Abstract. The paper analyses the international laws, particularly the legal corpus related to the intangible cultural heritage, reviews how the ICH safeguarding policies are developed, core terms like “intangible cultural heritage”, ICH domains and inventorying on the national level. The paper pays attention to the living heritage transmitted from one generation to another and has cultural and social meaning for communities needed to preserve identity and provide continuity of development. A special attention is paid to the impact of emergencies – climate changes, technological disasters, armed conflicts – for liveability of the intangible cultural heritage, means of its safeguarding. The paper observes efforts of some
countries in building a system of national laws and programs for ICH safeguarding. Each country, as the paper has concluded, develops its own legislative framework for safeguarding of the living heritage while basing on the letter and the spirit of the
Convention 2003.

У статті аналізується міжнародне право, зокрема корпус законів, що стосуються нематеріальної культурної спадщини, розглянуто, як будується політика в охороні нематеріальної культурної спадщини (НКС), основні поняття, такі як визначення терміна «нематеріальна культурна спадщина», галузі та інвентаризацію НКС на національному рівні. Увагу приділено тій живій спадщині, яка передається від одного покоління до наступного й має для спільнот, громад соціальне, культурне значення, необхідне для збереження ідентичності та забезпечення безперервності розвитку. Окрему увагу приділено впливу надзвичайних обставин-змін клімату, технологічних катастроф, збройних конфліктів-на життєздатність нематеріальної культурної спадщини, засоби її охорони. Прослідковано зусилля країн у розбудові національного законодавства в системі культурної політики та програм з охорони нематеріальної культурної спадщини. Кожна країна, як підводить до висновку стаття, розвиває власну законодавчу структуру охорони живої спадщини, спираючись водночас на букву й дух Конвенції ЮНЕСКО 2003 року. The paper analyzes cultural policies for ICH using the example of the Kingdom of the Netherlands. In particular, the focusof attention is the Action Plan for implementing the UNESCO Convention 2003, that is, measures for inventorying and planning. Besides,the legislative base and special provisions concerning the ICH are also analyzed. The proposed review certifies that the safeguarding of the intangible cultural heritage became not only the important line but an integral and defining part of the cultural policy of the Netherlands.

The paper analyzes the steps anticipating the adoption and international approval of the UNESCO Convention
for the Safeguarding of the Intangible Cultural Heritage. It deals, particularly, with a wide body of expert discussion reports
and studies laying the base for adopted political documents and legislative acts, summarizing resolutions and proposals,
which we had to consider. Retrospective and analytical review presented in the paper allows not only to recognize and
appreciate the long-term way anticipating the development of the final draft of the UNESCO Convention, but also to examine
most of conceptions, terms and principles applied in 2003 Convention which are further improving under challenges of
time and international community. Analyzing the genesis of criteria and principles, that is, the essence of today concept on
safeguarding of the intangible cultural heritage underlying the 2003 Convention, the author stresses upon such important
its integral parts as comprehensive and interdisciplinary studies, broad field for dialogue directed at reaching consensus,
definition of the role of communities and individual bearers of the intangible cultural heritage.
У статті розглядаються кроки, що передували прийняттю та міжнародному схваленню Конвенції ЮНЕСКО про охорону нематеріальної культурної спадщини. Зокрема, ідеться про величезний масив матеріалів експертних обговорень і досліджень, на
основі яких приймалися політичні документи та нормативно-правові
акти, робилися підсумкові резолюції та пропозиції, і який довелося опрацювати. Ретроспективний та аналітичний огляд, запропонований у статті, дозволяє не просто зрозуміти та оцінити той довгий
шлях, що передував розробці остаточного проєкту Конвенції ЮНЕСКО про охорону нематеріальної культурної спадщини, а й глибше
збагнути багато понять, термінів і принципів, застосованих у Конвенції 2003 року, які дедалі вдосконалюються, враховуючи вимоги
часу та міжнародного суспільства. Досліджуючи генезу критеріїв
і принципів, власне, суті сьогоднішньої концепції про охорону нематеріальної культурної спадщини, покладену в основу Конвенції
ЮНЕСКО 2003 року, автор наголошує на таких важливих складових,
як усебічні та міждисциплінарні дослідження, широке поле діалогу,
спрямованого на досягнення консенсусу, визначення ролі громади та
окремого носія елемента нематеріальної культурної спадщини.

