Sub: Clarification on banking provisions ofElectricity (Promoting Renewable Energy Through


Green Energy Open Access) Rules, 2022 – regarding.

Ref:- (1) MoP notification No.- 23/09/2021-R&R dtd.21.08.2024

Respected Sir / Madam,

Ministry Of Power vide Notification dated 06.06.2022 has notified Electricity (Promoting Renewable
Energy through Green Energy Open Access) Rules, 2022. The clause 8 (2) of rules 2022 provides that

“The permitted quantum of banked energy by the Green Open Access consumers shall be at least thirty
percent of the total monthly consumption of electricity from the distribution licensee by the consumers.”

Accordingly, Hon’ble GERC has notified (Terms and Conditions for Green Energy Open Access)
Regulation, 2024 wherein provisions for permitted quantum of banked energy is covered under clause
No 17.6 (vi) as,

“The permitted quantum of banked energy by the green energy open access consumers shall be at least
30% of total consumption of electricity from the distribution licensee by the consumers during the billing
period.”

Representations have been received from various stake holders regarding clarity for “total consumption
of electricity from the distribution licensee” and “Permitted quantum of banking”.

GUVNL have requested for clarifications regarding banking clause to EPD, GoG and Hon’ble GERC.
The Matter was further represented through EPD, GoG to MoP, GoI.

In this regard, Ministry of Power vide notification No. 23/09/2021-R&R dtd.21.08.2024 have issued
following clarification on banking provisions of Electricity (Promoting Renewable Energy Through Green
Energy Open Access) Rules, 2022

“It is hereby clarified that for the purpose of calculating the permissible quantum of banked energy, which
represents a minimum of 30% of total monthly consumption, only the energy directly procured from the
distribution licensee shall be considered. Electricity obtained through Open Access arrangements either

from a third-party supplier or via captive generation utilizing the distribution network, will be excluded
from this calculation.”

In view of the above and as acknowledged by Hon’ble GERC , following method is to be considered for
calculation of banking for the consumers availing Green Energy Open Access under GERC Green
Energy Open Access regulations 2024.

(1) Permitted quantum of banked energy by the green energy open access consumers shall be
maximum upto 30% of total consumption of electricity from the distribution licensee by the
consumers during the billing period with payment of Banking charges as per the prevailing
regulation.

(2) For calculating quantum of total consumption of electricity from the distribution licensee,
Electricity obtained through Open Access arrangements either from a third-party supplier or via
captive generation utilizing the distribution network, shall be excluded.

Illustration of banking energy is as below:

During any billing cycle, in case of the total consumption of electricity from the distribution licensee is
100000 units (Excluding energy from Open Access arrangements either from a third-party supplier or via
captive generation), upto 30000 units shall be allowed for banking. The banked energy above 30000
units shall be treated as inadvertent flow of energy that means If during a billing cycle banked energy is
31000 units, 1000 units shall be treated as inadvertent flow of energy and no credit will be given.

It is kindly requested to instruct concerned officers for further implementation please.
