Abstract:
Dalits carry a historic sociological agency of ‘contempt and discrimination’ against their ‘self’ in
the broader caste society. Such look down prejudiced chauvinism against their self and social
identity gets manifested even at the cost of violating legal and constitutional measures. The
present paper focuses on one such prominent sociological, legal and constitutional spirit
violation discourse. Though Dalits appear to have protective measures granted by the State, in
reality, such measures are selectively extended and curtailed. In this respect, selective extension
of legal provisions to Hindu Dalits and Christian Dalits is a noted phenomenon. As a result, the
present paper highlights how Christian Dalits are not covered under the Prevention of Atrocities
Act and why they should be covered under the same legal and constitutional
provisions. Methodologically, the paper engages in secondary data synthesis on the lines of
normative, legal and constitutional modes of critical argumentations.
Keywords: Dalits, Christian Dalits, Atrocities, Law, Constitution.

ABOUT THE
SEMINAR
understanding law and society in india
Society consists of human beings as Aristotle rightly said man is a
social animal. To maintain some sort of discipline among its
members, societies prepare rules and everyone has to obey
those. Culture, folkways, customs, mores, and conventions are
some of the best examples of regulating human behaviour in
society. Change is the law of nature and society is not exempted
from it. Due to colonization in India, there was evidence of social
change especially among educated Indians. After India gained
independence and became the largest democratic country in the
world, one could find drastic changes in the social, economic,
political, educational, and professional life of Indians.
Globalization encourages transnational migration of human
beings for better job opportunities, in addition to the free-flow of
goods and services around the world. In this way, the division of
labour becomes complex and heterogeneity is found not only in
terms of vocations but also ethnicity. When human interaction
increases with the members of other societies, society is more
prone to hearing the voices of diverse communities of the
society. Ultimately, legislatures prepare new bills/amendments
and put them on the table for discussion in both houses to
convert them into acts/laws. Once a law is prepared, each citizen
has to obey it. Any citizen, who seeks justice in any case, can
knock on the doors of courts.
