The Applicant bank declares that the cause of action arose at SBI, Sriram Nagar
branch, Eluru, West Godavari District when the defendant has made an application on
15-06-2016 for sanction of Home loan of Rs.24,00,000.00 and the same was
sanctioned on 20-06-2016 and executed the relative documents evidencing the loan
transaction on all respective dates and executed Revival letters on 10-06-2019 and 04-
03-2022 and the defendant has deposited his title deed with the applicant bank by
executing Letter of Confirmation for creation of mortgage by Deposit of title deeds on
…-08-2016 and the application claim is for more than Rs.20.00 Lakhs. Further the
defendant is residing within the territorial jurisdiction of the Hon'ble Tribunal, hence this
Tribunal has both pecuniary and territorial jurisdiction to adjudicate this application.

4. LIMITATION:
That the applicant Bank further declares that the application is within the period of
limitation prescribed under Section-24 of the Recovery of Debts due to Bank and
Financial Institutions Act, 1993. In respect of loan facilities sanctioned and granted
by the Applicant bank’s Sriram Nagar branch, Eluru, West Godavari District when
the defendant has made an application on 15-06-2016 for sanction of Home loan of
Rs.24,00,000.00 and the same was sanctioned on 20-06-2016 and executed the
relative documents evidencing the loan transaction on all respective dates and
executed Revival letters on 10-06-2019 and 04-03-2022 and executed the relative
documents evidencing the loan transaction on all respective dates and the
defendant has deposited his title deed with the applicant bank by executing Letter
of Confirmation for creation of mortgage by Deposit of title deeds with the applicant
bank on -08-2016; subsequently the defendant failed to repay the loan as per the
terms and conditions of sanction as well as the documents executed by him; on all
days when the applicant bank addressed letters demanding to regularize the loan
account of the defendant, but the defendant failed to regularize the loan accounts;
thus the loan accounts of the defendant was classified as NPA on 14-06-2023;
when the applicant bank got issued registered lawyer’s notice on 04-04-2025
demanding to repay the loan outstanding but there is no response from the
defendant; hence this application is within the limitation in terms of Section-24 of
Recovery of Debts due to Banks and Financial Institutions Act.

The Applicant bank further submits that it has established Stressed Assets
Resolution/Recovery Centers/Braches at several places all over India for resolution
of Non-performing Assets (NPA) and pending litigation accounts for administration
purposes and one such Center/Branch is established at Visakhapatnam. The
present file has been migrated from SBI, Sriram Nagar branch, Eluru, West
Godavari District to this Stressed Assets Recovery Branch for pursuing litigation.
Hence, the applicant branch is entitled to file the application as per the provisions of
the State Bank of India Act and regulations there under.
The defendant has approached the applicant’s bank Sriram Nagar branch, Eluru,
West Godavari District and made an application on 15-06-2016 for sanction of
Home loan of Rs.24,00,000.00 and the same was sanctioned on 20-06-2016 and
executed the relative documents evidencing the loan transaction on all respective
dates and executed Revival letters on 10-06-2019 and 04-03-2022 and the
defendant has deposited his title deed with the applicant bank by executing Letter
of Confirmation for creation of mortgage by Deposit of title deeds on …-08-2016
with the applicant bank and executed necessary loan documents in favour of the
applicant bank, which is more fully described in the application schedule.

COLLATERAL SECURITY:
-Nil-
01). The defendant approached the applicant’s bank Sriram Nagar branch, Eluru,
West Godavari District and made an application on 15-06-2016 for sanction of
Home loan of Rs.24,00,000.00 and the same was sanctioned vide its Arrangement
letter dt. dt.20-06-2016 which is acknowledged by defendant. The Application for
Home loan and Arrangement Letter are filed as Document Nos.1 and 2. While
availing the above loan facility of Rs.24,00,000.00, the defendant has executed the
following documents on 20-06-2016 in favor of Applicant’s branch, Sriram Nagar
branch, Eluru, West Godavari District.

Interest on the loan will be charged at .25% above Base Rate which is currently
9.15% p.a. (the current effective rate of interest being 9.4% p.a) with monthly rests.
The rate of interest is subject to revision from time to time due to (i) changes in
Base Rate or (ii) revision even without change in Base Rate and you shall be
deemed to have notice of changes in the rate of interest whenever the changes in
Base Rate or increase in interest rates where there is no change in Base Rate are
either displayed on the notice board of the branch or published in newspapers or
made through entries of the interest rate charged in the passbook/statement of
account furnishes to you and you are liabe to pay such revised rate of interest. The
Bank has the option to reduce or increase the EMI or extend the repayment period
or both consequent upon revision in interest rate. In the event of a default in
payment or any irregularity in the account, the Bank reserves the right to levy a
higher rate of interest as it deems fit.
The applicant bank has, in pursuance of the sanctions of the above referred loans
has disbursed the loan amounts to the defendant and the same was availed and
utilized by the defendant.

