Objektif utama kajian ini dijalankan adalah untuk mengetahui kedudukan dan perspektif syariah terhadap penggunaan unsur Islam dalam perniagaan. Tinjauan terhadap perspektif Islam merangkumi dalil-dalil yang disepakati daripada Al-Quran, As-Sunnah, Ijma’, Qiyas, dan juga kaedah Sad Az-Zarai’, maqasid syariah, fatwa-fatwa dari Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan bagi Hal Ehwal Ugama Islam Malaysia dan Jawatankuasa Fatwa Negeri. Metodologi kajian adalah berbentuk kajian kepustakaan menggunakan pedekatan analisa terhadap dalil-dalil dari sumber yang disepakati dan tidak disepakati, serta pelbagai hujah sokongan daripada kitab-kitab syariah yang muktabar, artikel-artikel berkaitan yang diterbitkan dari dalam dan luar negara dan lain-lain untuk mendapatkan maklumat-maklumat penting beserta perinciannya bagi setiap permasalahan yang timbul berkaitan dengan isu penggunaan unsur agama Islam dalam perniagaan. Hasil kajian menunjukkan bahawa amalan eksploitasi agama Islam sama ada eksploitasi terhadap Al-Quran mahupun As-Sunnah adalah sesuatu yang diharamkan dan wajib ditegah oleh pihak-pihak berautoriti kerana hal ini boleh menimbulkan fitnah terhadap agama Islam, dapat memudaratkan kesihatan, bahkan dapat menggoyahkan pegangan akidah seseorang Muslim sekiranya terlalu bergantung dan mempercayai terhadap kehebatan-kehebatan produk yang dilabelkan dengan unsur-unsur agama. Oleh yang demikian, aktiviti ini perlu dibendung bagi menjaga kesucian agama Islam.   Kata kunci: Eksploitasi, Islam dan makanan Sunnah.     Abstract The main objective of this study is to find out the sharia position and perspective on the use of Islamic elements in the business. An overview of the Islamic perspective includes the dalils from Al- Quran, As-Sunnah, Ijma ', Qiyas, and  the Sad-Zarai method, the maqasid syariah, the fatwa of the Muzakarah of the National Council for Fatwa Committee for Islamic Religious Affairs Malaysia, State Fatwa Committee, Lajnah Daimah Li Al-Buhuth wa Al-Ifta, and others. This research is a library study using analytical approaches by referring to shariah books, related articles in connection with the issue of the use of Islamic religious elements in the business. The findings show that the practice of Islamic exploitation either the exploitation of the Quran or As-Sunnah is prohibited as this may lead to defamation against Islam, may harm one’s health and even may deviate the faith a Muslim. Therefore, this activity needs to be controlled in order to protect the sanctity of Islam.   Keywords: Exploitation, Islam and prophetic food.

The paper is a review of the Malaysian experience in managing the issuance and development of Islamic bonds market. It was observed that Malaysia has begun with the issuance of loan-based Islamic bonds by the Malaysian government followed by the vast and extensive issuance of sale-based Islamic bonds by both government and private corporations. However, most of the Malaysian Islamic bonds issued to date have been based on the principles of Murabahah and Al-Bai' Bithaman Ajil (BBA) that can hardly obtain the acceptance and confidence of global investors especially from the Middle-East countries. Hence, the issuance of Ijarah-based global sovereign and corporate Islamic bonds (Sukuk) took place in 2002. In general, five key factors have been recognized to develop a more comprehensive Malaysian Islamic bonds market and accelerate the progress of Malaysia's venture into the international Islamic financial arena.

Corporate waqf is usually considered as the component of cash waqf. However, Hajar et al (2011) suggested that corporate waqf should be established as an independent wadf concept. Thus, based on the suggestionm, this paper aims to reconceptualize corporate as an independent waqf concept. This paper is a theoretical study based on previous studies and researches on corporate waqf. The paper discussess corporate waqf from three different aspects; definition of corporate as independent waqf concept, models, and Shariah considerations. The study will establish corporate waqf as an independent category of waqf due to its salient characteristics and extend the understanding and concept of the corporate waqf. The novelty of this study lies on its attempt in defining the corporate waqf independently. This study also discuss the three models of the corporate waqf and deliberate on the main Shariah considerations related to the corporate waqf practice.

