Delivery Time
As per stated on each parts, ex-Germany + Approx. 2-4 weeks shipping time via sea,
upon receiving the purchase order and final acceptance of all technical and commercial issues. Delivery dates are calculated on the transfer of risk according to the Incoterm
Delivery Term:
Incoterm: Contractual basis as per Incoterm 2010.
Carriage Paid To (CPT) Brunei Seaport, packing included, without oil filling, without installation,
without guard and without VAT.
Liability for delay in delivery:
Per full week 0.5% of the value of the goods delivered in delay, but in total not more than 5% of the value of the goods delivered in delay.
This shall be your sole and exclusive remedy for delay in delivery, unless liability is mandatory by
law.

Liability for warranty

The limitation period for warranty claims is 12 months after commissioning or 15 months after delivery, whatever occurs first.
In case of defects attributable to Voith, Voith shall, at its discretion, repair or replace the defective good.
Voith shall be liable for defects and legal imperfections in title due to its fault to the exclusion of further claims - subject to liability clause below - as stipulated in Section 1

General Liability
Voith limits any liability in respect of non-insured risks, whether in contract, tort or otherwise,
for any damage or loss, arising out of this Contract or any of the Voith’s products & parts supplied pursuant hereto up to an aggregate limit of twenty-five percent (25)% of
price.
Voith excludes all liability for any indirect, incidental or consequential expense, loss, damages or cost, loss of profits, revenue or business interruption arising in any way o
relation to
these general terms and conditions of sale and otherwise at law, equity, common law or by operation
of statute, whether or not the likelihood of such loss or damage was contemplated.

In respect of insured risks, Voith accepts liability in respect of:-

(i) the death or injury to any person to a limit of Ringgit Malaysia (RM) one (1) million per person; or
(ii) the damage caused to the Purchaser’s and third party property by a fault (excluding damages for loss of use where the failure of an Equipment or any Voith’s product to
level of performance, quality, fitness or durability expressly or impliedly warranted or represented by
