Law No 143

of 26 July 2000

concerning the fight against illicit drug trafficking and use

ISSUED BY: THE PARLIAMENT


PUBLISHED IN: THE OFFICIAL GAZETTE OF ROMANIA No 362 of 3 August 2000

The Parliament of Romania hereby adopts this Law.

CHAPTER I

GENERAL PROVISIONS

Article 1

In this Law, the terms and expressions below shall have the following meaning:

a) “substances subject to national control” means drugs and drug precursors listed in
Schedules I–IV in the Annex, which are part of this Law; the schedules can be amended by
the Government Emergency Ordinance by registering new plants or substances, by
deregistering a plant or substance, or by transferring such plants or substances from one
schedule to another, upon the proposal of the Minister of Health;

b) “drugs” means plants and narcotic drugs or psychotropic substances or mixtures containing
such plants and substances, as listed in Schedules I–III;

c) “high-risk drugs” means any drug listed in Schedules I and II;

d) “risk drugs” means any drug listed in Schedule III;

e) “drug precursors” means any substance frequently used to produce drugs, as listed in
Schedule IV;

f) “toxic chemical inhalants” means any substance established as such by order of the
Minister of Health;
g) “illicit drugs use” means the use of drugs subject to national control, without a medical
prescription;

h) “drug addicted person” means any person who is in a state of physical and/or psychic
addiction caused by the use of drugs, as certified by one of the medical units, duly designated
thereto by the Ministry of Health;

i) “detoxification treatment” and “medical supervision” mean the measures that can be taken
in order to suppress physical and/or psychic drug addiction;

j) “controlled delivery” means the method used by the duly designated institutions or bodies,
subject to authorization and control of the public prosecutor, consisting in granting permission
to passage or transit, throughout the national territory, of narcotic drugs or drug precursors,
suspected of being illegally delivered, or of substances replacing narcotic drugs or drug
precursors, in order to discover the criminal activities and to identify the persons involved in
such activities;

k) “undercover investigators” means police officers especially appointed to carry out


investigations, following the authorization of the public prosecutor, in order to collect data on
crime existence and identification of offenders, as well as preliminary acts, while operating
under another identity than the real one, assigned for a definite period of time.

CHAPTER II

PENALTIES FOR DRUG TRAFFICKING AND OTHER ILLICIT


OPERATIONS INVOLVING SUBSTANCES SUBJECT TO NATIONAL CONTROL

Article 2

(1) Unlawful cultivation, production, manufacture, experimentation, extraction, processing,


transformation, provision, placing on the market, selling, distribution, delivery under any title,
shipment, transport, buying, purchase, possession or any other operation involving risk drug
movement are punishable by a prison sentence of 3 to 15 years and prohibition of certain
rights.
(2) If the facts provided for in paragraph (1) involve high-risk drugs, the penalty shall be a
prison sentence of 10 to 20 years and prohibition of certain rights.

Article 3

(1) The entry or withdrawal from the country, as well as the import or export of risk drugs,
without a legal authorization, are punishable by a prison sentence of 10 to 20 years and
prohibition of certain rights.

(2) If the facts provided for in paragraph (1) involve high-risk drugs, the penalty shall be a
prison sentence of 15 to 25 years and prohibition of certain rights.

Article 4

Unlawful cultivation, production, manufacture, experimentation, extraction, processing,


transformation, purchase or possession of drugs for personal use are punishable by a prison
sentence of 2 to 5 years.

Article 5

Deliberate provision, under any title, of premises, houses or any other location with public
access, for illicit drug use or allowing for illicit use in such places shall be punished by a
prison sentence of 3 to 5 years and prohibition of certain rights.

Article 6

(1) Deliberate prescription of high-risk drugs, by a physician, when the prescription is not
necessary from the medical point of view, shall be punished by a prison sentence of 1 to 5
years.

(2) Deliberately dispensing or obtaining high-risk drugs, based on a medical prescription


drawn up under the conditions provided for in paragraph (1) or based on a false medical
prescription, shall also be punished by the same sanction.

Article 7
Administration of high-risk drugs to a person, by violating the Law, shall be punished by a
prison sentence of 6 months to 4 years.

Article 8

Providing, in view of using, toxic chemical inhalants to a minor shall be punished by a prison
sentence of 6 months to 2 years, or by fine.

Article 9

Production, manufacture, import, export, provision, selling, transport, delivery under any title,
shipment, buying, purchase or possession of drug precursors, equipment or material with a
view to use them for the illicit cultivation, production or manufacture of high-risk drugs shall
be punished by a prison sentence of 3 to 10 years and prohibition of certain rights.

Article 10

Organizing, leading or financing the criminal offences referred to in Articles 2–9 shall be
punished by the sanctions provided for in the Law for such offences, with a three-year
increase of the maximum limits.

