CONCEPT DEVELOPMENT
• Ensure Client's requirements, examine site constraints & potential &
prepare a design brief for Client's approval
• Prepare report - Site evaluation & analysis and Impact of existing and/ or
proposed development on its immediate environs
• Prepare drawings & documents - Detailed survey & soil investigation at
Project site
• Furnish report on measures - Mitigate the adverse impact of existing and
/or proposed development on immediate environs
• Prepare Conceptual designs wrt requirements given & prepare rough
estimate of cost on area basis
Schedule of Services - Stage 2 & 3
PRELIMINARY DESIGN AND DRAWINGS
• Modify the conceptual designs - required changes
• Prepare preliminary drawings + sketches + study model, etc., - Client's
approval with preliminary estimate of cost on area basis
DRAWINGS FOR CLIENT'S/ STATUTORY APPROVALS
• Prepare drawings necessary for Client's/ statutory approvals
• Ensure compliance with Codes, Standards & Legislation assisting
Client in obtaining the statutory approvals as required
Schedule of Services - Stage 4 & 5
WORKING DRAWINGS AND TENDER DOCUMENTS
Prepare Working drawings + Specifications + Schedule of quantities - Estimate of
Cost & Tender documents including Code of practice covering aspects like
• Mode of measurement
• Method of payments
• Quality control procedures on materials & works and
• Other conditions of contract

APPOINTMENT OF CONTRACTORS
Invite, receive & analyse tenders - Advise Client on appointment of contractors
Schedule of Services - Stage 6
CONSTRUCTION
Prepare & Issue - Working drawings & details for proper execution of works
during construction with the following-

• Approve samples of various elements & components


• Check & approve Shop drawings submitted by the contractor/ vendors.
• Site visits at agreed intervals - Inspect and evaluate the Construction and-
• Clarify any decision
• Offer interpretation - Drawings/Specifications
• Attend conferences & meetings to ensure project is proceeding in
accordance with conditions of contract &
• Client informed & give necessary advice on actions

CONSTRUCTION
• Daily supervision –
▪ Construction Manager (Clerk of Works/ Site Supervisor/
Construction Management Agency in case of a large and complex
project- under the guidance & direction of the Architect &
appointed and paid by the Client
▪ Ensure work at site proceeds in accordance with the contract
documents/drawings
▪ Exercise time and quality controls

• Issue Certificate of virtual Completion of works

COMPLETION
•Prepare & submit completion reports and drawings for the
project as required
•Assist the Client in obtaining "Completion/ Occupancy
Certificate" from Statutory authorities, wherever required
•Issue 2 sets of built drawings including services and structures
Schedule of Payment
PROFESSIONAL FEE
•Architect shall be paid professional fee and other
charges in accordance with the Scale of Charges
•Any tax levied by law - Service tax, etc. contingent to
professional services rendered by the Architect -
Payable by the Client, additional to the gross fees
charged by the Architect

consistent with the work done + other charges and
reimbursable expenses as agreed upon -

Effecting Payment to the Architect
PROFESSIONAL FEE
Fee computed on the actual cost of works on completion
The payment due to the Architect to be computed on the following basis:

Retainer : On rough estimate of cost


At Stage 1 : On rough estimate of cost
At Stages 2 to 4 : On preliminary estimate of cost
At Stages 5 to 6b : Accepted tender cost
At Stage 7 : Actual total cost
Effecting Payment to the Architect
Progressive payments shall be made at any of the above stages - Quantum of work
done during that stage, as per mutual agreement
No deductions from fee of the Architect - Penalty, Liquidated damages, Part rates or
other sums withheld from payment/recovered from contractors/ suppliers
Work is executed wholly or in part with old materials/ labour/ carriage is provided by
the Client - Fees shall be calculated as work executed wholly by the contractor
supplying all labour and new materials
Actual cost of the completed works shall include
- Cost of execution of assigned works
- Cost of equipment & machinery such as Transformers, DG Sets, Sub-stations, Lifts,
Air Conditioning Machines, Pumps & Motors, Water and Sewage Treatment Plant,
etc.,
- But excluding the cost of land
Effecting Payment to the Architect
DOCUMENTATION AND COMMUNICATION CHARGES
10% of the professional fee payable to the Architect at all stages, in addition to
Professional fee