Розглядається історія становлення термінології у сфері нематеріальної культурної спадщини як у науковому дискурсі, так і в політичній мові та політичних документах для визначення тих процесів і проблем, які впливають на формування та прийняття відповідних рішень та на розуміння завдань, що постають сьогодні перед окремими групами, громадами та суспільствами.
The paper analyzes the establishment of the ICH terminology as in scientific discourse as in political language and documents for determining processes and problems impacting on formulation and adoption
of respective decisions and understanding of challenges which separate groups, communities and societies are facing today.

The paper analyzes the practice of culture policy development for the intangible cultural heritage (ICH) using example of ICH elements nomination to the National Register of ICH of Ukraine and UNESCO Lists. In particular, the focus of our interest are measures of inventory and planning. We consider also the legislative base and special provisions concderning ICH safeguarding. The proposed survey evidences that the ICH safeguarding has become not only the important direction but an integral and definitive part of cultural policy.
У статті розглядається практика побудови культурної політики у сфері нематеріальної культурної спадщини (НКС) на прикладі номінування елементів НКС до Національного переліку НКС України та Списків ЮНЕСКО. Зокрема, у фокусі уваги заходи з інвентаризації та планування. Також розглядається законодавча база й спеціальні положення, що стосуються НКС. Пропонований огляд свідчить, що охорона нематеріальної культурної спадщини стала не просто важливим напрямом, а невід’ємною та визначальною складовою культурної політики.

The paper considers questions which are raised recently by UNESCO, that is, climate changes, food security, education, role and place of communities and local institutions/organizations. In this case, it deals with Carpathian biosphere reserve as a stakeholder which could become a moderator of inventorying of the intangible cultural heritage at the biosphere reserve territory
У статті розглядаються питання, які сьогодні піднімаються ЮНЕСКО, це зміна клімату, продовольча безпека, освіта, роль і місце місцевих громад, спільнот а також місцевих організацій, у даному випадку роль Карпатського біосферного заповідника як зацікавленої організації яка може стати модератором інвентаризації нематеріальної культурної спадщини на території біосферного заповідника.

The purpose of the paper is to provide a general
review of Intangible Cultural Heritage safeguarding policy development on local and oblast (provincial) level in Ukraine with the
commitment of various stakeholders, communities, bearers and
practitioners as a result of the training workshops that were organized with the support of the Regional Centre for the Safeguarding of Intangible Cultural Heritage in South-Eastern Europe (Sofia,
Bulgaria). The paper will show the positive impact of collaboration
among national and international organizations and institutes in
2003 Convention implementation, especially among Sofia Center
for Intangible Cultural Heritage Safeguarding, National Academy
of Arts of Ukraine, National Union of Folk-Art Masters of Ukraine,
Odessa Oblast Center for Ukrainian Culture, Development Centre
“Democracy through Culture” (accredited by 2020 to UNESCO)
and local communities, culture organizations and universities. The
analysis of the concrete outcomes of the collaboration defines the
essential steps and components for the Intangible Cultural Heritage policy development on local and national level.

Olha Pilyuhina is an artist and a craftswoman, a master of Reshetylivka tapestry1, representative of the creative family of Pilyuhins. She leads exhibition activity to promote the living culture, carries out master classes, lectures audiences of different ages, develops educational programmes for children and young people. Her works embody traditions of Reshetylivka vegetable carpet weaving along with her own creative quest. This interview was taken after the opening of the exhibition “Harmonies” by O. Pilyuhina at the National Academy of Arts of Ukraine at the beginning of March 2020.

The paper analyzes cultural policies for ICH using the example of some European countries, State Parties of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage. In particular, the special attention is paid to measures and programmes related to research, safeguarding, ICH promotion, knowledge transfer and education. Besides, the article considers the legislative base and special provisions concerned ICH safeguarding. The proposed review certificates that the safeguarding of the intangible cultural heritage has become not only the important direction but an integral, and often a critical, part of cultural policies of state parties of the UNESCO Convention 2003.
