ORDINANCE NO. 01
SERIES OF 2024

AN ORDINANCE REQUIRING EVERY HOUSEHOLD OF THE BARANGAY


TO ATTEND AT LEAST ONE REPRESENTATIVE EVERY HOUSEHOLD,
DURING THE CONDUCT OF BARANGAY ASSEMBLY OF BARANGAY
LACTUDAN, CAGWAIT, SURIGAO DEL SUR.

Be it ordained by all members of the Sangguniang Barangay of Barangay
Lactudan, Cagwait, Surigao del sur.in session assembled that;

WHEREAS, the Barangay Assembly is a vital avenue for fostering


community engagement, participation, and discourse;
WHEREAS, the active involvement of every household in the Barangay
Assembly promotes a sense of unity, cooperation, and shared responsibility;

WHEREAS, pursuant to the Republic Act No. 7160 Section 397 otherwise
known as Local Government Code of 1991, that mandates that the Barangay
Assembly shall meet at least twice a year, to hear and discuss the semestral

report of the Barangay concerning its activities and finances as well as problems
affecting the Barangay.
WHEREAS, Barangay Official observed that many of the barangay
constituents of this Barangay Lactudan ignores Bandillo for Barangay Assembly.

WHEREAS, one of the bonafide household member is he/she is an actual


resident of the barangay for at least six (6) months stayed in the barangay and at
least fifteen (15) year of age or over are mandated to attend Barangay Assembly
every time such meeting are being called.

NOW, THEREFORE, BE IT ORDAINED, by the Sangguniang Barangay of


Lactudan, Cagwait, Surigao del Sur, in session assembled, that:

SECTION 1: Title
It is hereby declared a policy of Barangay Lactudan known as to mandate
every households of Barangay at least one (1) representative per household
to attend the conduct of Barangay Assembly.

SECTION 2: Purpose
The purpose of this ordinance is to ensure the active participation of every
household in the Barangay Assembly, thereby enhancing community
awareness, collaboration, and democratic governance within Barangay
Lactudan. And all concern individuals are hereby enjoined to extend their
utmost cooperation for the successful implementation of this ordinance.

SECTION 3: Definition Of Terms


For the purpose of this ordinance, the following terms shall be defined as:

1. Barangay Assembly: A gathering of members of a barangay to


discuss and address issues pertinent to the community's welfare and
development.
2. Household: A group of individuals living together in a dwelling unit,
sharing common living arrangements and facilities.
3. Representative: An individual at least 15 years of age chosen or
appointed in a household to attend and participate in the Barangay
Assembly on their behalf.

SECTION 4: Coverage
This ordinance applies to all households within the territorial jurisdiction of
Barangay Lactudan, Cagwait, Surigao del Sur.

SECTION 5: Exemption
Only with valid reasons, like emergencies that all household members are
also out of town.

SECTION 6: Penalty Clause


Failure to attend this activity shall have a penalty of P500.00 per barangay
assembly meeting. and shall be imposed to every household no payment of
penalty, no issuance of Barangay Clearance or Certifications to all household
members per Barangay Assembly or shall render the community service of One
(1) day.

SECTION 6: Effectivity
This ordinance shall take effect upon its approval of the Sangguniang Bayan
of the Municipality of Cagwait, Surigao del Sur.

ENACTED AND UNANIMOUSLY APPROVED this 08TH day of APRIL,


2024 at Barangay Lactudan, Cagwait, Surigao del Sur, Philippines.

SECTION 1: Title
It is hereby declared a policy of Barangay Lactudan known as to mandate
every households of Barangay at least one (1) representative per household
to attend the conduct of Barangay Assembly.

(This ordinance shall be known as the "Barangay Assembly Attendance


Ordinance of Barangay Lactudan.")

SECTION 2: Purpose
The purpose of this ordinance is to ensure the active participation of every
household in the Barangay Assembly, thereby enhancing community
awareness, collaboration, and democratic governance within Barangay
Lactudan.

SECTION 3: Coverage
This ordinance applies to all households within the territorial jurisdiction of
Barangay Lactudan, Cagwait, Surigao del Sur.

SECTION 4: Mandatory Attendance


(a) Every household in Barangay Lactudan is required to send at least one
representative to attend the Barangay Assembly.

(b) The Barangay Assembly shall be conducted at least twice a year, in


accordance with the guidelines set by the Sangguniang Barangay.

SECTION 5: Exemption
Only with valid reasons, like emergencies that all household members are
also out of town.

SECTION 6: Schedule and Notice


(a) The schedule for the Barangay Assembly shall be determined and
announced by the Sangguniang Barangay at least two weeks before the
assembly date.

(b) Notice of the Barangay Assembly, including the date, time, and venue,
shall be posted in conspicuous places within the barangay and disseminated
through other appropriate means.
SECTION 7: Non-compliance Penalties
(a) Failure to comply with the mandatory attendance requirement may
result in penalties as determined by the Sangguniang Barangay.

(b) Penalties may include fines, community service, or other appropriate


measures as specified in subsequent resolutions or ordinances.

SECTION 8: Implementation

The Barangay Captain, through the Barangay Council, shall be responsible
for the effective implementation of this ordinance.

SECTION 9: Repealing Clause


All ordinances, resolutions, or parts thereof inconsistent with this ordinance
are hereby repealed or modified accordingly.

SECTION 10: Effectivity


This ordinance shall take effect fifteen (15) days after its approval and
posting in accordance with the provisions of the Local Government Code.

WHEREAS, Barangay Lactudan is in need of financial assistance to cover


various expenses associated with organizing and conducting the 65th Adlaw nan
Lactudan Celebration and 8th Sugba-Sugba Festival;

NOW THEREFORE, upon motion of Hon. Antonieto P. Mantilla, SBM and


seconded by the rest of the members present, as it was;

BE IT RESOLVED, as it is hereby resolved, by the Barangay Council of


Lactudan, Cagwait, Surigao del Sur, earnestly requests HON. JOSEFITO TAÑOLA
–SANGGUNIANG BAYAN MEMBER OF CAGWAIT, SURIGAO DEL SUR TO
ALLOCATE AN AMOUNT OF FIVE THOUSAND PESOS (₱5, 000.00) TO SUPPORT
BARANGAY LACTUDAN DURING OUR 65TH ADLAW NAN LACTUDAN
CELEBRATION AND 8TH SUGBA-SUGBA FESTIVAL ON JUNE 20-21, 2024.

RESOLVED FINALLY, that a copy of this resolution be furnished Hon.


Josefito Tañola and to the Office of the Sangguniang Bayan, for his information
and appropriate action.

UNANIMOUSLY APPROVED this 15TH day of JANUARY 2024 at


Barangay Lactudan, Cagwait, Surigao del Sur, Philippines.