REIMBURSABLE EXPENSES
Site visits by the Architect/ Consultant are also reimbursable by the Client-
• Actual cost of travel (to & fro), boarding & lodging and local transport for any visit
made by his staff to the site/ Other locations as may be necessary in connection
with the execution of work / performance of duties as per agreement
• Cost of presentation models, computer simulation, presentation drawings, etc.,
prepared at the instance of the Client for purposes other than the Design and
execution of the project
Clients Role & Responsibilities
• Detailed requirements of the project
• Property lease/ ownership documents
• Site plan - necessary topographical and service requirement information. In case of
non-availability - Client shall arrange for the survey/ collection of necessary information and pay
for the same
• Reports on soil conditions and test as required by the Architect or pay for the preparation of the
same
• Specific conditions/ Statutory stipulations/ Codes of Practice/Schedule of rates, etc., desired to be
followed
• Pay all the fees, levies, security deposits and expenses in respect of statutory sanction
• Effect to the professional advice of the Architect and cause no changes in the drawings and
documents without the consent of the Architect
• Honour Architect's bills within one month of its submission
• Appoint a Construction Manager (Clerk of Works/ Site Supervisor/ Construction Management
Agency - large & complex project) as per the Architect's advice
Architect’s Execution Responsibilities
• Architect shall keep the Client informed about the progress of work in
his office
• Shall appoint specialised consultants as agreed with the Client, if
necessary
• Shall be responsible for the direction & integration of the consultants
work. The consultants shall be fully responsible for the calculations, the
detailed design and periodic inspection & evaluation of the work
entrusted to them. Upon request, Architect shall make available the
design calculations
• Will advise the Client on the Time Schedule (Bar Chart/PERT/ CPM
Network) prepared by the contractors for the completion of work as
required
Architect’s Execution Responsibilities
• Shall supply to the Client upto six sets of drawings at different stages
for Free
• Shall not make any deviations, alterations or omissions from the
approved drawings, involving financial implications without prior
consent of the Client
• Any professional services by the Architect for the Client after the
agreed project completion period shall be compensated on mutually
agreed terms
• Shall exercise all reasonable skill, care & diligence in the discharge of
his duties & shall exercise such general superintendence and inspection
as per the Conditions of Contract
Architect’s Execution Responsibilities
• Any revision in the approved drawings, tenders and documents,
required by the Client - additional services by the Architect & paid for
@ 50% of the fee prescribed for the relevant stage(s)
• No change shall be made in the approved drawings and specifications
at site without the consent of the Architect
• Any curtailment of the professional services, beyond Stage 2, shall
make it obligatory for the client to pay at least 20% of the fee for the
remaining Stage(s) of the curtailed work/ Services
• Architect in agreement with the Client to prepare a Time Schedule in
respect of various services to be rendered & discharge of Client's obligations
Architect’s Execution Rights
INDEMNIFICATION
If a Claim/ Suit is brought against the Architect/Consultants by any third
party for damages from
• Personal injury or property damage caused wholly by the client, or
• Anyone employed by the client, or
• Anyone for whose acts the client may be held responsible,
Client shall indemnify the Architect and fully reimburse any loss, damage
or expenses, including the attorney’s fees, - Architect may incur in
connection
Architect’s Execution Rights
OWNERSHIP OF COPYRIGHT
• Architectural design is an intellectual property of the Architect
• Drawings, specifications, documents & models as instruments of service - Property
of the Architect whether the intended project is executed or not
• Client shall retain copies of the Architect's models, drawings, specifications and
other documents for his information & use in connection with the project ONLY
• Cannot be used for any other project by the Client/ Architect / any other person,
except for the repetition as stipulated in the Scale of Charges

TERMINATION OF AGREEMENT
• Termination by either one giving a written notice of not less than 30 days
• Terminated party should either fail substantially to perform her/ his part of
responsibilities/duties
• Failure is not caused by the one initiating the termination
• If termination not related, directly/ indirectly to any act, omission, neglect or
default by Architect – He/ She entitled to professional fees as stipulated under
Clause 4 & Clause 9
• If Architect's firm closing business/ Client having terminated the agreement –
Client’s right to employ another Architect to complete the work, after making
payment to the previous architect's firm

INTERPRETATION
In condition of ambiguity/difficulty in interpretation of the Conditions of
Engagement & Scale of Charges - Interpretation of COA shall be final &
binding on both Architect & Client

ARBITRATION

• All disputes arising between Client & Architect under "Conditions of Engagement
and Scale of Charges" referred for arbitration to the Council of Architecture
• Arbitrator appointed by the President, Council of Architecture
• Conducted as per the provisions of the Arbitration and Conciliation Act, 1996
• Decision & award of the Arbitrator shall be final and binding on the Architect and
the Client

• Main purpose to give the promoter of competition the choice of the
best available design
• Jury or assessor with his/ her best knowledge selects the best design &
gives participants the best deal
• Guideline of Architectural competition lays emphasis on the mandatory
requirement of Assessor his/her qualification
• Every competitor competes on same conditions, same information and
within the same time limit
• Entries are judged only by those who are qualified to read, to interpret
and to judge, if the design selected meets the promoters requirement

• Students of recognized Institutions
• Promoter/ Assessor/ any Associates/ Partners/ Employees/ Staff
from the institution cannot be the sole assessor

Conditions should clearly explain the following-

• Nature of problem to be solved
• Mandatory requirements for competitors
• Number + Scale + Size of drawings
• Size of documents & models
• Form of estimates and Amount of prize

3 REGISTRATION OF PROCEDURE
• Competitor will request the promoter to send registration form.
• Registration is acknowledged once necessary documents, requisit
deposit and other items has been sent
• Competition brochure to contain
following information - d) Names of Assessor(s)
a) Name of Promoter(s) e) Eligibility of competitors
b) Purpose and nature of competition f) Time schedule of competition
c) Number of prizes, prize amounts & g) Procedure of registration, last
honorarium to be paid date and time etc

4 BOARD OF ASSESSORS

• Consists of group of Architects, Assessors, Promoter(s), Employee(s) of


Promoter, Consultants etc
• Architects should be the majority in number
• No. of Assessors appointed by Promoter should not be more than 2
• Assessor to be paid prescribed Honorarium & out of pocket expense

5 PRIZE, HONORARIA & MENTIONS
• Competition announcement to mention No. of prizes, Amount of
honorarium & Prize money
• Total Prize money will be about 1% of the estimated project cost

6 COPYRIGHT & RIGHT OF OWNERSHIP


• Each competitor will have the copyright to reproduce his own design
• Promoter can reproduce the winning designs in his in-house publication
& brochure
• He/ She cannot exploit it commercially without any agreement or
approval from the winning competitor

7 EXHIBITION OF ENTRIES
• All competition entries including those rejected by Board of Assessors
will be displayed at the venue for one week along with the report of
Assessor
• Exhibition will be open to public without any charge
• Intimation of date & venue will be sent to all the participants