Article 11

(1) Should the encouragement, by any means, to the illicit drugs use be followed by
accomplishment, it shall be punished by a sentence of 6 months to 5 years.

(2) If the encouragement is not followed by accomplishment, it shall be punished either by a


prison sentence of 6 months to 2 years or by a fine.

Article 12

(1) The criminal offences provided for in Articles 2, 3 and 5 are punishable by a sentence of
life imprisonment or by a prison sentence of 15 to 25 years and prohibition of certain rights, if
the person that has committed them belongs to an organization or association or to a group of
at least three members, with definite structures and established with a view to commit such
criminal offences and to obtain material or other illicit benefits.

(2) The criminal offences provided for in Articles 4, 6, 7, 9 and 11, when committed under the
conditions stipulated under paragraph (1), are punishable by a prison sentence of 3 to 15
years.

(3) In case of the offences provided for in paragraphs (1) and (2), if they lead to the victim’s
death, the sentence shall be life imprisonment or imprisonment of 15 to 25 years and
prohibition of certain rights.

Article 13

(1) The attempt to commit any of the offences provided for in Articles 2-7, 9 and 10 shall be
punished.

(2) Production or procurement of means or instruments, as well as the measures taken with
the aim of committing any of the offences provided for in paragraph (1), shall also be
considered attempted offences.

Article 14

In relation to the offences included in this Chapter, in addition to the situations provided for in
the Criminal Code, the following situations shall qualify as aggravating circumstances:

a) the person who committed the offence had a duty involving the exercise of public
authority, and the criminal offence was committed while exercising this duty;

b) the criminal offence was committed by a medical agent or by a person with statutory
responsibilities in the fight against drugs;

c) the drugs were sent and delivered, distributed or offered to a minor, a mentally disordered
person, to a person undergoing detoxification or under medical supervision, or other such
forbidden activities were carried out in relation to any of the said persons, or the offence was
committed in a medical, education, military institution or unit, in prisons, social assistance or
rehabilitation centres, or medical educational institutions, places where pupils, students or
other young persons carry out educational, sports, social activities, or anywhere in the
proximity of the said locations;

d) minors are used to commit any of the criminal offences provided for in Articles 2-11;

e) the drugs were mixed with other substances, thus increasing the risk to the life and integrity
of the persons.

Article 15

The person who, before the initiation of prosecutions, denounces to the competent authorities
his/her participation in an association or agreement with the view to commit any of the
offences provided for in Articles 2-10, thus enabling to identify and hold liable of penal
responsibility the other participants, shall not be punished.

Article 16

The person who has committed any of the offences provided for in Articles 2-10 and who,
during the criminal prosecution, denounces and facilitates the way to identify and hold liable
of penal responsibility other persons that have committed offences relating to drugs, shall
benefit from the reduction to half of the statutory penalty limits.

Article 17

(1) Drugs and other goods related to the offences provided for in Articles 2-10 shall be
confiscated and if they are not found, the convict is legally bound to pay their corresponding
value in cash.

(2) Money, securities or any other goods acquired by disposal of drugs and other goods
provided for in paragraph (1) shall also be confiscated.

Article 18

(1) Confiscated drugs shall be destroyed. It is compulsory to keep counter proofs.


(2) The following shall be exempted from destruction:

a) usable medicinal products, that have been remitted to pharmacies or hospital units,
following the pre-notification given by the Pharmaceutical Directorate within the Ministry
of Health;

b) plants and substances usable in the pharmaceutical industry or other industry, depending
on their nature, that have been remitted to a public or private economic agent licensed to
use or export such plants and substances;

c) certain corresponding amounts, that shall be kept for the purposes of education and
scientific research, or that have been remitted to institutions using dogs and other animals
for detecting drugs, for preparing and maintaining their training, according to the legal
provisions.

(3) The drugs shall be destroyed regularly, by incineration or other adequate means, by a
commission consisting of one representative of each of the following institutions: the Public
Prosecutor’s Office attached to the Supreme Court of Justice, the Ministry of Health – the
Pharmaceutical Directorate, the Ministry of Waters, Forests and Environment Protection, and
of an expert within the central unit for the fight against illicit drug trafficking of the General
Inspectorate of Romanian Police and the person responsible for the corpus delicti department
in the same unit.

Article 19

If a drug addict is convicted for committing an offence, the provisions of the Criminal Code
and of the Criminal Procedure Code shall apply as appropriate.

CHAPTER III

PROCEDURAL PROVISIONS

Article 20
Upon the request of legally authorized institutions or bodies, the Public Prosecutor’s Office
attached to the Supreme Court of Justice may approve controlled deliveries, whether the drugs
or drug precursors are totally replaced or not.

