DEED OF EXTRAJUDICIAL SETTLEMENT OF ESTATE OF x WITH DEED OF
DONATION
I, SON OF GREGORIA, American citizen, of legal age, single, and a
resident of x U.S.A., after having been duly sworn to in accordance with law,
depose and state:
1. That I am the sole heir of x, who is also an American citizen, of
legal age and a resident of x died intestate on 01 January 2023 as evidenced by
her Death Certificate issued by the _____________ hereto attached as Annex
“A” and made an integral part hereof;
2. That at the time of death, the Deceased left a property in the
Philippines covered by TCT No.x and more particularly described as follows:

3. That at the time of the Decedent’s death, she has no known
obligations to whomsoever for which her above-described property can be made
liable;
4. That the decedent is not survived by any ascendants, descendants
nor any collateral relatives who may qualify as successors-in-interest, except
myself as her son and only legal heir;
5. That pursuant to Rule 74, Sec. 1 of the Revised Rules of Court, I
hereby adjudicate unto myself the above-described property by means of this
Affidavit and hereby file the same with the Registry of Deeds with the request
that the said adjudication be made effective without judicial proceeding as
prescribed by the aforementioned provision of the Rules of Court, after the
corresponding Estate Tax assessable thereon by the Bureau of Internal Revenue
(BIR) is settled, if any, and upon payment of all other taxes due the local
government unit, as may be appropriate and necessary to facilitate the transfer of
the properties herein mentioned.
- BY WAY OF DONATION -
As I inherited the subject property by way of succession, I hereby donate
the same to xad, B.F. Homes, Almanza, Las Pinas City.
That for and in consideration of the love and affection which the DONOR
has for the DONEES, the said DONOR, by these presents, TRANSFERS AND
CONVEYS, BY WAY OF DONATION, unto said DONEES, their heirs and
assigns, the above-described real property with all the improvements
thereon, free from all liens and encumbrances.
That the DONOR does hereby state, for the purpose of giving full effect to
this donation, that he has reserved for himself in full ownership sufficient property
to support him in a manner appropriate to his needs.
That the DONEES hereby ACCEPT THIS DONATION of the above-
described property, and do hereby express gratitude for the kindness and
liberality of the DONOR.
