TENANCY AGREEMENT

This Tenancy Agreement made on this 30TH day of September, 2024(Two


thousand Twenty four) A.D.

BETWEEN
LAHARI SEN, Daughter of Late AJIT KUMAR SEN (Age around 67 years) presently,
by faith: Hinduism, by Nationality – Indian, residing at Holding No. - 121,
Kalibari Road, P.O. - New Barrackpur, P.S. – New Barrackpur, Barrackpur – II,
New Barrackpur (M), Ward No. – 3, District - North 24 Parganas, Kolkata -
700131, West Bengal, India, hereinafter referred to as the LANDLORD (which
term and expression shall unless excluded by or repugnant to the subject or
context be deemed to mean and include his representative, heirs, successors,
administrators, taxpayer, executors and assigns) of the ONE PART.

AND
SMT. SUSMITA HAZRA, wife of Sri Amit Kumar Hazra (age around 37 years)
resident of PRAMODA RESIDENCY, 3RD FLOOR, FLAT 3D, SUBHASH PALLY, P.S.
- MADHYAMGRAM, MADHYAMGRAM, KOLKATA - 700130 do hereby solemnly
affirm & declare as follows: - address a hereinafter referred to as the TENANT
(which term and expression shall unless excluded by or repugnant to the
subject or context be deemed to mean and include its/his representatives,
heirs, successors, administrators, executors and assigns) of the OTHER PART.

WHEREAS the Landlord herein possessed a SHOP ROOM, measuring carpet area 200
(Two Hundred) Square feet approx. a little more, on the Ground Floor at Holding No. -
121. Kalibari Road, P.O. - New Barrackpur, P.S. – New Barrackpur,
Barrackpur – II, New Barrackpur (M), Ward No.-03, District - North 24
Parganas, Kolkata - 700131, West Bengal, India and decided to the let on Rent
the said SHOP ROOM the above-mentioned address to the License herein for a period of
108 (One Hundred Eight) months i.e. from 30/09/2024 to 29/09/2033 more fully
described and written hereunder on the following terms and conditions agreed both by and
between the parties hereto:

TERMS SETTLED AND AGREED BY AND BETWEEN THE PARTIES ARE AS


FOLLOWS:-

1. Landlord hereby granted Tenancy to the Tenant to use and occupy the aforesaid the
SHOP ROOM of the above-mentioned address for retail medicine shop Davaindia
Generic Pharmacy or any other retail or wholesale medicine shop with the any other
name and style represented by Mrs. Susmita Hazra, Proprietor or any other productive
legal Business purposes only none else.

2. The period of this Agreement is for a period of 108 (One Hundred Eight) months
i.e. from 30/09/2024 to 29/09/2033 and the period is the essence of this agreement
which will be automatically terminated after the expiry of the said period unless the
Landlord in writing extends the same, the agreement is renewable with the written
consent of both parties and may increase the fees as per discretion of the Landlord.

3. The monthly Rent of the afore said SHOP ROOM is of the above-mentioned
address have been settled at monthly Rs. 8,000/- (Rupees Eight Thousand Only)
which shall be paid by the Tenant within the 10th day of every current month to
the Landlord. And the Tenant will pay an amount of Rs.48,000.00 (Rupees Forty
Eight Thousand only) paid as Security deposit which will be returned back or
adjusted after expiry of Tenancy without interest. After expiry of Tenancy, the
Landlord will return the security deposit to the Tenant before handover the shop
room and will collect the written acknowledgement.

4. The Rent will be increased by 10% in every 3 years.

5. The Tenant shall be exclusively liable and responsible for terms and conditions laid
down in this agreement of all sorts and natures.
6. The Tenant shall not resort to nuisance and annoyance of any sort during the tenure
of the Tenancy.

7. That the Landlord will provide an Electric Meter to the Tenant premises and the
Tenant will pay the Electric Bill as per meter reading regularly. Tenant may avail
the own electric commercial meter from Electricity Board or any other Competent
authority. If the Tenant want to avail so, Landlord will provide the necessary NOC
and required papers.

8. The Tenant shall keep the said SHOP ROOM of above-mentioned address in clean,
sanitary and fit condition and will not make any material alteration or addition in or
to the said premises nor hand it over to anyone else without prior permission in
writing from Landlord and cannot give any let or sub-let and cannot do any illegal
activities and illegal business and also cannot keep any inflammable goods.

9. Only the Tenant will have the option to determine or terminate this agreement
before expiry by giving six months Notice from Tenant side to Landlord. If the
Tenant will determine or terminate this agreement before expiry the Landlord will
refund back the Security Deposit and advance rent amount to the Tenant before hand
over the said SHOP ROOM to the Landlord i.e. before completion notice period of
six months.

10. The Tenancy may be renewed for further period if so requested and required by the
Tenant, provided the Landlord does not require the said Part of Premises of the
above noted address and also on satisfaction of the past performance of the Tenant.

11. It is hereby further agreed by the Tenant to maintain peace and congenial relation
with the Landlord and not to do anything which is detrimental to the interest of the
Landlord nor convert the character of this Tenancy and bind himself to handover
peaceful vacant possession of the aforesaid Part of Premises without any waste and
damage to the Landlord on date of expire of the Tenancy.

12. This Tenancy will stand to be terminated on failure to pay the Rent agreed by the
Tenant for consecutive Three months and the Tenant will remain responsible to
compensate for any loss or damage sustained by the Landlord for any act of the
Tenant the Tenancy will be automatically vacated.
13. That the Landlord will provide the facility of Urinal, Latrine and water supply for
the employees of the shop, outside of the shop premises.

14. Any disputes or differences whatsoever arising between the parties relating to the
Tenancy agreement shall be resolved amicably by both the parties.

IN WITNESS WHEREOF the parties hereto have set and subscribed their respective
hands and put their signature on the day, month and year first above written.