Article 21

(1) The Prosecutor may authorize the use of undercover investigators to discover the criminal
offences, to identify the crime authors and to obtain evidence, when there are solid grounds to
believe that any of the crimes provided for in this Law has been committed or is going to be
committed.

(2) Authorization shall be granted in written form for a period of maximum 60 days and may
be extended, on solid grounds, for periods not exceeding 30 days each.

Article 22

(1) Police officers within the specialized units, operating as undercover investigators, and
their collaborators may procure drugs, chemical substances, essential and precursors,
following the pre-authorization by the Prosecutor, with a view to discover criminal activities
and to identify the persons involved in such activities.

(2) The reports made by police officers and their collaborators, as provided for in paragraph
(1), may be considered as evidence.

Article 23

(1) If there is solid evidence that a person who is going to commit any of the crimes provided
for in this Law or who has committed such a crime is making use of telecommunications or
IT systems, the criminal prosecution body may be granted access to these systems and keep
them under surveillance for a definite period of time, following the authorization by the
Prosecutor.

(2) The provisions of Article 91(1)-(5) of the Criminal Procedure Code shall apply as
appropriate.
Article 24

Searching can be carried out in the places where there is evidence that any of the crimes
provided for in this Law has been committed or is going to be committed, according to the
provisions of the Criminal Procedure Code.

Article 25

(1) If there is solid evidence that a person is a drug carrier and conceals drugs in his/her body,
the criminal prosecution body shall order medical examinations for drug detection upon
written consent of the examinee. In case of refusal, the Prosecutor’s authorization shall be
required and it shall also mention the medical unit designated to carry out these medical
examinations.

(2) The reports on the result of medical examinations, as well as those on the way they were
carried out, shall be immediately communicated to the Prosecutor or, if necessary, to the
criminal prosecution body that requested them.

Article 26

The central unit for the fight against illicit drug trafficking within the General Inspectorate of
Romanian Police is the only unit to coordinate and centralize all the data related to drugs,
essential chemical substances, precursors and toxic chemical inhalants.

CHAPTER IV

MEASURES AGAINST ILLICIT DRUG USE

Article 27

(1) Illicit use of drugs subject to national control, without a medical prescription, is prohibited
throughout the Romanian territory.

(2) The person using illicit drugs under national control shall be subject, as necessary, to one
of the following measures: detoxification treatment or medical supervision.
(3) The measures provided for in paragraph (2) shall be set out by one of the medical units
designated by the Ministry of Health, on the basis of a forensic expertise.

(4) Appeals can be made against the decision of the medical unit, within 10 days of the
notification, to the court responsible for the medical unit in question.

(5) Appeals may be made against the court order.

Article 28

(1) Detoxification treatment shall be provided in inpatient care, in one of the medical units
designated by the Ministry of Health, that are bound to verify regularly whether the treatment
should continue.

(2) When detoxification treatment is not necessary, the person shall be subject to medical
supervision in a public or private medical unit among those designated by the Ministry of
Health, that shall take the necessary medical measures, taking into consideration the person’s
health status, personality and social background to which he/she belongs.

(3) Medical supervision shall be provided continually or temporarily by one of the medical
units provided for in paragraph (2), together with a family, a person or a group of persons,
which have the skills as such supervision may require.

(4) The expenses related to detoxification treatment or medical supervision, as well as to the
forensic expertise, shall be incurred by the state and, depending on the resources, by the
respective person, the family or a private body, under the conditions set out in a Joint Order of
the Ministers of Health and Finance.

(5) The Ministers of Justice and Health shall establish by a joint order the medical and
educational measures to be applied to drug addicts in penal institutions.

Article 29

(1) Drug addicts that willingly choose to undergo treatment in a specialized medical unit or
dispensary may require confidentiality.
(2) Drug addicts that have undergone treatment under the conditions provided for in
paragraph (1) shall be granted, upon their request, a nominal certificate specifying the issuing
unit, identification data of the respective person, duration and object of the treatment, health
status upon completion or interruption of treatment.

Article 30

Any person with knowledge about a drug-user may notify one of the medical units designated
by the Ministry of Health that shall proceed according to the Law.

CHAPTER V

FINAL PROVISIONS

Article 31

Within 60 days of the entry into force of this Law and upon the approval of the Ministries of
Interior, Justice and Finance, the Ministry of Health shall issue the Regulation for
implementing the provisions of this Law that shall be approved by a Government Decision.

Article 32

Upon the entry into force of this Law, the provisions of Article 312 of the Criminal Code
concerning narcotic products or drugs, as well as any other contrary provisions, shall be
repealed.

This Law has been adopted by the Senate during the meeting of 9 May 2000, in compliance
with the provisions of Article 74(1) of the Constitution of Romania.
