Dear Sir
This is in supersession to our communication cited above and reference to the meeting held on the PIU
dt.23.04.2024 wherein the recommendation for proposal of EOT were discussed and directed to the
Authority Engineer to re-examine the recommendation and link the proposal with supporting document
which are available with Authority Engineer and EPC contractor.
In view of above, we have re-examined the proposal/request of EPC contactor regarding (i) Revision of
Appointed Date, (ii) Grant of Extension of Time & shifting of Project Milestone due to various reasons of
delays which are not attributed to the Contactor and our pointwise observation/comments on the subjected
matter are hereunder;

x. As per above, we are of the opinion that the revision in the Appointed date in not tenable,
however the Authority can consider grant of EOT for the said period of 61days.
4. Due to delay in permission of tree cutting and the obstruction of land owners.
i. As per the EPC Contractor they were unable to remove/cut the trees from the project site due
to non-permission of concerned Forest Authority from km.0+000 to km.4+300 for cutting of
118 + 6646 trees. The permission granted by the Forest Authority on 23.02.2023 & the EPC
Contactor commenced the tree cutting. However, the land owners denied permission to EPC
contractor to enter into their respective lands to cut the trees on the ground that the
compensation against land acquisition was not paid to them. The EPC Contactor convinced the
land owners allowing them for the tree cutting work in this stretch and the work completed on
15.05.2023. As the tree cutting work done within the considerable time from AD and as the
Forest Authority has not revoked the permission of Tree cutting, hence the EOT for the section
not tenable.
ii. As per the EPC Contractor they were also unable to remove/cut the trees from the project site
due to non-permission of concerned Forest Authority from km.4+300 to km.7+000 for cutting
of 1759 trees. The permission granted by the Forest Authority on 27.02.2023 & the EPC
Contactor commenced the tree cutting. However, the land owners denied permission EPC
contractor to enter into their respective lands to cut the trees on the ground that the
compensation against land acquisition was not paid to them. The EPC Contactor convinced the
land owners allowing them for the tree cutting work in this stretch and the work completed on
26.06.2023. As the tree cutting work done within the considerable time from AD and as the
Forest Authority has not revoked the permission of Tree cutting, hence the EOT for the section
not tenable.
iii. As per the EPC Contractor they were also unable to remove/cut the trees from the project site
due to non-permission of concerned Forest Authority from km.7+000 to km.12+000 for cutting
of 2610 trees. The permission granted by the Forest Authority on 27.03.2023 & the EPC
Contactor commenced the tree cutting. However, the land owners denied permission EPC

contractor to enter into their respective lands to cut the trees on the ground that the
compensation against land acquisition was not paid to them. Meanwhile the Forest Authority
revoked the permission of Tree cutting from km.7+700 to km.10+300 dt.09.08.2023 and after
representation of PIU Moradabad dt.14.08.2023. The revised permission granted by the Forest
Authority on 19.08.2023. The EPC Contactor cut the tree with the help of Police and the work
was completed on 28.09.2023. the total delay of 109days occurred for the 5.000km length, for
which the weighted average delay is of 40 days for 13.700Km length.
iv. As per the EPC Contractor they were also unable to remove/cut the trees from the project site
due to non-permission of concerned Forest Authority from km.12+000 to km.13+700 for
cutting of 1290 trees. The permission granted by the Forest Authority on 07.08.2023 & the
EPC Contactor commence the tree cutting. However, the land owners denied permission EPC
contractor to enter into their respective lands to cut the trees on the ground that the
compensation against land acquisition was not paid to them. The EPC Contactor cut the tree
with the help of Police and the work was completed on 29.09.2023. The total delay of 97days
occurred for the 1.700km length, for which the weighted average delay is of 12 days for
13.700Km length.
v. In this regards, we would like to draw your kind attention towards the clause no. 9.4 of EPC
Contract Agreement which is reproduced hereunder;
9.4 Felling of trees
The Authority shall assist the Contractor in obtaining the Applicable Permits for felling
of trees to be identified by the Authority for this purpose if and only if such trees cause a
Material Adverse Effect on the construction or maintenance of the Project Highway. The
cost of such felling shall be borne by the Authority and in the event of any delay in felling
thereof for reasons beyond the control of the Contractor; it shall be excused for failure
to perform any of its obligations hereunder if such failure is a direct consequence of
delay in the felling of trees. The Parties hereto agree that the felled trees shall be deemed
to be owned by the Authority and shall be disposed in such manner and subject to such
conditions as the Authority may in its sole discretion deem appropriate. For the
avoidance of doubt, the Parties agree that if any felling of trees hereunder is in a forest
area, the Applicable Permit thereof shall be procured by the Authority within the time
specified in the Agreement.
vi. In view of above, it evident that the EPC Contractor faced difficulty is cutting of trees and the
reason for delay is not attributable to EPC Contractor.
vii. In accordance with the provisions of Article-9.4 of the EPC Agreement, the Authority shall
assist in obtaining the Applicable Permits for felling of trees in non-forest area to be identified
by the Authority for this purpose if, and only of, such trees a Material adverse Effect on the
construction of maintenance of the project highway. The contractor shall fell these trees as per
the permits obtained. The cost of such felling shall be borne by the Authority and in the event

in delay in felling thereof for reasons beyond the control of the Contractor, it shall be excused
for failure to perform any of its obligations hereunder if such failure is a direct consequence of
delay in the felling of trees.
viii. And accordingly, the EPC Contractor is entitled for the Extension of Time on account of delay
in permission of felling of trees due to hindered length.
ix. The tree cutting details summarized which is attached herewith as “Annexure-B”
5. Due to delay in permissions from other departments (Irrigation/PWD etc.) for crossing of
their Bund/Canals/Drains/Roads.
i. As per the EPC contractor the other departments (Irrigation/PWD etc.) has not permitted to
work in their area of canals.
ii. The over effect of delay is only 9 days’ extension of time and the issue is currently not closed.
The EPC contractor may apply for the extension of time for the reason after the final closer of
the issue as currently the applicability of EOT is indeterminable for the reason.
iii. However, we are in opinion that the All permits shall be obtained by the EPC contactor for the
executing the works of project highway. Therefore, the Extension of time for this reasons is
not tenable as per Authority Engineer.
In view of above, Summary of Delay events & its weighted delay reviewed by Authority Engineer and net
delay days after overlapping events and recommended delay days are enclosed as an “Annexure-I”.
In addition to this, the Strip Chart project highway showing the work done by the EPC Contactor on available
land as on date Milestone –I & II for your information and ready reference as “Annexure-II”.
Accordingly, the revised dates for the Project Milestone-I and Onwards with considering 120 days EOT.

In this regards, we would like to draw your kind attention towards the clause no.10.5 of EPC Contract
Agreement which reproduced hereunder;
(i) Without prejudice to any other provision of this Agreement for and in respect of extension
of time, the Contractor shall be entitled to extension of time in the Project Completion
Schedule (the "Time Extension") to the extent that completion of any Project Milestone is
or will be delayed by any of the following, namely:
As per Clause no.10.5 of EPC Contract Agreement, the EPC Contractor is therefore entitled for the Extension
of time of 120 days for the delays/reasons not attributed to EPC Contractor.
In addition to this, the other stretches shall not be applicable for the Interim Extension of time without
incurring damages and the price adjustment shall be freezed in accordance with the Original Project
Milestone.
The Interim Extension of time recommended as above to the EPC Contractor is subject to the condition that
without prejudice to the right of the Authority, the EPC Contractor should give an undertaking that no
damages/claim will be raised on account of the Interim Extension of Time granted by the Authority.
