e e Republic of the Philippines Province of Sarangani MUNICIPALITY OF MALUNGON OFFICE OF THE MAYOR EXECUTIVE ORDER_14 _ Series 2019 CREATION OF DRUG FREE WORKPLACE COMMITTEE AND ASESSMENT TEAM IN THE MUNICIPALITY OF MALUNGON WHEREAS, DDB Regulation No. 13 series of 2018, among others, provides for the establishment and institutionalization of drug free workplace policies in all government offices which includes the conduct of authorized drug testing for elective local officials and appointive public officer; WHEREAS, Executive No. 66, Series of 2018 directs all local government units to formulate and adopt their respective Drug Free Workplace Programs and conduct Authorized Drug Testing among their respective officials and personnel; WHEREAS, the Civil Service Commission, through Memorandum Circular NO. 13, Series of 2017 has provided for guidelines on the conduct of a mandatory random drug test for public officials and employees to ensure that public service remain drug-free as a condition for continuous employment; WHEREAS, Memorandum Circular No, 13, Series of 2017 of the CSC shall cover all ‘appointment public officials in all offices, including all constitutional bodies, departments, bureaus, and agencies of the national government, government-owned and controlled corporations, stateand local universities and college, and elective local officials of local government unit; WHEREAS, to maintain an atmosphere that is safe, secure, and healthy environment forthe protection of its workers, properties and reputation, an Executive Order for the creation of Drug-free Workplace Committee and an Assessment Team is deemed necessary; NOW, THEREFORE, I, ATTY. MARIA THERESA D. CONSTANTINO, Municipal Mayor of Municipality of Malungon, by virtue of the powers vested in me by law, do hereby create a Drug-free Workplace Committee and an Assessment Team to ensure the adoption and implementation of DDB Regulation NO. 13 series of 2018 as follows: SECTION 1.COMPOSITION. The Malungon Drug-Free Workplace Committee shall have the following Composition: Chairman: ATTY. MARIA THERESA D. CONSTANTINO Municipal Mayor Co-Chairman: DR. RAFAIDA G. HERNANDEZ Municipal Health Officer Members: MR. JESSIE A. DELA CRUZ LDRRMO/Municipal Administrator —Designate MS. RUTH A. ARANGOTE Municipal Social Welfare and Development Officer MS. ARLYNE J. GUILLEY-DEL ROSARIO LRO/HRMO-Designate MR. KING LLOYD ABELADO Agricultural Technician/Employee's Union President e e SECTION 2. ROLES AND RESPONSIBILITIES. The Malungon Drug-Free Work- place Committee (Committee, for brevity) shall have the following roles and responsibility: a. Formulate/update the LGUs own Drug Free Workplace Policy/ies; b. Ensure that workplace polices and programs on the prevention and control of dangerous drugs, including drug testing, shall be disseminated to all officers and employees; , Maintain a drug-free workplace; 4d. Ensure that all employees undergo assessment/pre-employment drug testing in accordance with the Civil Service rules; e. Cause the conduct of substance abuse awareness and prevention program/s; f. Cause the conduct of mandatory drug testing in accordance with CSC Memorandum Circular No. 13, Series of 2017; 9. Ensure adequate funding for the implementation of Drug-free Workplace Policy; fh. Perform such other functions as may be necessary to carry out the above ‘enumerated functions. SECTION 3. The Malungon Drug-Free Workplace Assessment Team shall have the following composition. Chairman: DR. RAFAIDA G. HERNANDEZ Municipal Health Officer Co-Chairman: MS. RUTH A. ARANGOTE Municipal Social Welfare and Development Officer, Member : DR. JEC M. PANE Medical Officer V MS. ARLYNE J. GUILLEY-DEL ROSARIO LRO/HRMO-Designate SECTION 4. ROLES AND RESPONSIBILITIES. The Team shall have the following duties and responsibilities: 2. Assist in the conduct of substance abuse awareness and prevention programs; b. Ensure that all employees undergo assessment/pre-employment drug testing; . Maintain the confidentiality of all information relating to drug-tests or to the identification of drug users in the workplace; d. Evaluate the results and determine the level of care and administrative interventions that can be extended to the concerned employee e. Evaluate status of drug dependent employee and recommend to the employer the resumption of the employees and/or the workplace in accordance with CSC Memorandum Circular No. 13, Series of 2017; f. Recommendation to the Committee an appropriation interventions for those who test positive in using illegal drugs in accordance with the existing DDB and Civil Service rules and regulations; g. Perform such other functions as may be necessary to carry out above enumerated functions. SECTION 5. SEPARABILITY CLAUSE. In case any provision in this policy may be found invalid, inconsistent or unenforceable, the validity, legality and enforceability of the remaining provisions shall not In any way be affected or imparted thereby.
