Affidavit of Explanation
I, Maria V. Malang, married, of legal age, residing at San Fernando, Pampanga,
owner and sole proprietor of Bembem Agricultural Products Wholesaling would like to
inform you that;
1. The Agricultural Training Institute – Regional Training Center III, is a government
agency located in San Ramon, Dinalupihan, Bataan, is inviting prospective bidder to
participate in competitive bidding with a Project Title – Supply and Delivery of
Extension Support (Free Range Chicken, Upgraded Goats, Feeds and Forage Seeds)
to the Beneficiaries of Binhi ng Pag-asa Program of Bataan and Tarlac consisting of
Lot 1 and Lot 2 as posted in their PhilGEPS Advertisement on October 14, 2022.
2. Our company, the Bembem Agricultural Products Wholesaling, has submitted its
intent to participate in the competitive bidding on Project Title Lot 1 – Supply and
Delivery of Extension Support (Free Range Chicken, Upgraded Goats, Feeds and
Forage Seeds) to the Beneficiaries of Binhi ng Pag-asa Program of Bataan and
Tarlac at Agricultural Training Institute – Regional Training Center III dated
November 3, 2022 and acknowledged on November 4, 2022.
3. Prior to the submission of intent, Mr. Daniel M. Tuazon in good faith, had a
communication with Ms. Erica Joyce A. Dacanay, School Administrator of
Sunnyside Training Center and Integrated Farms Inc., thru calls and text messages
on October 28, 2022 as shown in Appendix A, the latter allowing the use of the
AWA Certificate of Sunnyside Training and Integrated Farm Inc. for a future
business transaction.
4. Mr. Daniel M. Tuazon is my son-in-law, and I hereby affirmed that I allow him to
transact with Sunnyside Training Center Integrated Farm on my behalf and behalf of
Bembem Agricultural Products Wholesaling.
5. On November 7, 2022 during the opening of bids, our company attached in the
bidding documents the AWA Certificate of Sunnyside Training Center and
Integrated Farms Inc., as possible supplier of our free range chicken to be delivered
in case the project in item no. 1 will be awarded to our company, (see Appendix C)
since we know that Sunnyside Training Center and Integrated Farm Inc., is an
accredited learning site for agriculture of ATI RTC III and believed that there will be
a good connection between both parties.
6. During the bid evaluation on November 7, 2022, our company was determined to
have the lowest calculated bid on Project Title Lot 1 – Supply and Delivery of
Extension Support (Free Range Chicken, Upgraded Goats, Feeds and Forage Seeds)
to the Beneficiaries of Binhi ng Pag-asa Program of Bataan and Tarlac at
Agricultural Training Institute – Regional Training Center III.
7. However, during the post qualification of bids, it was determined by our company
that Sunnyside Training Center and Integrated Farm Inc. cannot supply the
requirements needed as stated in the Technical Specification stated in the Philippine
Bidding Document No. ATIRTC3-2022PB-06 due to difficulty of reaching out to
the latter as they are avoiding communication with us as seen in Appendix D
showing unanswered calls and text message logs. Thus, we came to the decision of
submitting the AWA Certification of another supplier Heritage Veterinary
Corporation as required by the members of TWG during the time of post
qualification.
8. During post qualification, the ATI Bids and Awards Committee and Technical
Working Group required our company to present a legal document between our
company and Sunnyside Training Center and Integrated Farm Inc., In regard to the
aforementioned, we believe that our evidence presented was obviously that to show
their credentials as future reference for possible supplier because we were not yet
sure that our company will be determined as the winning bidder in the project stated
in item 1.
9. Since there is no contract awarded and no delivery has happened yet from our
company with Agricultural Training Institute – Regional Training Center III, the
company believes that Sunnyside Training Center and Integrated Farms Inc.’s
credentials were not defamed because they were only presented as reference for
possible supplier and not been used for any transactions.
10. Since there was a text message between Mr. Daniel M. Tuazon and Ms. Erica Joyce
Dacanay, that the latter consented to the presentation of AWA Certificate, we were
at the impression, in good faith, that we are allowed to do so.
11. Due to all aforementioned statements, I was obviously that our company is in good
faith to transact with Sunnyside Training Center and Integrated Farm Inc., and in
any case that clarification warrants, our company is willing to communicate.