Library research was carried out to collect relevant information and data. The materials not only limited to the English language but also cover Malay language materials. This study aims to propose a Shariah compliant mode of house financing named as “Adapted Mudarabah Model” or abbreviated as AMM. The proposal is made after discussing the most two common schemes for Islamic home financing i.e. BBA (Bayʿ Bithaman Ajil) dan MM (Musharakah Mutanaqisah) and their Shariah related issues. Thus, it is exploratory and conceptual in nature. This Shariah compliant financing model is proposed due to the shortfalls in the BBA and MM models where there are some unresolved and controversial Shariah and legal issues. This study uses the concept of mudarabah in this model and suggests that by implementing this model, all of the issues discussed in BBA and MM can be mitigated as the model does not require the Islamic banks to fulfill any of the conditions and obligations of counter-values. It has been observed that the efforts to rejuvenate waqf institutions in Islamic countries were participated by the corporate entities. For example, in Malaysia, Johor Corporation (JCorp) has initiated a waqf clinic in 1998 which later expanded into a corporate waqf entity known as Waqaf An-Nur Corporation Berhad (WANCorp). In other event, Majlis Agama Islam Wilayah Persekutuan (MAIWP) has collaborated with Tabung Haji to develop a Class A waqf building leased to Bank Islam Malaysia Berhad (BIMB) in 2011. Recently, Majlis Agama Islam Selangor (MAIS) and Bank Muamalat Malaysia Berhad (BMMB) have combined their efforts to develop a cash waqf fund named as Wakaf Muamalat Selangor. All these developments in waqf endeavor involving corporate entities are worth to be analyzed in order to create a new framework of waqf practice. Thus, the paper aims to identify the models of corporate waqf, and highlight the Shariah considerations on this new form of waqf. The study will establish corporate waqf as an independent category of waqf due to its salient characteristics. The novelty of this finding is against the common perception of public who consider corporate waqf as a form of cash waqf. This study suggests corporate waqf as the best form of modern waqf practice based on its vibrant nature and active roles with strong professional participation in its management.

Pengurusan dan pentadbiran masjid di Malaysia adalah terletak di bawah bidang kuasa Majlis Agama Islam Negeri-Negeri (MAIN). Manakala pengurusan dan pentadbiran ekonomi dan kewangan masjid-masjid diurus oleh ahli jawankuasa masjid di bawah seliaan MAIN. Terdapat masjid-masjid yang mempunyai sumber ekonomi yang kukuh yang dijana oleh hasil aset-aset wakaf seperti tanah, bangunan dan peralatan yang disewakan selain kutipan tabung-tabung khas dan am seperti tabung hari Jumaat. Namun di dalam menguruskan dana-dana masjid yang adakalanya mencecah ratusan ribu ringgit, tidak terdapat garis panduan khas Shariah untuk diikuti oleh pihak pentadbiran masjid.  Ini telah menyebabkan terdapat dana-dana masjid yang bernilai tinggi beku tidak dijana dengan sebaiknya. Justeru, objektif utama kajian ini ialah untuk menganalisa fatwa-fatwa yang dikeluarkan oleh badan-badan fatwa samada di dalam (Malaysia) dan luar negara (Brunei) tentang perkara-perkara yang berkaitan dengan pengurusan pendapatan dan perbelanjaan dana-dana masjid. Dengan adanya garis panduan tersebut akan memudahkan pihak pengurusan masjid mentadbir dan mengurus dana-dana yang diperolehi. Artikel ini adalah sebahagian dari hasil penyelidikan yang dijalankan berkaitan pengurusan ekonomi dan kewangan masjid-masjid di Daerah Hulu Langat, Selangor.

