Sub: Notice against non-delivery of vehicle and deficiency of


services by you.

Dear Sir,

We act on behalf of Mr. SUMEDHA S KAUNDINYA, S/o D. S.


Pramod, aged about 21 years, residing at No. 555, 6 th Main, 1st
Cross, Hanumanthanagar, Goviopuram Extension, Bangalore 560
019.(“Our Client”)

1. Our client informs us that the First of you is an Indian electric


two-wheeler manufacturer, based in Bengaluru. Having your
manufacturing plant located at Krishnagiri, Tamil Nadu in
India.

2. Our client informs us that the Second of you is an Experience


Centre, where the probable consumers visit when they look for
information regarding purchase of Ola Scooters, financing for
vehicles, test ride and all kinds of service support.

3. Our client informs us that the Third to Eleventh of you are the
Directors of the First of your company, dealing with day-to-day
functions of the First of your company.

4. Our client informs us that on 5th Jan, our client approached the
Second of you showing interest to buy the OLA S1 variant.
Subsequently based on the representations and assurances
made by the agents of the Second of you, our client went ahead
and booked an OLA S1 variant by paying the booking charges
of Rs. 19,602/- (Rupees Nineteen Thousand Six Hundred and
Two only). The aforementioned amount was paid under 2
invoices dated 05/01/2023, by virtue of the said invoice dated
05/01/2023 you confirmed the booing of the OLA Si Variant on
our client’s name and further generated a booking ID Bearing
No. OET-186011614050123-HYH361.

5. Our client informs us that the second of you helped our client
to avail a loan facility to a tune of approximately Rs. 93,000/-
(Rupees Ninety-Three Thousand only). In order to assist our
client in purchasing the said OLA S1 Variant. Our client further
informs us that, the said loan facility was approved to our
client based on his SIBIL score other factors furnished by our
client.

6. Our client informs us that during the time of booking the


Second of you has promised that the vehicle would be
delivered to him within completion of 15 days from the date of
booking and further assured that there would not be delay in
any sort with respect to the delivery.

7. Our client informs us that on 12/01/2023 the Second of you


sent a mail to our client stating that his vehicle booked under
Booking ID No. OET-186011614050123-HYH361 was ready
and the same was undergoing registration process and that the
registration team would reach out to our client and inform him
about the date of delivery of the vehicle, subsequently our
client received a call from the assured that the vehicle will be
delivered on the next date that is 13/01/2023.
8. Our client informs us that, to the dismay of our client the
vehicle was not delivered to him on 13/01/2023, when our
client called the registration team of the Second of you, to the
shock on surprise of our client, you responded on a very
callous manner and assured that the vehicle will be delivered
on 14/01/2023. To the surprise on shock of my client you
again failed to deliver the booked vehicle to our client.

9. Our client informs us that, our client has been trying to reach
the Second of you and their agents by means of phone calls and
mails at many instances, but all the efforts made by our client
went in vein. Our client further informs us that the Second of
you has still not delivered the booked vehicle to our client.

10. Our client informs us that, as on 23/01/2023 the Booked


OLA S1 variant was still not delivered to our client and there
was no response that was given to him to that effect despite his
several efforts. It is pertinent to mention here that an agent of
the Second of you One Mr. Yogananda, responded to the call
placed by my client and in a very unprofessionally represented
to our client that there will be a delay in the delivery of the
vehicle and further threatened our client with dire
consequences if he does not stop pursuing about the same. It is
pertinent to mention here that our Indian Judicial System is a
very honourable institution and has always succeeded in
delivering justice to anyone who has approached seeking
justice, our client represented that he will be paying his first
EMI in the short forthcoming and that the vehicle was still not
delivered to him even after the many failed assurances
delivered by the Second of you, the aforementioned Mr.
Yogananda (the agent of the Second of you) in a very callous
manner stated that our client can approach the issue legally
and the said Mr. Yoganada having no regards towards the same
would deliberately make efforts to delay the delivery of the
vehicle and further cause loss to our client.

11. Our client informs us that, our client has spent many
working hours and money to get a response from your end but
all his efforts have gone in vein. The Second of you with a
malafied intention to cause mental harm and financial loss to
our client have adopted this manner of providing poor service
to our client and have further gone ahead and made a mockery
of the Indian Judicial system as well.

12. Our client informs us that, you have created unnecessary


financial loss and mental pressure to our client and damaged
reputation of our client by breaking promises resulting in
causing huge financial loss to our client as he is liable to pay
EMI to an undelivered vehicle and has to choose other means
of transport at his own expense as you have at many instances
failed to deliver the promises made by you.

13. Our client informs us that, That you have committed


cheating, fraud and breach of trust by making false assurances
about the delivery of the vehicle and our client and cheated our
client by making illegal profits at the cost of our client.

In such facts and circumstances, as stated herein above in the


present legal notice, I hereby call upon you, the addressee, deliver
the OLA S1 Variant vehicle booked by our client vide Booking I D
No. OET-186011614050123-HYH361, immediately within 15
days from the receipt of this lawyer notice, failing which, I shall be
constrained to take shelter of the court of law at your cost,
damages, compensation, and consequences, accordingly.
We, further, call upon you through this legal notice to pay a sum of
Rs. 15,000/- (Rupees Fifteen Thousand only) i.e. cost of the
communication incurred by our client (which he would not have
had to if the vehicle was delivered to him as promised and
assured) and other Expenses of Rs. 5,000/- (Rupees Five
Thousand only) spent for conveyance and telephone calls, to our
client with 13.50% interest within a period of 7 days from the
receipt of this legal notice failing which our client shall be
constrained to file civil as well as criminal complaint against all
the responsible directors and staff of you in the court of law,
inform sales tax and other department about your tax evasion
methods/fraudulent accounting system and in that event you
might be burdened with all fees and risks which please note
carefully.

You are further liable to pay a sum of Rs. 10,000/- (Rupees Ten
thousand) as necessary cost and expenses of sending the present
legal notice to you.

Copy of this legal notice is also kept at our office for further ready
reference it required in future.
