PURPOSE:

The purpose of the Rohm and Haas Kankakee Polymer Plant Transportation Emergency
Response Plan is to guarantee prompt and effective response in the event of a spill or an
accident during transportation of Rohm and Haas products outside of the Kankakee
Polymer Plant facilities.

POLICY:

Common/Contract carriers (truck and rail) are responsible for their own emergency
response preparedness while transporting Rohm and Haas products. It is Rohm and
Haas policy; however, to be prepared to respond to an accident or spill involving a
common/contract carrier (truck or rail) should they fail to respond fully while transporting
Rohm and Haas products.

Normally, any transportation emergency would not involve the Kankakee Plant. All
shipping papers identify the Home Office 24 hour phone number as the location for
emergency assistance. Therefor, the plant should not typically receive any calls. If the
plant does receive a call, one of the following steps should be taken:

1. Provide technical assistance on the products if you know the answers to the
on-scene caller’s questions. Do not speculate or give directions as to how the
situation can be safely mitigated, as this can only be done with the information
available at the scene. Generally we will be asked for information related to
the hazards (environmental and personnel) associated with the products,
which we should be able to answer. Ensure that the carrier has called
CHEMTREC as that is the 24 hour responding agency for Rohm and Haas.

2. Get the phone number of the on-scene caller and tell him that you will get
them technical assistance immediately. Call the Rohm and Haas emergency
assistance numbers listed below and ask the responder to call the scene. Do
not stop seeking assistance until you have confirmed that a Rohm and Haas
emergency response coordinator will call the scene of the accident and
provide all necessary assistance.

3. In the unlikely event of an incident locally around the plant, the senior plant
manager (or his designee) should go to the scene. Any assistance the plant

can provide needs to be provided, and the Home Office emergency phone
numbers listed above should be called if outside assistance is required.

Rohm and Haas employees are not typically expected to engage in direct accident or spill
mitigation activities, but will provide technical assistance on the products involved.
Employees should cooperate fully with authorized officials and emergency agencies by
providing advice and technical assistance. It is important that all transportation
emergencies be handled properly, and every reasonable attempt be made to satisfy the
callers request for information. Callers asking for company assistance should never be
turned away without assistance

NOTIFICATION REQUIREMENTS

The Rohm and Haas contacts are listed in the order of priority and one individual from the
Operations Contacts and one individual from the technical Contacts should be notified as
soon as possible. Note that only incidents as defined in #SP-7 (Incident Reporting and
Investigation) require reporting to these contacts.

If the incident appears to be improperly handled or if it presents some risk of negatively


affecting Rohm and Haas, then the internal company notification should be made
immediately. Otherwise, the notification can be made the following business day.

RESPONSE PROCEDURE

In the event an employee is notified of a transportation emergency, the following response


measures should be followed:

1. Attempt to get assistance on the call (if possible) from the Home Office emergency
response system. If this is not possible, then pass the call on to either the Safety
Department or the Operations Supervisor. Do not stop working with the site until
either they have the information they need, or some other Rohm and Haas
employee has begun giving assistance to the site.

2. The individual handling the emergency call must first attempt to get the facts
pertinent to the emergency:

a. What is the location of the incident?

b. What mode of transportation is involved?

c. What is the material involved in the incident?

d. What type of incident is this, i.e., what caused the emergency? (motor
vehicle accident, spill, derailment, punctured drum, etc.)

e. At what time did the incident occur?

f. Have any emergency response authorities been contacted?

g. Is emergency response assistance being requested?

h. Has the carrier been called?

The attached "Response Form" has been developed to assist the employee in
documenting the discussion for any transportation emergency. This form must be
filled out for all calls received and the original submitted to the EHS Manager within
24 hours after the incident.

2. If the caller requests product hazard information, read the information listed on
Material Safety Data Sheet. If they have a telefax machine, offer to transmit a copy
of the MSDS by "FAX".

3. If no emergency response assistance is requested, the extent of plant involvement


is limited to providing information as requested and completing the necessary
company (verbal) reporting requirements

4. Submit to the EHS Manager the report on the incident during the first available
dayshift. The EHS Manager will then fill out the proper loss reporting forms and
submit them to the appropriate internal company personnel.
