respect of discussion and elaboration of translated texts. The analysis will focus on Shaykh Dawud’s work of Nahj al-Raghibin with special reference to the essentials of the sale contract. The selection of the subject of the sale contract is to demonstrate that the authors of Kitab Jawi had some appreciation on the trade and business prevailing during their compilation. The article argues that Nahj is not simply a translation of the Arabic texts, but it is an academic exercise, which consists of selecting, rearranging, and supplementing and presenting ideas and concepts of law.

Talfiq boleh diertikan sebagai percampuran pendapat daripada beberapa mazhab dalam masalah tertentu sehingga menghasilkan satu hukum yang tidak diiktiraf oleh mana-mana mazhab fiqh. Konsep Talfiq ini masih tidak mendapat penjelasan yang sewajarnya daripada pakar perundangan Islam dari sudut perbincangan dalil dan perbahasan para ulama berkenaan dengannya sekalipun telah terdapat sejumlah karangan berkenaan konsep ini. Secara umumnya diketahui, konsep Talfiq sangat ditentang oleh para ulama silam khususnya pada zaman perkembangan dan penulisan mazhab-mazhab fiqh. Setelah bermulanya zaman pembaharuan fiqh Islam pada abad ke 20, konsep ini mula dipopularkan semula di samping kempen supaya masyarakat Islam bebas daripada ikatan mazhab. Kajian ini akan cuba memberikan satu penilaian terhadap konsep ini agar satu keputusan dapat dibuat sama ada untuk menyokong pengamalan konsep Talfiq ataupun tidak membenarkan sama sekali pengamalannya dalam proses pengeluaran hukum Islam. Selain berijtihad, kaedah yang digunakan oleh para ulama sebelum ini ialah berpegang kepada pendapat mazhab-mazhab tertentu, ini juga sedikit sebanyak mengekeng perkembangan industri perbankan Islam kerana amat sukar untuk mencari penyelesaian hukum yang berdasarkan satu-satu mazhab tertentu sahaja. Kajian ini akan menganalisis secara tuntas berkenaan konsep Talfiq di kalangan ilmuan Islam berserta aplikasi terkini melalui fatwa-fatwa yang dikeluarkan di dalam Resolusi Syariah Majlis Penasihat Syariah Bank Negara Malaysia.  Kajian akan cuba menjawab beberapa persoalan dalam penggunaan konsep Talfiq  dan seterusnya memberikan salah satu pilihan kaedah penyelesaian hukum bagi pihak-pihak yang berkecimpung dalam bidang perbankan Islam ini.
