Barangay Ordinance No. 2-2024

“AN ORDINANCE DECLARING IT’S UNLAWFUL FOR ANY PERSON TO MAKE OR CAUSE
EXCESSIVE, UNNECESSARY, UNSUALLY LOUD SOUNDS FROM VIDEOKE/KARAOKE MACHINES,
OTHER FORMS OF SOUND SYSTEMS AND THE USE OF MODIFFIED MUFFLER OR NOISY PIPES OF
MOTOR VEHICLES THAT CAN CAUSE PUBLIC DISTURBANCE”

WHEREAS, as provided in RA 7160 of the Local Government Code Chapter 4 Section391 states that the
Sangguniang Barangay as the Legislative body of the barangay shall enact ordinances as may be
necessary to discharge responsibilities conferred upon it by the law or ordinances and to promote the
general welfare of the inhabitants therein;

WHEREAS, Article 26 of the Civil Code partly states that: “Every person shall respect the dignity,
personality, privacy and peace of mind of his neighbors and other persons”;

WHEREAS, the making excessive, unnecessary or unusually loud sounds from videoke/karaoke
machines and other audio/sound systems, public address system and modified mufflers or noisy pipes
from motor vehicles beyond limits and at unacceptable levels during unholy hours causes serious
discomfort and has created numerous complaints and public condemnation;

WHEREAS, the public's health, comfort, convenience, safety, welfare, and prosperity are all negatively
impacted by the protracted, strange, and unnatural sounds that are unreasonable, out of the ordinary,
or too loud.
NOW, THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG BARANGAY OF ANGGAPANG NORTE
ON ITS REGULAR SESSION ASSEMBLED THAT:

Section 1. General Prohibition. It is unlawful for any person to cause, or for any person in
possession of property to allow to originate from the property, sound that is a
public disturbance noise.

Section 2. Definition of Terms. As used in this Ordinance, the following term has its meaning as
follows:

Public disturbance noise - means any noise, sound or signal which unreasonably disturbs the
comfort, peace, or repose of another person or persons.

Karaoke/Videoke - a form of popular entertainment in which individual members of the


public sing along to pre-recorded instrumental versions of popular
songs, the lyrics of which are displayed for the singer on a screen in
sync with the music.
Modified Muffler - a muffler look-a-like but without its silencer component having them
removed/tampered, which results to a loud noise or engine.

Sound System - a set of equipment for the reproduction and amplification of sound.

Section 3. Allowed hours for the use of videoke/karaoke machine and other sound system. The
use of videoke/karaoke machine and other sound system shall only be allowed until 11:00 PM.

Section 4. Prohibited Acts. It shall be unlawful:

4.1 For any person to make, create or maintain any unreasonably loud, disturbing and
unnecessary noise within the Barangay. Noise of such character, intensity or duration as to
be detrimental to the life, health, comfort or repose of an individual is prohibited.

4.2 For any person to used modified mufflers or noisy pipes on motor vehicles that could
cause nuisance to the constituents.

4.3 For any person to operate and use karaoke/videoke or any form of amplified sound
outside of the curfew hours mentioned in Section 4.

4.4 For any person to make or cause excessive, disturbing, unreasonable and unnecessary
sound from videoke/karaoke machine, other forms of sound system and modified muffler
or noisy pipes from motor vehicles in such manner or in such volume intended to annoy the
quiet and comfort of a reasonable person of normal sensitivities in any dwelling or
residence.

Section 5. Exemptions. This ordinance shall provide exemptions during Christmas and New Year’s
celebration.

Section 6. Imposition of fees. Any person who violates the provision of this chapter shall pay the
penalty of fine in the amount of:

2nd Offense – Php 250.00
3rd Offense – Shall be prohibited to claim Barangay Clearances and Certificates for
one (1) month

3rd Offense – Shall be prohibited to claim Barangay Clearances and Certificates for
one (1) month

Section 7. Separability Clause. If for any reason, any provision, or portion or part of this Ordinance
is found to be inconsistent with any law, other provisions or part/s thereof not so affected shall
remain in full force and effect.

Section 8. Repealing Clause. Ordinances, resolutions, and other issuance inconsistent with this
Ordinance are hereby repealed or modified accordingly.

Section 9. Effectivity Clause. This Ordinance shall take effect immediately upon its approval.