dikeluarkan. BMMB adalah merupakan sebuah institusi kewangan Islam pertama di Malaysia yang bekerjasama dengan
Majlis Agama Islam Negeri (MAIN) di dalam mengurus, mengumpul dan melabur dana wakaf di Malaysia. Kerjasama
yang dijalinkan ini membuka suatu dimensi baru di dalam struktur wakaf korporat di Malaysia, terutamanya model
perbankan wakaf korporat. Kertas kerja ini adalah merupakan kajian yang pertama dilakukan terhadap struktur “Wakaf
Selangor Muamalat” semenjak ianya dilancarkan. Dapatan kajian ini diharapkan akan menyemarakkan lagi penglibatan

Buku ini mengandungi hadith-hadith yang terpilih berkaitan dengan pengurusan harta dan perancangan kewangan daripada ketiga-tiga sudut Shariat: aqidah, fiqh dan tasawwuf. Daripada hadith-hadith yang telah dipilih, penulis menjadikan empat puluh (40) hadith sebagai hadith-hadith utama dan selebihnya sebagai hadith-hadith sokongan yang mempunyai kaitan dengan hadith-hadith utama.

Penulis telah cuba sedaya upaya memastikan agar hadith-hadith yang dipilih sebagai hadith-hadith utama adalah berstatus sahih atau sekurang-kurangnya hasan. Bagi hadith-hadith sokongan, hadith-hadith da’if juga dipilih selagi mana ia tidak mengandungi perkara-perkara aqidah atau elemen halal dan haram.

Sebagai tambahan faedah, penulis juga meletakkan ayat-ayat al-Quran dan kata-kata para ulama’, khususnya para sahabat RA , di tajuk-tajuk yang relevan.

Masjid adalah merupakan syiar atau mercu tanda keagungan agama Islam. Rasulullah SAW telah meletakkan peranan masjid sebagai sebuah institusi terpenting bagi umat Islam yang terbukti dengan pembinaan masjid di Quba’ sewaktu di dalam perjalanan menuju ke Madinah dan seterusnya pembangunan Masjid Nabawi di Madinah. Pembentukan negara Islam Madinah adalah berpaksikan kepada peranan besar yang diletakkan kepada institusi masjid yang tidak hanya sebagai pusat beribadat dan menimba ilmu pengetahuan sahaja, bahkan ianya melangkaui sebagai pusat perbendaharaan negara dan pertemuan dengan delegasi-delegasi luar. Sudah tentulah satu bentuk pengurusan yang sistematik seperti pengurusan kewangan dan sumber manusia telah dilaksanakan bagi memastikan segala peranan dan tanggungjawab yang diamanahkan tersebut dapat dilakukan secara mantap dan berkesan.
Justeru, buku ini akan membincangkan dua aspek penting pengurusan kewangan masjid iaitu pendapatan dan perbelanjaan dana masjid. Satu model kewangan masjid iaitu Model Imarah MasjidTM telah dibangunkan yang menerangkan secara terperinci tatacara pengurusan pendapatan dan perbelanjaan masjid. Aspek pendapatan masjid telah dibahagikan kepada dua kategori utama iaitu pendapatan yang diperolehi dari dana umum dan pendapatan yang diperolehi dari dana khusus. This book is designed to be the introductory part of Fiqh al-Muamalat by discussing the most basic concepts that should be learned before the discussion of Muamalat contracts starts.

The discussion begins with the explanation of the Fiqh al-Muamalat terms, its position in the Shariah and the Shariah doctrines related to the Muamalat matters.

Then, it discusses the four introductory theories of Fiqh al-Muamalat in details. The four theories are:
(i) The theory of legal capacity (al-ahliyyah),
(ii) The theory of property (al-mal),
(iii) The theory of ownership (al-milkiyyah) and
(iv) The theory of contract (al-aqd).

These four theories shall enlighten the reader on the required legal capacity that must be occupied by the contracting parties, the nature of property from Islamic perspective, the relationship between a property and its owner as well as the framework of Shariah-compliant contract.