The defendant has committed default in repayment as per the terms and conditions
of the sanctions. The defendant has failed to keep up to the stipulations, terms and
conditions undertaken for repayment of the loan and as a result of that the loan
account has become highly irregular. The repayment schedules agreed upon were
not adhered to. It is respectfully submitted that despite of repeated oral requests
and demands made by the Applicant Bank the defendant was reluctant, to repay
the debt, while acknowledging the debt due to the applicant bank. It is submitted
that the unscrupulous attitude of the defendant has put the applicant Bank to untold
financial embarrassment. It is submitted that vexed with the attitude of the
defendants, the applicant bank has addressed several letters, but did not respond
and finally the loan account has become NPA on 14-06-2023 and the applicant
bank has issued registered Lawyer’s notice to the defendants on 04-04-2025, but
the defendant did not respond. The registered Lawyer’s notices together with postal
receipt and acknowledgement/returned cover are filed as Document Nos.10 and
11.
5 (8) For the loans granted by the applicant bank to the defendant and the
repayments made by the defendant, the accounts is being maintained by the
Applicant Bank in the ordinary course of business and the account copy certified
under the Banker’s Books of Evidence Act is filed herewith as Document No.12.
As per the said account, the defendant is due and is liable to pay an amount of
Rs.26,65,586.78Ps in Home loan (35896703300) with interest @ 9.00% p.a. The
account has been classified as NPA on 14-06-2023 and the applicant bank is
entitled to claim interest at contractual rate on the outstanding amounts from 30-06-
2023 till the date of realization of entire debt. As on 05-04-2025 a total debt of
Rs.26,65,586.78Ps (Rupees Twenty Six Lakhs Sixty Five Thousand Five
Hundred and Eighty Six and Seventy Eight Paisa only) is due and payable by
the defendant. The said amount is inclusive of unapplied interest, which interest
has been calculated by the Bank as per the terms of the loan.

Further, the applicant Bank is entitled to claim the said interest in Home loan and
other loan documents and as per covenants therein the applicant Bank is entitled to
capitalize the interest payable by the defendant as to amalgamate with the principle
amount. The interest calculation is filed herewith as Document No.13.
5 (9) As the defendant has failed to repay the loan out-standings, the Applicant is
forced to approach this Honourable Tribunal to recover the money due. Hence, the
Applicant Bank submits that the application fee, Advocate fee and other incidental
costs, charges incurred for translating the title deeds in Telugu Language into
English etc., form part of debt and recoverable from the defendants.
5 (10) The Applicant Bank submits that the interest has been charged as per the
terms of the Agreement and in accordance with RBI guidelines and as per the
norms of the Bank from time to time. The statement of accounts showing all the
transactions duly certified under Banker’s Books of Evidence Act is filed herewith. It
is also submitted that the applicant bank is entitled to claim and recover interest
thereon at contractual rate and the applicant bank is also entitled to claim future
interest as per the contractual rate from the date of filing of O.A till the date of full
and final realization.
RELIEF SOUGHT:
06. In view of the facts mentioned in the paragraphs 5 above, the Applicant bank
prays for the following reliefs.

b) To pass an order directing the defendant to pay the amounts mentioned above
within the time fixed by the Honourable Tribunal failing which order for sale of
schedule mentioned property to realize the claim amount of Rs.26,65,586.78Ps
(Rupees Twenty Six Lakhs Sixty Five Thousand Five Hundred and Eighty Six
and Seventy Eight Paisa only) being debt due under the loan facilities granted to
the defendants, and to pay the sale proceeds thereof, to the applicant bank and
issue Recovery Certificate accordingly.
c) To issue a RECOVERY CERTIFICATE to the Recovery Officer directing him to
recover the amount of Debt as prayed in reliefs A & B by applying the modes of
recovery mentioned in Section 25 to 29 of Recovery of Debts due to Banks and
Financial Institutions Act, 1993, and to pay the same to the applicant bank.
e) To grant such other relief or reliefs as the Honourable Tribunal may deems fit
and proper in the circumstances of the case.
7. INTERIM ORDER:
The Applicant prays that the Hon’ble Tribunal may be pleased to grant the following
Interim Relief, pending disposal of the O.A:-
(a) The Defendants, their servants and agents be restrained by an order/injunction
of this Hon’ble Tribunal from any way dealing with or disposing off or encumbering
the mortgaged property or any part thereof or any right, title or interest therein.
(b) An ad-interim ex-parte injunction order may be issued directing the Defendants
to make a rule and faithful disclosure of all their other immovable properties,
movable properties, bank lockers, fixed deposits, bank accounts and all such other
business in which the Defendant has any interest on oath.

(c) And upon such disclosure to pass appropriate injunction order restraining the
Defendants transferring, alienating, encumbering parting with possession and/or in
any manner dealing with such disclosed assets.
(d) To appoint Advocate Commissioner to take possession and sale of the assets
of the Defendants.
(e) To direct the Defendants to surrender their passport before the DRT and seek
clearance of DRT to travel abroad Under Section 22(2) (h) of RDDBFI Act, Read
with Rule 18 of DRT Rules.
8. Whether the subject matter is pending in any court:
The applicant declares that the matter regarding which this application has been
made is not pending before any court of Law or Authority or Tribunal.

State Bank of India, Sriram Nagar branch, Eluru, West Godavari District, where the

Banking solutions.
The branch uses core banking solutions soft ware for conducting the banking
business. The data is stores at Central data Center, Central Business District,
Belapur, Navi Mumbai, Maharashtra state. Core banking solutions Software works
on Unix platform.
i)      Use of the system is based on the rights and privileges granted to each
authorized user in the system.
ii)    Transactions requiring authorizations entered by one user in the system are
cleared/checked by another authorized official.
iii)   All changes in customers profiles are entered using appropriate menus with
appropriate control for the amendments. Issue of cheque books, recording of stop
instructions, interest rates are also similarly controlled.
iv) The daily transactions are printed in the Day Book for all accounts and checked
against relative vouchers/statements.
i) The back up of all data is stored at central data center, Belapur and is labeled
internally and externally to identify the contents of the back up.
i) Authorized users can also only log into the system using their passwords during
their working hours.

F) Any other factor which will vouch for the integrity and accuracy of the
system are as follows:-
i) Appropriate anti Virus software is used for all its servers and systems as per the
policy of the bank. To take care of power failure or erratic power supply, UPS
Systems are installed at the branch. The Computer systems including printers and
other systems are covered by appropriate Annual Maintenance Contracts for
carrying out repairs and maintenance work to keep the systems running efficiency
and effectively.
